CORONERS ACT 1997 (NO. 57 OF 1997) - SECT 100

Deaths in institutions—retention of deceased's records

100. (1) Where a person dies while a patient in a hospital or other institution in circumstances in which a Coroner has jurisdiction to hold an inquest, the person in charge of the hospital or institution shall ensure that all records relating to that person are retained intact for not less than 3 years after the date of the death.

(2) Where a person dies in custody, the person in charge of the hospital or institution in which, or the agency in whose care or custody, the death occurred, shall ensure that records relating to that person are retained intact for not less than 7 years after the date of the death.

Penalty: 50 penalty units.
