The Parliament of Australia enacts:

1  Short title 

4 

 

  This Act may be cited as the Australian Education Amendment 

5 

(School Funding Guarantee) Act 2014.

2  Commencement 

7 

 

  This Act commences on the day after this Act receives the Royal 

8 

Assent.

1  After subsection 25(1)

Insert:

Minister to consider whether State or Territory education funding 

6 

to be reduced 

7 

 

(1A)  Before making a determination under paragraph (1)(a) in relation 

8 

to a State or Territory for a year, the Minister must be satisfied that 

9 

the total amount of the State or Territory's funding for participating 

10 

schools located in the State or Territory is not to be, or was not, 

11 

reduced at any time during the year. 

12 

 

(1B)  Before making a determination under paragraph (1)(c) in relation 

13 

to a State or Territory for a year, the Minister must be satisfied that 

14 

the total amount of the State or Territory's funding for 

15 

non-participating schools located in the State or Territory is not to 

16 

be, or was not, reduced at any time during the year.

2  Application

The amendments made by this Schedule apply in relation to a 

19 

determination made on or after the day this item commences.
