EXPLANATORY STATEMENT


Authority

This Regulation is authorised by section 155 of the Education Act 2004 (the Act).

Background

Section 38 of the Act provides that a school board is established for each government school. Section 41 of the Act prescribes the composition of a school board of a government school.

Section 41(2)(f) of the Act provides that only those schools prescribed in a regulation can have 2 student members elected by the students at the school and appointed by the Chief Executive.

Schedule 1 of the Education Regulation 2005 prescribes those schools whose school boards include 2 student members elected by the students at the school.

Purpose

This amendment regulation amends Schedule 1 of the Education Regulation 2005 to remove the names of schools that no longer exist (due to school closures and amalgamations) and to include the names of new schools (due to school amalgamations).

Details

A detailed explanation of each clause of the amendment regulation follows.

Clause 1 Name of regulation
The first clause of the Regulation specifies that the name of the regulation is the Education Amendment Regulation 2008 (No 1). The Regulation amends the Education Regulation 2005, which is the subordinate law to the Education Act 2004.



Clause 2 Commencement
Under this clause, this Regulation will commence on the day after the date it is notified on the ACT Legislation Register.

Clause 3 Legislation amended
This provision provides that this Regulation amends the Education Regulation 2005.

Clause 4 Schedule 1, part 1.1
This provision substitutes a new table in Schedule 1, Part 1.1, of the Education Regulation 2005 that:

• removes Ginninderra District High School – the school closed at the end of the 2005 school year

• removes Kambah High School – the school closed at the end of the 2007 school year

• changes Melba High School to Melba Copland Secondary School – Melba High School and Copland College amalgamated at the beginning of 2008 to become the Melba Copland Secondary School

• changes Caroline Chisholm High School to Caroline Chisholm School – Caroline Chisholm High School, Chisholm Primary School and Chisholm Preschool amalgamated at the beginning of 2008 to become the Caroline Chisholm School.


Clause 5 Schedule 1, part 1.2, item 2
This provision omits Schedule 1, Part 1.2, item 2 of the Education Regulation 2005 to remove Copland College as Melba High School and Copland College amalgamated at the beginning of 2008 to become the Melba Copland Secondary School.
