Outline


The Trade Measurement (Weighbridges) Amendment Regulations 2002 (No 1) (the regulations) amend regulations 19, 25, 29, 30 and 31 of the Trade Measurement (Weighbridges) Regulations 1991 by changing the maximum penalty from a dollar amount to the corresponding number of penalty units. The monetary value of the penalties have not changed, but the wording is now in line with current drafting style and the penalty can be increased if the value of the penalty unit in the Legislation Act 2001 is increased.

Clause Notes


Regulation 1 – Name of regulations – provides that the regulations are the Trade Measurement (Weighbridges) Amendment Regulations 2002 (No 1).

Regulation 2 – Commencement – provides that the regulations commence on the day the Magistrates Court (Trade Measurement Infringement Notices) Regulations 2002 commence.

Regulation 3 – Regulations amended – provides that the regulations amend the Trade Measurement (Weighbridges) Regulations 1991.

Regulation 4 – Regulation 19 – provides that regulation 19 of the Trade Measurement (Weighbridges) Regulations 1991 is amended by changing the maximum penalty from $200 to 2 penalty units. The monetary value of the penalty has not changed, but the wording is now in line with current drafting style and the penalty can be increased if the value of the penalty unit in the Legislation Act 2001 is changed.

Regulation 5 – Regulation 25 – provides that regulation 25 of the Trade Measurement (Weighbridges) Regulations 1991 is amended by changing the maximum penalty from $2,000 to 20 penalty units. The monetary value of the penalty has not changed, but the wording is now in line with current drafting style and the penalty can be increased if the value of the penalty unit in the Legislation Act 2001 is changed.

Regulation 6 – Regulation 29 – provides that regulation 29 of the Trade Measurement (Weighbridges) Regulations 1991 is amended by changing the maximum penalty from $2,000 to 20 penalty units. The monetary value of the penalty has not changed, but the wording is now in line with current drafting style and the penalty can be increased if the value of the penalty unit in the Legislation Act 2001 is changed.

Regulation 7 – Regulation 30(1) – provides that regulation 30(1) of the Trade Measurement (Weighbridges) Regulations 1991 is amended by changing the maximum penalty from $2,000 to 20 penalty units. The monetary value of the penalty has not changed, but the wording is now in line with current drafting style and the penalty can be increased if the value of the penalty unit in the Legislation Act 2001 is changed.
