CORONERS ACT 1997 (NO. 57 OF 1997) - SECT 83

Improper dealings with body or ashes of deceased

83. (1) A person shall not interfere with or remove the body or ashes of a deceased with intent to prevent or hinder the holding of the post-mortem examination or an analysis of the ashes, if the person has reason to believe that a post-mortem examination of the body or an analysis of the ashes has been, or may be, ordered under this Act.

Penalty:

        (a)     if the offender is a natural person—200 penalty units or imprisonment for 2 years, or both;

        (b)     if the offender is a body corporate—1,000 penalty units.

(2) A person shall not interfere with or remove the body or ashes of a deceased with intent to prevent or hinder the conducting of an inquest, if the person has reason to believe that an inquest has been, or may be, ordered under this Act.

Penalty:

        (a)     if the offender is a natural person—200 penalty units or imprisonment for 2 years, or both;

        (b)     if the offender is a body corporate—1,000 penalty units.
