EXPLANATORY STATEMENT



The Road Transport (General) Act 1999 permits an authorised person to issue an infringement notice for an infringement notice offence under the road transport legislation. Offences for which an infringement notice can be issued, and the applicable penalties, are listed in the Road Transport (Offences) Regulation 2005.

The Road Transport (Offences) Amendment Regulation 2009 (No 1) (the Regulation) amends the Road Transport (Offences) Regulation 2005 to incorporate revised penalties effective from 7 December 2009.

The penalty amounts in the following Schedules have increased by 10% rounded down to the nearest dollar.

The infringement notice penalty for the offence of driving a vehicle without third-party insurance at item 1 in Part 1.13A of the Regulation has been increased from $484 to $543 to realign this penalty with the penalty for the offence of driving an unregistered vehicle.
