This legislation has been repealed.
(1) This section applies in relation to a decision of the kind referred to in section 62 (1) (a) to (f) or section 63 (1) (a) to (f).
(2) A person is not entitled to make application under section 62 (1) or 63 (1) for review of a decision—
(a) until the period during which a request under section 38 (1) may be made has expired; or
(b) if a request in accordance with section 38 (1) has been made, until—
(i) the person who made the request is notified under section 38 (2) (c) of the outcome of the attempt to resolve the disagreement; or
(ii) the period referred to in section 38 (2) expires;
whichever occurs first.
(3)
Where a request has been made in accordance with section 38 (1) in
relation to a decision, the prescribed time for lodging an application under
section 62 (1) or 63 (1) for review of the decision is the period commencing
on the day on which the person who made the request becomes entitled under
subsection (2) to make the application and ending on the 28th day after that
day.
