The Parliament of Australia enacts:

1 Short title

This Act is the
Australia Day Act 2023
.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

this Act
The day this Act receives the Royal Assent.
Note:

(2) Any information in column 3 of the table is not part of this Act.

Information may be inserted in this column, or information in it

may be edited, in any published version of this Act.

3 Observance of Australia Day as the national day
8
(1) The national day of Australia is to be known as Australia Day and
9
observed on 26 January each year.
10
(2) The date referred to in subsection (1) ceases to be Australia Day if,
11
and only if:
12
(a) a new date or dates, and the date referred to in subsection (1),
13
are submitted in each State and Territory to the electors
14
qualified to vote for the election of members of the House of
15
Representatives; and
16
(b) the new date, or one of the new dates, is chosen by a majority
17
of all the electors voting.

(3) The:
19
(a) form and manner in which a proposal for a new Australia
20
Day is submitted to electors; and
21
(b) manner in which a vote on the proposal is taken (which may
22
include the adoption of a form of preferential voting for
23
choosing among 3 or more dates); and
24
(c) arrangements for adopting a new date as Australia Day if
25
chosen as mentioned in subsection (2);
26
are to be as Parliament prescribes.

(4) In this section:

Territory
means any Territory referred to in section 122 of the

Constitution in respect of which there is in force a law allowing its
2
representation in the House of Representatives.
