The Parliament of Australia enacts:

1 Short title
5
This Act may be cited as the Antarctic Treaty (Environment
6
Protection) Amendment Act 2010.

2 Commencement
8
(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10
column 2 of the table. Any other statement in column 2 has effect
11
according to its terms.

The day this Act receives the Royal Assent.

(a) the day this Act receives the Royal
Assent; and
(b) the day Measure 16, adopted by the
XXXIInd Antarctic Treaty Consultative
Meeting at Baltimore on 17 April 2009,
comes into force for Australia.
However, the provision(s) do not commence
at all if the event mentioned in paragraph (b)
does not occur.
The Minister must announce by notice in the
Gazette the day the Measure comes into
force for Australia.
Note:
This table relates only to the provisions of this Act as originally

passed by both Houses of the Parliament and assented to. It will not be

expanded to deal with provisions inserted in this Act after assent.

24
(1AA) A permit must not authorise a person to take native invertebrates
25
unless:

(a) the Minister is satisfied that the variety of species, the
27
habitats essential to their existence and the balance of the
28
natural ecological systems existing within the Antarctic will
29
be maintained; and
30
(b) the permit is so expressed as to ensure, as far as possible, that
31
the taking authorised by the permit will be carried on to the
32
extent only that it is necessary for:

(i) the construction and operation of scientific support

facilities; or
2
(ii) providing specimens for scientific research, public

education (including display in museums or other

educational institutions) or such other educational

purposes as the Minister thinks fit; or
6
(iii) providing specimens for zoological gardens; or
7
(iv) monitoring or conserving the environment or an historic
8
site or monument; or
9
(v) providing for unavoidable consequences of scientific
10
activities not authorised under subparagraph (ii) or (iii);
11
and
12
(c) in the case of a permit relating to a specially protected
13
species:
14
(i) the permit is granted for a compelling scientific
15
purpose; and
16
(ii) the Minister is satisfied that the activities authorised by
17
the permit will not jeopardise the existing ecological
18
system or the survival or recovery of that species or of
19
the local population of that species; and
20
(iii) if the permit is to kill native invertebrates of that
21
species--there is no suitable alternative technique to
22
achieve the purpose for which the permit is granted.

(1) A person commits an offence if:

(a) the person brings into the Antarctic an organism or an article;

(b) the person, by that conduct, brings into the Antarctic a

micro-organism that is not indigenous to the Antarctic.
23
Penalty: Imprisonment for 2 years or 120 penalty units, or both.
24
(2) Subsection (1) does not apply if:
25
(a) the person brings the organism or article into the Antarctic
26
for use as food; or
27
(b) the person has taken all reasonable precautions to ensure that
28
a micro-organism that is not indigenous to the Antarctic is
29
not brought into the Antarctic by the conduct mentioned in
30
paragraph (1)(a); or

(c) the person has a permit or a recognised foreign authority to

bring in the micro-organism.

(3) Subsection (1) does not apply in relation to the conduct mentioned
3
in paragraph (1)(a) if the conduct was done in an emergency:
4
(a) to save a person from death or serious injury; or
5
(b) to secure the safety of a ship or aircraft or the safety of
6
equipment or facilities of high value; or
7
(c) to protect the environment.

19AD Offences relating to bringing food into the Antarctic
9
Bringing live animals into the Antarctic as food
10
(1) A person must not bring a live animal into the Antarctic for use as
11
food.
12
Penalty: Imprisonment for 2 years or 120 penalty units, or both.
13
Controls to ensure organisms brought into Antarctic as food do not
14
escape
15
(2) If a person brings an organism into the Antarctic for use as food,
16
the person must put controls in place that ensure that the organism
17
does not escape into the Antarctic environment.
18
Penalty: Imprisonment for 2 years or 120 penalty units, or both.
19
Poultry and food products derived from poultry
20
(3) A person commits an offence if:
21
(a) the person brings poultry or any other bird product that is to
22
be used as food into the Antarctic; and
23
(b) the poultry or other bird product is contaminated with
24
disease.
25
Penalty: Imprisonment for 2 years or 120 penalty units, or both.
26
(4) Subsection (3) does not apply if the person has taken all reasonable
27
precautions to ensure that disease is not brought into the Antarctic
28
by the conduct mentioned in paragraph (3)(a).

