EXPLANATORY STATEMENT

This Regulation is authorised by section 134 of the Health Professionals Act 2004.

Outline


There are two amendments. The first amendment is to include the medical specialty of oral and maxillofacial surgery in the list of medical specialties contained in table 2.4 of schedule 2 (the medical practitioners’ schedule) of the Health Professionals Regulation 2004. The second amendment is to make a corresponding amendment to the list of specialties in table 6.7 of Schedule 6 (the dentists’ schedule) so that the wording of these specialties is consistent.

In respect of the first amendment, the inclusion of oral and maxillofacial surgery for medical practitioners follows the approval of this specialty by the Australian Medical Council (the AMC) which is the national accreditation body for the medical profession. The list in table 2.4 not only lists the areas of medical specialties but also the qualifications that have been approved by the AMC for the purpose of professional registration in that specialty area. It is imperative that the lists of specialties that have been approved by the AMC are kept up to date to ensure that registration decisions in the ACT are supported by the legislation.

In respect of the second amendment, this is necessary to ensure that the wording of this specialty is consistent as between the medical practitioners’ schedule and the dentists’ schedule.

Revenue/Cost Implications


There is no additional cost involved in this Regulation.

Formal Clauses


Clause 1 – Name of Regulation – states the title of the Regulation, which is the Health Professionals Amendment Regulation 2008 (No 1).

Clause 2 – Commencement – states when the Regulation commences. The provisions commence on the day after notification.

Clause 3 –Legislation amended – provides that this Regulation amends the Health Professionals Regulation 2004.

Clause 4 – Schedule 2, table 2.4, new item 11A – inserts a new item 11A, which includes oral and maxillofacial surgery in the list of medical specialties in table 2.4. The new item also includes a description of the qualification necessary to support professional registration in that medical specialty.

Clause 5 – Schedule 6, table 6.7, item 6 – inserts a new item 6 to ensure consistency in wording for the dentists’ schedule that also refers to this specialty.
