The Parliament of Australia enacts:

1 Short title

This Act may be cited as the Appropriation (Parliamentary
9
Departments) Act (No. 2) 2014-2015.

2 Commencement

This Act commences on the day this Act receives the Royal
2
Assent.

3 Definitions

In this Act:
5
administered assets and liabilities item means an amount set out in
6
Schedule 1 in relation to a Parliamentary Department opposite the
7
heading "Administered Assets and Liabilities".
8
administered item means an amount set out in Schedule 1 opposite
9
an outcome for a Parliamentary Department under the heading
10
"Administered".
11
departmental item means the total amount set out in Schedule 1 in
12
relation to a Parliamentary Department under the heading
13
"Departmental".

Note:
The amounts set out opposite outcomes, under the heading
15
"Departmental", are "notional". They are not part of the item, and do
16
not in any way restrict the scope of the expenditure authorised by the
17
item.

expenditure means payments for expenses, acquiring assets,
19
making loans or paying liabilities.
20
item means any of the following:
21
(a) a departmental item;
22
(b) an administered item;
23
(c) an administered assets and liabilities item;
24
(d) an other departmental item.
25
non-corporate entity means:
26
(a) a non-corporate Commonwealth entity within the meaning of
27
the Public Governance, Performance and Accountability Act
28
2013; or
29
(b) the High Court.

Note:
Each Parliamentary Department is a non-corporate Commonwealth

entity for the purposes of the Public Governance, Performance and
2
Accountability Act 2013.

other departmental item means an amount set out in Schedule 1 in
4
relation to a Parliamentary Department opposite the heading
5
"Equity Injections".

Parliamentary Department means any of the following:
7
(a) the Department of the Senate;
8
(b) the Department of the House of Representatives;
9
(c) the Department of Parliamentary Services;
10
(d) the Parliamentary Budget Office.

Portfolio Additional Estimates Statements means the Portfolio
12
Additional Estimates Statements that were tabled in the Senate or
13
the House of Representatives in relation to the Bill for this Act.
14
Portfolio Budget Statements means the Portfolio Budget
15
Statements that were tabled in the Senate or the House of
16
Representatives in relation to the Appropriation (Parliamentary
17
Departments) Act (No. 1) 2014-2015.

portfolio statements means:
19
(a) the Portfolio Budget Statements; and
20
(b) the Portfolio Additional Estimates Statements.
21
President means the President of the Senate.
22
responsible Presiding Officer means:
23
(a) in relation to the Department of the Senate--the President; or
24
(b) in relation to the Department of the House of
25
Representatives--the Speaker; or
26
(c) in relation to the Department of Parliamentary Services--the
27
President and the Speaker together; or
28
(d) in relation to the Parliamentary Budget Office--the President
29
and the Speaker together.

Speaker means the Speaker of the House of Representatives.

special account has the same meaning as in the Public

Governance, Performance and Accountability Act 2013.

4 Portfolio statements

The portfolio statements are declared to be relevant documents for
4
the purposes of section 15AB of the Acts Interpretation Act 1901.

Note:
See paragraph 15AB(2)(g) of the Acts Interpretation Act 1901 which
6
provides that the material that may be considered in the interpretation
7
of a provision of an Act includes any document that is declared by the
8
Act to be a relevant document.

5 Notional transactions between entities that are part of the
10
Commonwealth
11
For the purposes of this Act, notional transactions between
12
non-corporate entities are to be treated as if they were real
13
transactions.

Note:
This section applies, for example, to a "payment" between
15
non-corporate entities that are both part of the Commonwealth. One of
16
the effects of this section is that the payment will be debited from an
17
appropriation for the paying non-corporate entity, even though no
18
payment is actually made from the Consolidated Revenue Fund. This
19
is consistent with section 76 of the Public Governance, Performance
20
and Accountability Act 2013.

6 Summary of appropriations

The total of the items specified in Schedule 1 is $113,837,000.

