HEALTH COMPLAINTS ACT 1993 (NO. 96 OF 1993) - SECT 21
21. A complaint to the Commissioner about a health service sought, used or received by, or administered to, a user may be made by the user or, where it is difficult or impossible for the user to make a complaint, or to make a complaint that complies with subsection 26 (1)—
(a) where the user has attained the
age of 18 years—by a person appointed by the user to make the complaint
on the user's behalf;
(b) where the
user has not attained the age of 18 years—by a parent or guardian of the
user;
(c) where a person, under any
other law or an order of a court, has the care of the affairs of the
user—by that person; or
(d)
by a person approved by the Commissioner to make the complaint on the user's
behalf.
