in the Parliament; and
7
(b) the report specifies the amount required by an Agency in
8
respect of:
9
(i) a State, ACT, NT and local government item for the
10
Agency; or
11
(ii) an administered item for the Agency; and
12
(c) the required amount is less than the amount of the item;
13
the item is taken to be reduced to the required amount.
14
(2) The Finance Minister may, by writing, determine that
15
subsection (1):
16
(a) does not apply in relation to the item; or
17
(b) applies as if the amount specified in the annual report were
18
the amount specified in the determination.
19
(3) A determination made under subsection (2) is a legislative
20
instrument and, despite subsection 44(2) of the Legislative
21
Instruments Act 2003, section 42 (disallowance) of that Act applies
22
to the determination. However, Part 6 (sunsetting) of that Act does

13 Reducing administered assets and liabilities items and other

32
Adjusting appropriation items Part 3
Section 14
Appropriation Bill (No. 4) 2009-2010 No. , 2009 9
(2) If a request is made under subsection (1), the Finance Minister
1
may, by writing, determine that the item is to be reduced by the
2
amount specified in the request.
3
(3) However, the determination has no effect to the extent that it would
4
reduce the item below nil, after subtracting amounts that have been
5
applied under Part 2 in respect of the item.
6
(4) The item is taken to be reduced in accordance with the
7
determination.
8
(5) A request made under subsection (1) is not a legislative instrument.
9
(6) A determination made under subsection (2) is a legislative
10
instrument and, despite subsection 44(2) of the Legislative

15
(1) A written request to reduce a CAC Act body payment item for a

19
Secretary of the Department.
20
Note: For
Department, see subsection 19A(3) of the Acts Interpretation Act
21

22
(2) If a request is made under subsection (1), the Finance Minister
23
may, by writing, determine that the item is to be reduced by the
24
amount specified in the request.
25
(3) However, the determination has no effect to the extent that it would
26
reduce the item below nil, after subtracting amounts that have been
27
paid to the body in respect of the item.
28
(4) The item is taken to be reduced in accordance with the
29
determination.
30
(5) Subsection 11(2) does not limit the reduction of a CAC Act body
31
payment item under this section.
32
Part 3 Adjusting appropriation items
Section 15
10 Appropriation Bill (No. 4) 2009-2010 No. , 2009
(6) A request made under subsection (1) is not a legislative instrument.
1
(7) A determination made under subsection (2) is a legislative
2
instrument and, despite subsection 44(2) of the Legislative
3
Instruments Act 2003, section 42 (disallowance) of that Act applies
4
to the determination. However, Part 6 (sunsetting) of that Act does
5
not apply to the determination.
6
15 Advance to the Finance Minister
7
(1) If the Finance Minister determined an amount under subsection
8
15(2) of the Appropriation Act (No. 2) 2009-2010 before the
9
commencement of this Act, the amount is to be disregarded for the
10
purposes of subsection 15(3) of that Act.
11
Note:
This means that, after the commencement of this Act, the Finance
12
Minister has access to $380 million under section 15 of the
13
Appropriation Act (No. 2) 2009-2010, regardless of amounts that have
14
already been determined under that section.
15
(2)
If:
16
(a) this Act appropriates an amount for particular expenditure;
17
and
18
(b) before the commencement of this Act, the Finance Minister
19
determines an amount (the advanced amount) under
20
section 15 of the Appropriation Act (No. 2) 2009-2010 for the
21
expenditure;
22
the amount appropriated by this Act for the expenditure is taken to
23
be reduced (but not below nil) by the advanced amount.
24

2
16 General drawing rights limits
3
Education Investment Fund
4
(1) On and after the commencement of this Act, subsection 16(2) of
5
the Appropriation Act (No. 2) 2009-2010 has effect as if the
6
general drawing rights limit specified in that subsection were
7
$1,311,694,000.
8
Note:
This decreases the Education Investment Fund general drawing rights
9
limit for the current year by $78,400,000.
10
Health and Hospitals Fund
11
(2) On and after the commencement of this Act, subsection 16(3) of
12
the Appropriation Act (No. 2) 2009-2010 has effect as if the
13
general drawing rights limit specified in that subsection were
14
$466,700,000.
15
Note:
This increases the Health and Hospitals Fund general drawing rights
16
limit for the current year by $1,000,000.
17
17 Adjustments for GST
18
If:
19
(a) a payment in respect of an acquisition or importation is or
20
was made in reliance on a general drawing rights limit
21
specified:
22
(i) in section 16 of the Appropriation Act (No. 2)
23
2009-2010; or
24
(ii) by the Finance Minister under paragraph 109(1)(a),
25
199(1)(a) or 267(1)(a) of the Nation-building Funds Act
26
2008; and
27
(b) a GST qualifying amount has arisen or does arise for that
28
acquisition or importation;
29
then the general drawing rights limit is increased or is taken, at all
30
relevant times, to have been increased, as the case requires, by the
31
amount of the GST qualifying amount.

(2) However, the determination has no effect:
11
(a) to the extent that it would reduce the item below nil, after
12
subtracting amounts that have been applied, under that Act,
13
in respect of the item; or
14
(b) to the extent that the amount specified, when added to any
15
other amounts specified in relation to the Parliamentary
16
Department under subsection (1), exceeds the depreciation
17
and make good amount for the Parliamentary Department.
18
(3) The item is taken to be reduced in accordance with the
19
determination.
20
(4) The determination is a legislative instrument and, despite
21
subsection 44(2) of the Legislative Instruments Act 2003,
22
section 42 (disallowance) of that Act applies to the determination.
23
However, Part 6 (sunsetting) of that Act does not apply to the
24
determination.
25
(5) Despite subsection 33(3) of the Acts Interpretation Act 1901, the
26
determination must not be rescinded, revoked, amended or varied.
27

28
administered item, in relation to a previous Act, means an
29
