2 Commencement

(1) Each provision of this Act specified in column 1 of the table

commences, or is taken to have commenced, in accordance with

column 2 of the table. Any other statement in column 2 has effect

according to its terms.

3 Definitions

In this Act:

administered assets and liabilities item
means an amount set out in
15
Schedule 1 in relation to a Parliamentary Department opposite the
16
heading "Administered Assets and Liabilities".
17
administered item
means an amount set out in Schedule 1 opposite
18
an outcome for a Parliamentary Department under the heading
19
"Administered".
20
current year
means the financial year ending on 30 June 2021.
21
departmental item
means the total amount set out in Schedule 1 in
22
relation to a Parliamentary Department under the heading
23
"Departmental".

Note:
The amounts set out opposite outcomes, under the heading
25
"Departmental", are "notional". They are not part of the item, and do
26

not in any way restrict the scope of the expenditure authorised by the

item.

expenditure
means payments for expenses, acquiring assets,
3
making loans or paying liabilities.

item
means any of the following:

(a) a departmental item;
6
(b) an administered item;
7
(c) an administered assets and liabilities item;
8
(d) an other departmental item.

non-corporate entity
means:
10
(a) a non-corporate Commonwealth entity within the meaning of
11
the
Public Governance, Performance and Accountability Act
12
2013
; or
13
(b) the High Court.

Note:
Each Parliamentary Department is a non-corporate Commonwealth
15
entity for the purposes of the
Public Governance, Performance and
16
Accountability Act 2013
.

other departmental item
means an amount set out in Schedule 1 in
18
relation to a Parliamentary Department opposite the heading
19
"Equity Injections".

Parliamentary Department
means any of the following:
21
(a) the Department of the Senate;
22
(b) the Department of the House of Representatives;
23
(c) the Department of Parliamentary Services;
24
(d) the Parliamentary Budget Office.
25
Portfolio Budget Statements
means the Portfolio Budget
26
Statements that were tabled in the Senate or the House of
27
Representatives in relation to the Bill for this Act.
28
portfolio statements
means the Portfolio Budget Statements.
29
President
means the President of the Senate.

responsible Presiding Officer
means:
31
(a) in relation to the Department of the Senate--the President; or

Representatives--the Speaker; or

Speaker
means the Speaker of the House of Representatives.

special account
has the same meaning as in the
Public

Governance, Performance and Accountability Act 2013
.

4 Portfolio statements

The portfolio statements are declared to be relevant documents for
11
the purposes of section 15AB of the
Acts Interpretation Act 1901
.

Note:
See paragraph 15AB(2)(g) of the
Acts Interpretation Act 1901
which

provides that the material that may be considered in the interpretation
14
of a provision of an Act includes any document that is declared by the
15
Act to be a relevant document.

5 Notional transactions between entities that are part of the
17
Commonwealth
18
For the purposes of this Act, notional transactions between
19
non-corporate entities are to be treated as if they were real
20
transactions.
21
Note:
This section applies, for example, to a "payment" between
22
non-corporate entities that are both part of the Commonwealth. One of
23
the effects of this section is that the payment will be debited from an
24
appropriation for the paying non-corporate entity, even though no
25
payment is actually made from the Consolidated Revenue Fund. This
26
is consistent with section 76 of the
Public Governance, Performance
27
and Accountability Act 2013
.

The total of the items specified in Schedule 1 is $141,746,000.

7 Departmental items

The amount specified in a departmental item for a Parliamentary
10
Department may be applied for the departmental expenditure of the
11
Parliamentary Department.

8 Administered items
13
(1) The amount specified in an administered item for an outcome for a
14
Parliamentary Department may be applied for expenditure for the
15
purpose of contributing to achieving that outcome.
16
(2) If the portfolio statements indicate that activities of a particular
17
kind were intended to be treated as activities in respect of a
18
particular outcome, then expenditure for the purpose of carrying
19
out those activities is taken to be expenditure for the purpose of
20
contributing to achieving the outcome.

9 Administered assets and liabilities items
22
(1) The amount specified in an administered assets and liabilities item
23
for a Parliamentary Department may be applied for expenditure for
24
the purpose of contributing to achieving any outcome specified in
25
Schedule 1 for the Parliamentary Department.

(2) If the portfolio statements indicate that activities of a particular
27
kind were intended to be treated as activities in respect of a
28
particular outcome, then expenditure for the purpose of carrying
29

out those activities is taken to be expenditure for the purpose of

contributing to achieving the outcome.

10 Other departmental items

The amount specified in an other departmental item for a

Parliamentary Department may be applied for the departmental
5
expenditure of the Parliamentary Department.

11 Advance to the responsible Presiding Officer
4
(1) This section applies if the responsible Presiding Officer is satisfied
5
that there is an urgent need for expenditure in relation to a
6
Parliamentary Department, in the current year, that is not provided
7
for, or is insufficiently provided for, in Schedule 1:
8
(a) because of an erroneous omission or understatement; or
9
(b) because the expenditure was unforeseen until after the last
10
day on which it was practicable to provide for it in the Bill
11
for this Act before that Bill was introduced into the House of
12
Representatives.

(2) This Act has effect as if Schedule 1 were amended, in accordance
14
with a determination of the responsible Presiding Officer, to make
15
provision for so much (if any) of the expenditure as the responsible
16
Presiding Officer determines.
17
(3) The total of the amounts determined under subsection (2) of this
18
section and subsection 11(2) of the
Supply (Parliamentary
19
Departments) Act (No. 1) 2020-2021
for the Department of the
20
Senate cannot be more than $300,000.
21
(4) The total of the amounts determined under subsection (2) of this
22
section and subsection 11(2) of the
Supply (Parliamentary
23
Departments) Act (No. 1) 2020-2021
for the Department of the
24
House of Representatives cannot be more than $300,000.
25
(5) The total of the amounts determined under subsection (2) of this
26
section and subsection 11(2) of the
Supply (Parliamentary
27
Departments) Act (No. 1) 2020-2021
for the Department of
28
Parliamentary Services cannot be more than $1 million.

(6) The total of the amounts determined under subsection (2) of this

section and subsection 11(2) of the

12 Crediting amounts to special accounts

If any of the purposes of a special account is a purpose that is
4
covered by an item (whether or not the item expressly refers to the
5
special account), then amounts may be debited against the
6
appropriation for that item and credited to that special account.

13 Appropriation of the Consolidated Revenue Fund
8
The Consolidated Revenue Fund is appropriated as necessary for
9
the purposes of this Act, including the operation of this Act as
10
affected by the
Public Governance, Performance and
11
Accountability Act 2013
.

14 Repeal of this Act
13
This Act is repealed at the start of 1 July 2023.
