EXPLANATORY STATEMENT

PURPOSE


The Utilities (Electricity Transmission) Regulation 2006 (Regulation) is made under the Utilities Act 2000 (the Act), section 15. Its purpose is to prescribe the transmission of electricity through an electricity transmission network to be a utility service for the purpose of the Act.

BACKGROUND


TransGrid is the owner and operator of the high voltage electricity transmission system in NSW. Its network extends to the ACT border and is connected to the ACT electricity grid. This regulation will enable the Minister to declare electricity transmission to be a utility service and hence TransGrid will become an electricity transmission service provider in the ACT. This will enable the ACT to put in place the minimum reliability standards for electricity transmission service provided in the Territory.

DETAILS OF THE REGULATION


Section 1 provides that the name of the regulation as the Utilities (Electricity Transmission) Regulation 2005.

Section 2 provides the commencement date of the regulation as the day after its notification.

Section 3 deals with notes found in the regulation and provides that such notes are for explanatory purposes and do not form part of the Regulation.

Section 4 prescribes electricity transmission through a network declared under section 5 to be a utility service.

Section 5 provides that the Minister may declare, by making a notifiable instrument, a transmission system, or part of a transmission system, to be an electricity transmission network.
