(1) If it appears to the Registrar that an association has been incorporated under a name or a name of a kind referred to in subsection 37 (5) without the consent of the Minister, the Registrar may, by notice in writing to the association, direct the association to change its name.
(2) A direction to an association pursuant to subsection (1) has effect as if it were a special resolution of the association passed pursuant to subsection 38 (1).
