Australian Capital Territory Numbered Acts Australian Capital Territory Numbered Acts(1) The Minister may exempt a person, a radiation source or a dealing with a radiation source from this Act if the Minister is satisfied that the person's conduct, the radiation source or the dealing does not pose a significant risk to the health or safety of people or of damage to property or the environment.
Note 1 A reference to an Act includes a reference to a provision of an Act (see Legislation Act, s 7 (3)).
Note 2 A regulation may also provide for exemptions (see s 123).
(2) An exemption may be conditional.
(3) An exemption under subsection (1) has no effect to the extent that it is inconsistent with a regulation.
(4) An exemption is a disallowable instrument.
Note A disallowable instrument must be notified, and presented to the Legislative Assembly, under the Legislation Act.
(5) In deciding whether to exempt a person, radiation source or a dealing with a radiation source, the Minister must take into account any criteria prescribed by regulation.
