(1) Any person who carries any goods on his or her person or on any animal or in or on any vehicle for the purpose of selling or offering for sale those goods, or who sells or offers for sale any goods carried on his or her person or on any animal or in or on any vehicle, shall, unless the person is the holder of an assistant hawker's licence, be deemed to be carrying on the business of a hawker within the meaning of this Act.
(2) Nothing in this Act applies to, or shall be deemed to affect in any way, the sale, delivery or distribution of newspapers by a child in accordance with the Children and Young People Act 1999 , chapter 10 (Employment of children and young people).
