AIR POLLUTION ACT 1984 (REPEALED) - SECT 26 26. (1) For the purposes of sections 23, 24, 24A and 24B, conduct engaged in on behalf of a body corporate by an employee or agent of the body corporate shall be deemed to have been engaged in also by the body corporate.

AIR POLLUTION ACT 1984 (REPEALED) - SECT 26

26. (1) For the purposes of sections 23, 24, 24A and 24B, conduct engaged in on behalf of a body corporate by an employee or agent of the body corporate shall be deemed to have been engaged in also by the body corporate.

(2) Subsection (1) does not apply where it is established that—

(a) the body corporate did not authorise or permit the conduct by its employee or agent; and

(b) all due diligence was exercised by or on behalf of the body corporate to prevent that conduct.