Note 1:
Items in Schedule 1 can be adjusted under Part 3 of this Act.

Note 2:
Sections 30A and 31 of the Financial Management and Accountability
6
Act 1997 also provide for adjustments of amounts appropriated by this
7
Act. Those sections continue to apply because of Part 2 of Schedule 2
8
to the Public Governance, Performance and Accountability
9
(Consequential and Transitional Provisions) Act 2014.

Note 3:
Sections 74 and 75 of the Public Governance, Performance and
11
Accountability Act 2013 also provide for the adjustment of amounts
12
appropriated by this Act.

7 Departmental items

The amount specified in a departmental item for a Parliamentary
15
Department may be applied for the departmental expenditure of the
16
Parliamentary Department.

8 Administered items

(1) The amount specified in an administered item for an outcome for a
19
Parliamentary Department may be applied for expenditure for the
20
purpose of contributing to achieving that outcome.
21
(2) If the portfolio statements indicate that activities of a particular
22
kind were intended to be treated as activities in respect of a
23
particular outcome, then expenditure for the purpose of carrying
24
out those activities is taken to be expenditure for the purpose of
25
contributing to achieving the outcome.

9 Administered assets and liabilities items

(1) The amount specified in an administered assets and liabilities item
28
for a Parliamentary Department may be applied for expenditure for

the purpose of contributing to achieving any outcome specified in

Schedule 1 for the Parliamentary Department.

(2) If the portfolio statements indicate that activities of a particular

kind were intended to be treated as activities in respect of a

particular outcome, then expenditure for the purpose of carrying
5
out those activities is taken to be expenditure for the purpose of
6
contributing to achieving the outcome.

10 Other departmental items

The amount specified in an other departmental item for a
9
Parliamentary Department may be applied for the departmental
10
expenditure of the Parliamentary Department.

11 Advance to the responsible Presiding Officer

(1) If a responsible Presiding Officer determined an amount under
5
subsection 11(2) of the Appropriation (Parliamentary
6
Departments) Act (No. 1) 2014-2015 before the commencement of
7
this Act, the amount is to be disregarded for the purposes of
8
subsections 11(3), (4), (5) and (6) of that Act.

Note:
This means that, after the commencement of this Act, the responsible
10
Presiding Officers have access to the following amounts under
11
section 11 of the Appropriation (Parliamentary Departments) Act
12
(No. 1) 2014-2015, regardless of amounts that have already been
13
determined under that section:
14
(a) for the Department of the Senate--$300,000;
15
(b) for the Department of the House of Representatives--$300,000;
16
(c) for the Department of Parliamentary Services--$1 million;
17
(d) for the Parliamentary Budget Office--$300,000.
18
(2) If:
19
(a) this Act appropriates an amount for particular expenditure;
20
and
21
(b) before the commencement of this Act, a responsible
22
Presiding Officer determines an amount (the advanced
23
amount) under section 11 of the Appropriation
24
(Parliamentary Departments) Act (No. 1) 2014-2015 for the
25
expenditure;
26
the amount appropriated by this Act for the expenditure is taken to
27
be reduced (but not below nil) by the advanced amount.

12 Crediting amounts to special accounts

If any of the purposes of a special account is a purpose that is
4
covered by an item (whether or not the item expressly refers to the
5
special account), then amounts may be debited against the
6
appropriation for that item and credited to that special account.

13 Appropriation of the Consolidated Revenue Fund
8
The Consolidated Revenue Fund is appropriated as necessary for
9
the purposes of this Act, including the operation of this Act as
10
affected by:
11
(a) the Financial Management and Accountability Act 1997, as
12
that Act continues to apply because of Schedule 2 to the
13
Public Governance, Performance and Accountability
14
(Consequential and Transitional Provisions) Act 2014; and
15
(b) the Public Governance, Performance and Accountability Act
16
2013.
17
14 Act ceases to be in force
18
This Act ceases to be in force at the start of 1 July 2017.
