SMOKING (PROHIBITION IN ENCLOSED PUBLIC PLACES) AMENDMENT ACT 2009 (NO. 51 OF 2009) - SECT 8

New section 5B (3) and (4)

after the note, insert

    (3)     However, a person does not smoke if the person holds or has control over a smoking product for the purpose only of extinguishing it or removing it from—

        (a)     an enclosed public place; or

        (b)     an outdoor eating or drinking place; or

        (c)     an underage function.

    (4)     For this Act, each of the following is a smoking product :

        (a)     a tobacco product;

        (b)     a herbal product;

        (c)     any other product that is designed for smoking.
