Crimes (Sentencing) Amendment Regulation 2010 (No 1)


Overview of Regulation


The Crimes (Sentencing) Amendment Regulation 2010 (No 1) (the regulation) amends the Crimes (Sentencing) Regulation 2006 to prescribe the offence of negligent driving causing grievous bodily harm as an offence to which Part 4.3 of the Crimes (Sentencing) Act 2005 applies.

Clause Notes


Clause 1 Name of Regulation
This clause states that the title of the regulation is the Crimes (Sentencing) Amendment Regulation 2010 (No 1).

Clause 2 Commencement
This clause states that the regulation commences on the day after it is notified.

Clause 3 Legislation amended
This clause provides that this regulation amends the Crimes (Sentencing) Regulation 2006.

Clause 4 New section 1A
This clause prescribes the offence of negligent driving causing grievous bodily harm contained in section 6 of the Road Transport (Safety and Traffic Management) Act 1999 as an offence to which Part 4.3 of the Crimes (Sentencing) Act 2005 applies. This will allow people authorised under section 49 of the Crimes (Sentencing) Act 2005 to make a victim impact statement in relation to the offence of negligent driving causing grievous bodily harm.

This amendment is made under the regulation making power contained in section 48(b) of the Crimes (Sentencing) Act 2005.
