The Parliament of Australia enacts:

1 Short title
4
This Act may be cited as the Aviation Legislation Amendment
5
(2008 Measures No. 2) Act 2008.

2 Commence ment

(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

111 Secretary may require aviation security information
5
(1) Information that is not security compliance information and is
6
prescribed by the regulations for the purposes of this section is
7
aviation security information.
8
(2) Without limiting the kinds of information that may be prescribed
9
by regulations made under subsection (1), the regulations may
10
prescribe the following kinds of information as aviation security
11
information:
12
(a) statistics relating to the screening of people, vehicles, goods
13
or cargo for entry to cleared areas or cleared zones;
14
(b) statistics relating to the people, vehicles, goods or cargo that
15
go through a screening process and:
16
(i) receive clearance as a result of going through the
17
screening process; or
18
(ii) do not receive clearance as a result of going through the
19
screening process and the reason or reasons for not
20
receiving clearance;
21
(c) information about activities undertaken, or to be undertaken,
22
to ensure that people, vehicles, goods or cargo that have not
23
received clearance are not in cleared areas or cleared zones;
24
(d) information about activities undertaken, or to be undertaken,
25
at an airport for the purposes of safeguarding against
26
unlawful interferences with aviation;
27
(e) information about the controls that apply, or will apply, to
28
airside areas, airside security zones, airside event zones,
29
landside areas, landside security zones or landside event
30
zones.

(3) If the Secretary believes, on reasonable grounds, that an aviation
32
industry participant has aviation security information, the Secretary
33
may, by written notice given to the participant, require the
34
participant to give the information to the Secretary.

(4) The information must be given within the period and in the form

and manner specified in the notice. The period must not be less
2
than 14 days.

(5) Without limiting subsection (4), the Secretary may specify in the
4
notice any one or more of the following ways for the participant to
5
give the information:
6
(a) orally;
7
(b) in writing;
8
(c) by electronic transmission.
9
(6) A person commits an offence if the person fails to comply with a
10
notice under subsection (3).
11
Penalty for an offence against this subsection: 45 penalty units.

112 Self-incrimination
13
(1) A person is not excused from giving aviation security information
14
under section 111 on the ground that the information might tend to
15
incriminate the person or expose the person to a penalty.
16
(2) However, if the person is a natural person:
17
(a) the information; and
18
(b) the giving of the information; and
19
(c) any information, document or thing obtained as a direct or
20
indirect consequence of giving the information;
21
are not admissible in evidence against the person in a criminal
22
proceeding, or any other proceeding for the recovery of a penalty,
23
other than a proceeding under section 137.1 or 137.2 of the
24
Criminal Code that relates to the giving of the information.

8 Subsection 127(1)

Repeal the subsection, substitute:

(1) The Secretary may, by writing, delegate all or any of his or her
28
powers and functions under this Act to a person of the following
29
kind:
30
(a) an SES employee, or acting SES employee, in the
31
Department;
32
(b) the Agency Head of an Agency that carries on activities that
33
relate to national security.

(1A) However, a delegation under paragraph (1)(b) has no effect unless

the Agency Head of the Agency agrees to the delegation.

127A Sub-delegation
5
(1) If the Secretary delegates a power or function to the Agency Head
6
of an Agency under paragraph 127(1)(b), the Agency Head may,
7
by writing, sub-delegate the power or function to an SES Band 3
8
employee in the Agency.

(2) Sections 34AA, 34AB and 34A of the Acts Interpretation Act 1901
10
apply in relation to the sub-delegation in a corresponding way to
11
the way in which they apply to a delegation.
12
(3) In exercising powers or functions under a sub-delegation, the
13
delegate must comply with any directions of the Agency Head of
14
the Agency.
15
(4) An SES Band 3 employee is an SES employee with a classification
16
of Senior Executive Band 3, and includes an SES employee who
17
has been temporarily assigned duties that have been allocated a
18
classification of Senior Executive Band 3.

(aa) copying or disclosure that is necessary for the purposes of

checking whether equipment used to make a cockpit voice
6
recording is functioning and reliable, provided the conditions
7
set out in subsection (3A) are met; or

(3A) The conditions that must be met for the purposes of
11
paragraph (3)(aa) are:
12
(a) the person who copies or discloses the CVR information for
13
the purposes of checking the equipment is authorised to do so
14
under the regulations; and
15
(b) that person honestly and reasonably believes on the
16
information available to him or her that:
17
(i) the cockpit voice recording does not relate to a
18
reportable matter (as defined for the purposes of the
19
Transport Safety Investigation Act 2003); and
20
(ii) the cockpit voice recording does not relate to an offence
21
under the law of the Commonwealth, or of a State or
22
Territory; and
23
(iii) the crew members in relation to the CVR information
24
were notified in writing, before the cockpit voice
25
recording was made, of the intention to copy or disclose
26
the CVR information for the purposes of checking
27
whether the equipment used to make the recording is
28
functioning and reliable.

A defendant bears an evidential burden in relation to the matter in

subsection (2). See subsection 13.3(3) of the Criminal Code.

(4) The Executive Director may, by notice in writing to a responsible
9
person, require the person to give the Executive Director a written
10
report in relation to an immediately reportable matter or a routine
11
reportable matter within the period specified in the notice, by the
12
means prescribed and including the particulars prescribed by the
13
regulations.
14
(5) The Executive Director must not require a responsible person to
15
give a report under subsection (4) unless either:
16
(a) the Executive Director is satisfied that:
17
(i) the person has knowledge of the immediately reportable
18
matter or routine reportable matter; but
19
(ii) the person is one to whom subsection (1) does not apply
20
because of the operation of subsection (2) or (3); or
21
(b) the Executive Director is satisfied that:
22
(i) the person is one to whom subsection (1) applies despite
23
the operation of subsection (2) or (3); and
24
(ii) the person may have information that was not
25
communicated in a report given under subsection (1).
26
(6) The responsible person must comply with the notice.
27
Penalty: 30 penalty units.
28
(7) A prosecution of a person for an offence against subsection (1)
29
may be commenced at any time within 6 years after the
30
commission of the offence.

25 Application of amendments of section 127 of the Aviation

A delegation to an SES employee, or acting SES employee in force,

immediately before the commencement of this item, under section 127
6
of the Aviation Transport Security Act 2004 (as in force immediately
7
before the commencement of this item) has effect after that
8
commencement as if it were a delegation to the SES employee, or the
9
acting SES employee, under that section as amended by item 8 of this
10
Schedule.

26 Application of Part 2 of this Schedule

The amendments made by Part 2 of this Schedule apply to copying or
13
disclosure that occurs on or after the commencement of that Part.
