The Parliament of Australia enacts:

1 Short title
8
This Act may be cited as the Asbestos-related Claims
9
(Management of Commonwealth Liabilities) (Consequential and
10
Transitional Provisions) Act 2005.

2 Commencement
1
(1) Each provision of this Act specified in column 1 of the table
2
commences, or is taken to have commenced, in accordance with
3
column 2 of the table. Any other statement in column 2 has effect
4
according to its terms.

Each Act that is specified in a Schedule to this Act is amended or

repealed as set out in the applicable items in the Schedule

concerned, and any other item in a Schedule to this Act has effect

according to its terms.

Committee to Commonwealth

On the commencement of this section:
3
(a) a liability of any kind (whether actual, potential or
4
contingent) of the Stevedoring Industry Finance Committee
5
established by section 4 of the Stevedoring Industry Finance
6
Committee Act 1977 ceases to be a liability of the Committee
7
and becomes a liability of the Commonwealth; and
8
(b) the Commonwealth becomes the successor in law in relation
9
to the liability.

5 Compensation for acquisition of property
11
(1) If the operation of this Act would result in an acquisition of
12
property from a person otherwise than on just terms, the
13
Commonwealth is liable to pay a reasonable amount of
14
compensation to the person.
15
(2) If the Commonwealth and the person do not agree on the amount
16
of the compensation, the person may institute proceedings in a
17
court of competent jurisdiction for the recovery from the
18
Commonwealth of such reasonable amount of compensation as the
19
court determines.

(3) The Consolidated Revenue Fund is appropriated for the purposes
21
of this section.

(4) In this section:
23
acquisition of property has the same meaning as in paragraph
24
51(xxxi) of the Constitution.
25
just terms has the same meaning as in paragraph 51(xxxi) of the
26
Constitution.

6 Regulations
28
(1) The Governor-General may make regulations prescribing matters:
29
(a) required or permitted by this Act to be prescribed; or
30
(b) necessary or convenient to be prescribed for carrying out or
31
giving effect to this Act.

(2) In particular, regulations may be made prescribing matters of a

transitional nature (including prescribing any saving or application
2
provisions) relating to:

(a) the enactment of the Asbestos-related Claims (Management
4
of Commonwealth Liabilities) Act 2005; or
5
(b) the enactment of this Act; or
6
(c) the amendments or repeals made by this Act.

Asbestos-related Claims (Management of Commonwealth Liabilities)
