MOTOR TRAFFIC REGULATIONS(AMENDMENT) (NO. 37 OF 1993) - REG 3

3. Regulation 32 of the Principal Regulations is repealed and the following regulation substituted:

Prescribed offences, penalties and demerit points

“32. (1) For the purposes of subsection 149 (1) of the Act, the prescribed penalty in respect of a parking infringement described in column 3 of an item in Part I of the Schedule, being an infringement of a provision of the Act specified in column 2 of the item, is the penalty specified in column 4 of the item.

“(2) For the purposes of subsection 180A (2) of the Act, a prescribed offence is an offence described in column 3 of an item in Part II or III of the Schedule that is an offence against a provision of the Act or these Regulations (as the case requires) specified in column 2 of the item.

“(3) For the purposes of section 180A of the Act, the prescribed penalty in respect of an offence prescribed by subregulation (2) is the penalty specified in column 4 of the item that relates to that offence.

“(4) For the purposes of section 180NB of the Act, a prescribed offence is an offence described in column 3 of an item in Part II of the Schedule—

        (a)     that is an offence prescribed by subregulation (2); and

        (b)     in respect of which a number of demerit points is specified in column 5 of the item.

“(5) For the purposes of section 180NB of the Act, the prescribed number of demerit points in respect of an offence prescribed by subregulation (4) is the number of demerit points specified in column 5 of the item that relates to that offence.

“(6) For the purposes of subsection 180NB(1) of the Act, the prescribed number of demerit points in respect of a corresponding offence (in this subregulation referred to as an ‘inter-State offence') is the number of demerit points specified in column 5 of the item in Part II of the Schedule that relates to the offence to which the inter-State offence corresponds.

“(7) For the purposes of paragraph 26A (f) of the Motor Traffic (Alcohol and Drugs) Act 1977 , the prescribed penalty in respect of an offence described in column 3 of an item in Part IV of the Schedule, being an offence against a provision of that Act specified in column 2 of the item, is the penalty specified in column 4 of the item.

“(8) For the purposes of paragraph 26A (g) of the Motor Traffic (Alcohol and Drugs) Act 1977 , the prescribed number of demerit points in respect of an offence described in column 3 of an item in Part IV of the Schedule, being an offence against a provision of that Act specified in column 2 of the item, is the number of demerit points specified in column 5 of the item.

“(9) For the purposes of section 6D of the Traffic Act 1937 , the prescribed penalty in respect of an offence described in column 3 of an item in Part V of the Schedule, being an offence against a provision of that Act specified in column 2 of the item, is the penalty specified in column 4 of the item.”.
