TREE PROTECTION ACT 2005 (NO. 51 OF 2005) - SECT 21

    (1)     The Minister may, in writing, determine criteria (the approval criteria ) for approving an activity that would or may—

        (a)     damage a protected tree; or

        (b)     be prohibited groundwork in—

              (i)     the protection zone for a protected tree; or

              (ii)     a declared site.

    (2)     A determination is a disallowable instrument.

Note     A disallowable instrument must be notified, and presented to the Legislative Assembly, under the Legislation Act.
