A Bill for an Act to limit ATM and cash facilities in

licensed venues, and for related purposes

The Parliament of Australia enacts:

1 Short title
6
This Act may be cited as the ATMs and Cash Facilities in Licensed
7
Venues Act 2008.

2 Commence ment
9
This Act commences at the end of 28 days after the day on which
10
this Act receives the Royal Assent.

3 Objects of Act
1
The objects of this Act are to limit and reduce the installation of
2
automatic teller machines and cash facilities in licensed venues.

4 Application of Act
4
Extension to external Territories
5
(1) This Act extends to Norfolk Island, the Territory of Cocos
6
(Keeling) Islands and the Territory of Christmas Island.
7
Limited extraterritorial application
8
(2) This Act applies to acts, omissions, matters and things in the
9
Australian jurisdiction and does not apply to acts, omissions,
10
matters and things outside the Australian jurisdiction.

5 Relationship with State and Territory law
12
This Act is not intended to exclude or limit the concurrent
13
operation of any law of a State or Territory, unless the contrary
14
intention appears.

6 Definitions
16
In this Act:
17
ATM card means any magnetic stripe card or smart chip card
18
issued by a financial institution to a customer of the financial
19
institution, which enables that customer, as an ATM cardholder, to
20
effect ATM transactions.
21
ATM cardholder means a customer of a financial institution who is
22
issued an ATM card and who has a PIN for use with it.
23
ATM transaction means a cash deposit, a cash withdrawal or a
24
balance enquiry effected by an ATM cardholder's use of an ATM
25
card and the keying in by the cardholder of the cardholder's PIN at
26
an ATM.

Australian jurisdiction means the land, waters, seabed and

airspace in, under or above:
2
(a) Australia; or
3
(b) an external Territory; or
4
(c) the exclusive economic zone; or
5
(d) the continental shelf.

Note:
A reference to Australia or to an external Territory generally includes
7
a reference to the coastal sea of Australia or the Territory (as
8
appropriate). See section 15B of the Acts Interpretation Act 1901.

authorised deposit-taking institution means a corporation that is
10
an authorised deposit-taking institution for the purposes of the
11
Banking Act 1959.

automatic teller machine or ATM means an electronic hardware
13
device, owned or operated by or on behalf of a financial institution,
14
a constitutional corporation, or a person, body corporate or
15
corporation that uses an eligible communications service to provide
16
cash facilities, that is capable of automatically dispensing cash in
17
response to a cash withdrawal transaction initiated by an ATM
18
cardholder, to be debited against or charged to an account of the
19
cardholder, through the use of an ATM card issued by a financial
20
institution that is a member of the Consumer Electronic Clearing
21
System (CS3) and the keying in by the cardholder of the
22
cardholder's PIN, and includes limited service devices (cash
23
dispensers) that only allow for cash withdrawals, although other
24
transactions such as balance enquiries may also be supported by an
25
automatic teller machine.

cardholder means an ATM cardholder, an EFTPOS cardholder or
27
a credit cardholder.

cash facility means:
29
(a) an ATM; or
30
(b) an EFTPOS terminal; or
31
(c) any other prescribed facility that enables a person to gain
32
access to the funds in his or her account or to a cash advance
33
through a credit card.

Consumer Electronic Clearing System (CS3) means the standards,

policies and procedures coordinated by the Australian Payments
2
Clearing Association for the purpose of settlement of obligations
3
incurred between financial institutions that arise from the operation
4
of the national automatic teller machine and EFTPOS networks.
5
constitutional corporation means a corporation to which
6
paragraph 51(xx) of the Constitution applies.
7
credit card means any magnetic stripe card or smart chip card
8
issued by a financial institution or a credit card or charge card
9
company to a customer of the financial institution or the credit card
10
or charge card company, which enables that customer, as a credit
11
cardholder, to effect credit card and charge card transactions,
12
including obtaining cash advances.
13
credit card company or charge card company means a company
14
that issues a card that allows the cardholder to purchase goods or
15
services or to obtain a cash advance against the card at multiple
16
locations and with entities that are not related to the company
17
issuing the card.
18
credit cardholder means a customer of a financial institution or a
19
credit card or charge card company who is issued with a credit card
20
or a charge card and who may have a PIN for use with that card.
21
credit card terminal means an electronic hardware device used to
22
put into effect a credit card transaction.
23
credit card transaction means a transaction initiated by a credit
24
cardholder to be charged to an account of the cardholder, through
25
the use at point of sale of a credit card issued by a financial
26
institution or a credit card or charge card company at a credit card
27
terminal, to purchase goods or services or to obtain a cash advance.
28
eligible communications service means a communications service
29
to which paragraph 51(v) of the Constitution applies
30
EFTPOS means an electronic funds transfer at the point of sale.
31
EFTPOS card means any magnetic stripe card or smart chip card
32
issued by a financial institution to a customer of the financial

