A Bill for an Act to amend the Australian Radiation
Protection and Nuclear Safety (Licence Charges) Act 1998, and for related
purposes
The Parliament of Australia enacts:
This
Act may be cited as the Australian Radiation Protection and Nuclear Safety
(Licence Charges) Amendment Act 2002.
This Act is taken to have commenced on 5 February 1999, immediately
after the commencement of the Australian Radiation Protection and Nuclear
Safety (Licence Charges) Act 1998.
Each Act that is specified in a Schedule to this Act is amended or
repealed as set out in the applicable items in the Schedule concerned, and any
other item in a Schedule to this Act has effect according to its
terms.

Protection and Nuclear Safety (Licence Charges) Act
1998
1 After section 5
Insert:
(1) A person who is the holder of a facility licence or a source licence
is liable to pay the charge imposed by this Act:
(a) even if a provision of a Commonwealth law is expressed to exempt the
person from taxes or charges, or specified taxes or charges; and
(b) even if that provision is expressed to prevail over other
laws.
(2) Subsection (1) does not apply if the relevant provision
explicitly refers to this Act.
