Explanatory Statement

OVERVIEW

This Regulation amends the Road Transport (Safety and Traffic Management) Regulation 2000 (the Regulation):

1. to add additional fixed red light/speed (intersection) camera sites to the schedule of the Regulation;

2. to provide for the use of fixed speed cameras on midblocks, and to define these sites;

3. to provide for the use of the Gatsometer Digital Radar Camera System (DRCS) device in mobile speed camera vans and fixed installations; and
4. to provide for the use of the Kustom Signals Inc, Silver Eagle II as a radar speed measuring device.

CLAUSES 1 TO 3 – FORMAL CLAUSES

Clauses 1 to 3 are formal clauses which:
• state the name of the regulation being created;
• provide for commencement of the regulation; and
• state the name of the regulation being amended.

CLAUSE 4 – SECTION 102, DEFINITION OF DIGITAL CAMERA DETECTION DEVICE
Clause 4 amends section 102 to include the Gatsometer Digital Radar Camera System (DRCS) as an approved digital camera detection device. A digital camera detection device is an approved traffic offence detection device for the purpose of the Road Transport (Safety and Traffic Management) Act 1999.
CLAUSE 5 – SECTION 102, NEW DEFINITION OF FIXED CAMERA DETECTION DEVICE

Clause 5 amends section 102 to insert a new definition of fixed camera detection device, and to include two additional devices – the Gatsometer Digital Radar Camera System (DRCS) and the Gatsometer Traffic Camera (GTC-GS11) – as approved fixed camera detection devices. A fixed camera detection device is an approved traffic offence detection device for the purpose of the Road Transport (Safety and Traffic Management) Act 1999. The Gatsometer DRCS is a radar device that can be used in both mobile and fixed installations. The Gatsometer GTC-GS11 is an updated version of the currently approved Gatsometer GTC-D device.


CLAUSE 6 – SECTION 102, DEFINITION OF RADAR SPEED MEASURING DEVICE

Clause 6 amends section 102 to include the Gatsometer Radar 24 and the Kustom Signals, Inc. Silver Eagle II as approved radar speed measuring devices. A radar speed measuring device is an approved traffic offence detection device for the purpose of the Road Transport (Safety and Traffic Management) Act 1999.


CLAUSE 7 – SECTION 102, DEFINITION OF TRAFFIC LIGHTS CAMERA DETECTION DEVICE

Clause 7 omits the definition of traffic lights camera detection device which has been replaced by the new definition of fixed camera detection device.


CLAUSE 8 – SECTION 103(1)

Clause 8 is consequential to the change in definition from traffic lights camera detection device to fixed camera detection device. Section 103 provides for the approval of various types of traffic offence detection devices under the Road Transport (Safety and Traffic Management) Act 1999.

CLAUSE 9 – SECTION 104A
Clause 9 provides for the testing of certain traffic offence detection devices, including the new devices covered by clauses 4, 5, and 6.

CLAUSE 10 – SECTION 105
Clause 10 amends section 105 to include the requirements for using radar based digital camera detection devices.

CLAUSE 11 – SECTION 105A
Clause 11 amends section 105A to clarify that the requirements for laser speed measuring devices used in mobile camera van operations are covered by section 105.

CLAUSE 12 – SECTION 105B
Clause 12 amends section 105B to clarify that the requirements for radar speed measuring devices used in fixed cameras and mobile camera van operations are covered by section 105.

CLAUSE 13 – SECTION 107(1)
Clause 13 is consequential on the new definition of fixed camera detection device.

CLAUSE 14 – SECTIONS 107A TO 107C
Clause 14 amends sections 107A to 107C to provide for the recording and verification of camera detection device image files. This clause uses the definition of camera detection device contained in the Road Transport (Safety and Traffic Management) Act 1999. The note after subsection 107(2) is amended to include the example of files sent by wireless network.

CLAUSE 15 – SECTION 108(3)
Clause 15 is consequential on the new definition for fixed camera detection device, and the use of new radar technology in mobile camera vans and fixed installations.

CLAUSE 16 – SECTION 108(9)(B)

Clause 16 is consequential on the new definition of fixed camera detection device.


CLAUSE 17 – SCHEDULE 1, PART 1.2, HEADING

Clause 17 is consequential on the new definition of fixed camera detection device.


CLAUSE 18 – SCHEDULE 1, PART 1.2, ITEM 23
Clause 18 re-orders the street names of existing item 23 to make it consistent with other sites. Clause 18 also adds two new fixed red light/speed (intersection) and ten fixed speed (midblock) camera sites to Schedule 1.

CLAUSE 19 – DICTIONARY, NOTE 3, NEW DOT POINTS

Clause 19 amends the note to the dictionary to include other terms that are defined in the Road Transport (Safety and Traffic Management) Act 1999.


CLAUSE 20 – DICTIONARY, NEW DEFINITION OF FIXED CAMERA DETECTION DEVICE

Clause 20 is consequential on the new definition of fixed camera detection device.

CLAUSE 21 – DICTIONARY, DEFINITION OF TRAFFIC LIGHTS CAMERA DETECTION DEVICE

Clause 21 is consequential on the omission of the definition of traffic lights camera detection device.