institution, which enables that customer, as an EFTPOS

cardholder, to effect EFTPOS transactions.

EFTPOS cardholder means a customer of a financial institution
3
who is issued with an EFTPOS card and who has a PIN for use
4
with that card.

EFTPOS terminal means an electronic hardware device used to
6
put into effect an EFTPOS transaction.
7
EFTPOS transaction means an electronic funds transfer initiated
8
by an EFTPOS cardholder, to be debited against or charged to an
9
account of the cardholder, through the use at point of sale of an
10
EFTPOS card issued by a financial institution that is a member of
11
the Consumer Electronic Clearing System (CS3), and in the normal
12
course, the keying in by the cardholder of the cardholder's PIN, at
13
an EFTPOS terminal, and includes any cash withdrawal, refund
14
and reversal of any such transfer.
15
executive officer of a body corporate means a person, by whatever
16
name called and whether or not a director of the body corporate,
17
who is concerned in, or takes part in, the management of the body
18
corporate.
19
financial institution means a corporation that is an authorised
20
deposit-taking institution for the purposes of the Banking Act 1959.
21
licence means a gaming machine licence or a poker machine
22
licence issued under the relevant laws of a State or Territory.
23
licensed venue means premises for which a licence is in force.
24
personal identification number or PIN means the number which is
25
either issued by a financial institution or a credit card or charge
26
card company, or selected by the cardholder, for the purpose of
27
authenticating the use by the cardholder of the ATM card,
28
EFTPOS card or credit card, as the case may be.

7 Application
5
This Part applies to:
6
(a) any financial institution; and
7
(b) any constitutional corporation; and
8
(c) any person, body corporate or corporation that uses an
9
eligible communications service to provide cash facilities.

8 Automatic telle r machines and other cash facilities at licensed
11
venues
12
(1) Subject to subsections (2) and (3):
13
(a) a financial institution; or
14
(b) a constitutional corporation; or
15
(c) a person, body corporate or corporation that uses an eligible
16
communications service to provide cash facilities;
17
must not install, own or operate an automatic teller machine or
18
other cash facility, or allow an automatic teller machine or other
19
cash facility to be installed or operated on its behalf, at a licensed
20
venue that allows a cardholder to obtain by means of that
21
automatic teller machine or other cash facility an amount of cash.
22
Maximum civil penalty:
2,000 penalty units.
23
Note:
penalty unit has the meaning given by section 4AA of the Crimes Act
24
1914.
25
(2) At a licensed venue:
26
(a) a financial institution; or
27
(b) a constitutional corporation; or
28
(c) a person, body corporate or corporation that uses an eligible
29
communications service to provide cash facilities;
30
may install, own or operate, or allow to be installed or operated on
31
its behalf an EFTPOS terminal, a credit card terminal or any other
32

cash facility prescribed for the purposes of this subsection, if the

EFTPOS terminal, credit card terminal or other prescribed cash
2
facility, as the case may be, does not permit cash withdrawals by,
3
or cash advances to, a card holder.
4
(3) If there are no other cash facilities within a 5 kilometre radius of
5
the licensed venue, the Minister may exempt (conditionally or
6
unconditionally):
7
(a) a financial institution; or
8
(b) a constitutional corporation; or
9
(c) a person, body corporate or corporation that uses an eligible
10
communications service to provide cash facilities;
11
from the operation of subsection (1).
12
(4) A condition of an exemption granted under subsection (3) must not
13
be contravened by:
14
(a) the financial institution; or
15
(b) the constitutional corporation; or
16
(c) the person, body corporate or corporation that uses an
17
eligible communications service to provide cash facilities;
18
granted the exemption under subsection 3.
19
Maximum civil penalty:
2,000 penalty units.

