ANIMAL WELFARE REGULATIONS


TABLE OF PROVISIONS

   PART I--PRELIMINARY CITATION 1. THESE REGULATIONS MAY BE CITED AS THE ANIMAL WELFARE REGULATIONS.

   2.      These Regulations commence on the day on which they are notified in the Gazette.  
   3.      In these Regulations, unless the contrary intention appears—“cattle” has the same meaning as in the Stock Act 1991; “Executive Officer” means a person appointed to be Executive Officer under regulation 29; “member” means a member of an Ethics Committee; “relevant person” means—  
   4.      For the purposes of subsection 13 (2) of the Act—  

   PART II--ANIMAL EXPERIMENTATION ETHICS COMMITTEES

   5.      A licensee shall establish and maintain an Ethics Committee in accordance with this Part.  
   6.      (1) An Ethics Committee shall be constituted by not less than 4 members, appointed in writing by the relevant person, of whom—  
   7.      The functions of an Ethics Committee are—  
   8.      An Ethics Committee has power to do all things necessary or convenient to be done for or in connection with the performance of its functions.  
   9.      (1) A member holds office as a part-time member.  
   10.     The relevant person shall appoint—  
   11.     A member may resign his or her office by writing signed by the member and delivered to the relevant person.  
   12.     The relevant person may terminate the appointment of a member for misbehaviour or physical or mental incapacity.  
   13.     (1) The relevant person may appoint a person to act as a member—  
   14.     (1) The Chairperson, or, if he or she is unable to do so, the Deputy Chairperson, shall—  
   15.     (1) The Chairperson shall preside at all Ethics Committee meetings at which he or she is present.  
   16.     Of the members constituting a quorum at a meeting of an Ethics Committee, 4 shall be members referred to in paragraphs 6 (1) (a), (b), (c) and (d).  
   17.     Subject to these Regulations, an Ethics Committee may conduct its affairs in such manner as it thinks fit.  
   18.     (1) A licensee or an authorised person may apply to an Ethics Committee for approval to carry out a program of research or teaching in which an animal is to be used.  
   19.     The Ethics Committee may, by written notice, require the applicant to furnish to the Committee, either orally or in writing, such further information relating to the application as is specified in the notice.  
   20.     A licensee shall not conduct a program of research or teaching using animals unless the program has been approved by the Ethics Committee.  
   21.     (1) On application in accordance with regulation 18, an Ethics Committee shall, in writing—  
   22.     An Ethics Committee shall establish and maintain a register of programs of research or teaching for which it has given approval.  
   23.     The Ethics Committee may grant an approval subject to such specified conditions as the Committee considers, on reasonable grounds, to be desirable in the interests of animal welfare, including conditions relating to—  
   24.     (1) On application by a licensee or an authorised person accompanied by the approval, the Ethics Committee shall, if satisfied that it is desirable in the interests of animal welfare—  
   25.     (1) The Ethics Committee may, if satisfied on reasonable grounds that—  
   26.     (1) Where the Ethics Committee believes on reasonable grounds that a person—  
   27.     (1) A licensee or authorised person (as the case requires) shall maintain a record in relation to the—  
   28.     An Ethics Committee may inspect, or cause to be inspected, any place used for a program of research or teaching, for the purposes of ensuring that the licensee is complying with a direction of the Ethics Committee or an approved code of practice.  
   29.     (1) The members of an Ethics Committee shall appoint 1 member to be the Executive Officer of the Committee.  
   30.     (1) The Executive Officer may, on behalf of the Committee, inspect premises used for a program of teaching or research specified by the Committee.  
   31.     (1) An Ethics Committee shall, within 90 days after the end of each financial year, furnish to the Minister a report relating to the activities of the Committee during that financial year.  

   PART III--MISCELLANEOUS

   32.     (1) Where an Ethics Committee makes a decision—  
   33.     A person entitled under subregulation 32 (1) to be given notice of a decision may apply to the Tribunal for a review of the decision.
