EXPLANATORY STATEMENT

Overview


The Road Transport (Safety and Traffic Management) Regulations Amendment 2002 amends the Road Transport (Safety and Traffic Management) Regulations 2000, made under the Road Transport (Safety and Traffic Management) Act 1999.

The amendments make provision for the establishment and operation of ticket (voucher) parking schemes managed by organisations other than the Road Transport Authority.

Regulation 76 of the Road Transport (Safety and Traffic Management) Regulations 2000 permits the Road Transport Authority to establish and operate a ticket parking scheme for any length of road or area. The wording of regulation 76 currently precludes any organisation other than the Road Transport Authority from operating a ticket parking scheme and have it enforced under the ACT Road Transport Legislation.

The amendments allow the Road Transport Authority to declare an organisation to be a Parking Authority who may establish and operate a ticket parking scheme for any length of road or area under its control in accordance with the Road Transport Authority guidelines.

Detail


The object of these regulation amendments is to:

(a) permit the Road Transport Authority to declare an organisation as a Parking Authority;

(b) make provision for the Parking Authority to establish and operate a ticket parking scheme;


(c) provide guidelines which are a disallowable instrument, for the establishment and operation of ticket parking areas managed by organisations other than the Road Transport Authority; and

(d) provide an appeal process under the Road Transport (General) Regulations 2000, in the event of the Road Transport Authority refusing to declare an organisation to be a Parking Authority.

It was brought to the attention of the Parliamentary Counsel’s Office that the cross reference in regulation 71(1)(a) of Road Transport (Safety and Traffic Management) Regulations 2000 was incorrect. An amendment with the correct provision for the exemption of police, emergency vehicles and authorised people has been inserted.

The power to make these regulations is found under section 42 of the Road Transport (Safety and Traffic Management) Act 1999.
