The Parliament of Australia enacts:

1 Short title

This Act is the Australian Grape and Wine Authority Amendment
7
(Wine Australia) Act 2017.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
10
commences, or is taken to have commenced, in accordance with
11

column 2 of the table. Any other statement in column 2 has effect

according to its terms.

(1) This section applies to the body corporate that was established by

section 6 of the Australian Grape and Wine Authority Act 2013 (as

in force immediately before the commencement of this section).

(2) That body corporate continues in existence by force of this section

as a body corporate, under and subject to the provisions of this Act,
16
under the name Wine Australia.

In this Act, Authority means the authority known as Wine Australia--
18
see section 4.

Note 2:
Subsection 25B(1) of the Acts Interpretation Act 1901 provides that a
20
body whose name is altered by an Act continues in existence under the
21
new name so that its identity is not affected.

In this Part:

asset means:

(a) any legal or equitable estate or interest in real or personal
6
property, whether actual, contingent or prospective; or
7
(b) any right, power, privilege or immunity, whether actual,
8
contingent or prospective.

continued Committee means the Authority Selection Committee as
10
continued under section 27B of the Wine Australia Act 2013 after the
11
transition time.
12
instrument includes an Act and any instrument made under an Act.
13
liability means any liability, duty or obligation, whether actual,
14
contingent or prospective.
15
old Committee means the Authority Selection Committee as established
16
under section 27B of the Australian Grape and Wine Authority Act
17
2013 and in existence immediately before the transition time.
18
transition time means the commencement of this Schedule.

The object of this Division is to avoid doubt about the effect of

continuing the existence of the body corporate Wine Australia,

previously known as the Australian Grape and Wine Authority, on

certain matters.

--Rules

39 Rules
4
(1)
The Minister may, by legislative instrument, make rules prescribing
5
matters of a transitional nature (including prescribing any saving or
6
application provisions) relating to the amendments or repeals made by
7
this Act.
8
(2)
To avoid doubt, the rules may not do the following:
9
(a) create an offence or civil penalty;
10
(b) provide powers of:
11
(i) arrest or detention; or
12
(ii) entry, search or seizure;
13
(c) impose a tax;
14
(d) set an amount to be appropriated from the Consolidated
15
Revenue Fund under an appropriation in this Act;
16
(e) directly amend the text of this Act.
17
(3)
This Part (other than subitem (2)) does not limit the rules that may be
18
made for the purposes of subitem (1).