9 Federal Court may order person to pay pecuniary penalty for
4
contravening civil penalty provision
5
Application for order
6
(1) Within 6 years of a person (the wrongdoer) contravening a civil
7
penalty provision, the Minister may apply on behalf of the
8
Commonwealth to the Federal Court for an order that the
9
wrongdoer pay the Commonwealth a pecuniary penalty.
10
Court may order wrongdoer to pay pecuniary penalty
11
(2) If the Court is satisfied that the wrongdoer has contravened a civil
12
penalty provision, the Court may order the wrongdoer to pay to the
13
Commonwealth for each contravention the pecuniary penalty that
14
the Court determines is appropriate (but not more than the relevant
15
amount specified for the provision).

Determining amount of pecuniary penalty
17
(3) In determining the pecuniary penalty, the Court must have regard
18
to all relevant matters, including:
19
(a) the nature and extent of the contravention; and
20
(b) the circumstances in which the contravention took place; and
21
(c) whether the person has previously been found by the Court in
22
proceedings under this Act to have engaged in any similar
23
conduct.

Conduct contravening more than one civil penalty provision
25
(4) If conduct constitutes a contravention of two or more civil penalty
26
provisions, proceedings may be instituted under this Act against a
27
person in relation to the contravention of any one or more of those
28
provisions. However, the person is not liable to more than one

pecuniary penalty under this section in respect of the same

conduct.

10 What is a civil penalty provision?
3
A subsection of this Act (or a section of this Act that is not divided
4
into subsections) is a civil penalty provision if the words "civil
5
penalty" and an amount in penalty units is set out at the foot of the
6
subsection (or section).

11 Contravening a civil penalty provision is not an offence
8
A contravention of a civil penalty provision is not an offence.
9
12 Persons involved in contravening civil penalty provision
10
(1) A person must not:
11
(a) aid, abet, counsel or procure a contravention of a civil
12
penalty provision; or
13
(b) induce (by threats, promises or otherwise) a contravention of
14
a civil penalty provision; or
15
(c) be in any way directly or indirectly knowingly concerned in,
16
or party to, a contravention of a civil penalty provision; or
17
(d) conspire to contravene a civil penalty provision.
18
(2) This Division applies to a person who contravenes subsection (1)
19
in relation to a civil penalty provision as if the person had
20
contravened the provision.

13 Recovery of a pecuniary penalty
22
If the Federal Court orders a person to pay a pecuniary penalty:
23
(a) the penalty is payable to the Commonwealth; and
24
(b) the Commonwealth may enforce the order as if it were a
25
judgment of the Court.

14 Acceptance of undertakings relating to contraventions of civil
4
penalty provisions
5
(1) This section applies if the Minister considers that an action taken
6
by a body corporate after the commencement of this section
7
contravened one or more civil penalty provisions of Part 2.
8
(2) The Minister instead of instituting proceedings under
9
subsection 9(1) may accept a written undertaking given by an
10
executive officer on behalf of the body corporate in relation to the
11
action, in which the body corporate:
12
(a) undertakes to pay a specified amount, within a specified
13
period to the Commonwealth; or
14
(b) any other undertaking in connection with that contravention.
15
(3) The executive officer on behalf of the body corporate may
16
withdraw or vary the undertaking at any time, but only with the
17
consent of the Minister.

15 Enforce ment of undertakings
19
(1) If the Minister considers that an executive officer who gave an
20
undertaking under section 14 or the body corporate on behalf of
21
which an undertaking was given under section 14 has breached any
22
of its terms, the Minister may apply to the Federal Court for an
23
order under subsection (2).
24
(2) If the Federal Court is satisfied that the executive officer or the
25
body corporate has breached a term of the undertaking, the Court
26
may make one or more of the following orders:
27
(a) an order directing the executive officer or the body corporate
28
to comply with that term of the undertaking;
29
(b) any other order that the Court considers appropriate.

16 Regulations
4
The Governor-General may make regulations prescribing matters:
5
(a) required or permitted by this Act to be prescribed; or
6
(b) necessary or convenient to be prescribed for carrying out or
7
giving effect to this Act.
