Births, Deaths and Marriages Registration Amendment Regulation 2009 (No 1)

Outline

The Civil Partnerships Amendment Act 2009 (No.2) makes several significant amendments to the Civil Partnerships Act 2008 (the Act), including amendments to provisions that allow same sex couples to enter into a civil partnership by making a declaration before a civil partnerships notary.

A number of amendments to the Births, Deaths and Marriages Registration Act 1997 ensure the proper registration of all civil partnerships entered into under the Civil Partnerships Act. This regulation makes consequential amendments to the Births, Deaths and Marriages Registration Regulation 1998.


Section 70 of the Births, Deaths and Marriages Registration Act 1997 provides that the Executive may make regulations for this Act.

Summary of clauses

1 – Name of regulation – this Regulation is the Births, Deaths and Marriages Registration Amendment Regulation 2009 (No 1).

2 – Commencement – provides for the Regulation to commence when the Civil Partnerships Amendment Act 2009 (No 2) commences.

3 – Legislation amended – this Regulation amends the Births, Deaths and Marriages Registration Regulation 1998.

4 – Section 8A(1) – omits a reference to section 32AA(4) of the Births, Deaths and Marriages Registration Act 1997, as that provision has been repealed.

5 – Section 8A(1)(b) – substitutes a new paragraph 8A(1)(b) to ensure that the particulars required to be provided under section 32AA(2) of the Births, Deaths and Marriages Registration Act 1998, as amended, are provided.

6 – Section 8A(2) – is omitted. The matters contained in this provision have been moved to section 8A(1)(b).