19AE Offence relating to destruction of organisms brought into

Antarctic without a permit
2
(1) This section applies if:
3
(a) a person brings into, or keeps in, the Antarctic an organism
4
that is not indigenous to the Antarctic; and
5
(b) that conduct is not in accordance with a permit or recognised
6
foreign authority (either because the person does not have
7
one to do so or because the conduct cannot be authorised by a
8
permit or recognised foreign authority); and
9
(c) the organism poses a risk to native fauna and flora.
10
(2) The person must, as soon as is reasonably practicable after
11
bringing the organism into the Antarctic or beginning to keep it,
12
remove or destroy the organism and any progeny of the organism.
13
Penalty: Imprisonment for 2 years or 120 penalty units, or both.
14
(3) Subsection (2) does not apply if:
15
(a) it is not feasible to remove or destroy the organism or its
16
progeny; or
17
(b) the removal or destruction of the organism or its progeny
18
would result in a greater adverse environmental impact than
19
not doing so; or
20
(c) the organism is brought into or kept in the Antarctic to be
21
used as food.
22
(4) The person must, as soon as is reasonably practicable after
23
bringing the organism into the Antarctic or beginning to keep it,
24
take all reasonable steps to avoid or, if already occurring, control
25
the consequences of the conduct mentioned in paragraph (1)(a).
26
Penalty: Imprisonment for 2 years or 120 penalty units, or both.
27
(5) Subsection (4) does not apply if the organism is brought into or
28
kept in the Antarctic to be used as food.

ARTICLE 1

DEFINITIONS
9
For the purposes of this Annex:
10
(a) "native mammal" means any member of any species
11
belonging to the Class Mammalia, indigenous to the
12
Antarctic Treaty area or occurring there naturally through
13
migrations;
14
(b) "native bird" means any member, at any stage of its life cycle
15
(including eggs), of any species of the Class Aves indigenous
16
to the Antarctic Treaty area or occurring there naturally
17
through migrations;
18
(c) "native plant" means any member of any species of terrestrial
19
or freshwater vegetation, including bryophytes, lichens, fungi
20
and algae, at any stage of its life cycle (including seeds, and
21
other propagules), indigenous to the Antarctic Treaty area;
22
(d) "native invertebrate" means any member of any species of
23
terrestrial or freshwater invertebrate, at any stage of its life
24
cycle, indigenous to the Antarctic Treaty area;
25
(e) "appropriate authority" means any person or agency
26
authorised by a Party to issue permits under this Annex;
27
(f) "permit" means a formal permission in writing issued by an
28
appropriate authority;
29
(g) "take" or "taking" means to kill, injure, capture, handle or
30
molest a native mammal or bird, or to remove or damage
31
such quantities of native plants or invertebrates that their
32
local distribution or abundance would be significantly
33
affected;
34
(h)
"harmful
interference"
means:

(i) flying or landing helicopters or other aircraft in a
1
manner that disturbs concentrations of native birds or
2
seals;
3
(ii) using vehicles or vessels, including hovercraft and small
4
boats, in a manner that disturbs concentrations of native
5
birds or seals;
6
(iii) using explosives or firearms in a manner that disturbs
7
concentrations of native birds or seals;
8
(iv) wilfully disturbing breeding or moulting native birds or
9
concentrations of native birds or seals by persons on
10
foot;
11
(v) significantly damaging concentrations of native
12
terrestrial plants by landing aircraft, driving vehicles, or
13
walking on them, or by other means; and
14
(vi) any activity that results in the significant adverse
15
modification of habitats of any species or population of
16
native mammal, bird, plant or invertebrate.
17
(i) "International Convention for the Regulation of Whaling"
18
means the Convention done at Washington on 2 December
19
1946.
20
(j) "Agreement on the Conservation of Albatrosses and Petrels"
21
means the Agreement done at Canberra on 19 June 2001.

ARTICLE 2
24
CASES OF EMERGENCY
25
1. This Annex shall not apply in cases of emergency relating to the
26
safety of human life or of ships, aircraft, or equipment and
27
facilities of high value, or the protection of the environment.
28
2. Notice of activities undertaken in cases of emergency that result in
29
any taking or harmful interference shall be circulated immediately
30
to all Parties and to the Committee.

ARTICLE 3

PROTECTION OF NATIVE FAUNA AND FLORA
34
1. Taking or harmful interference shall be prohibited, except in
35
accordance with a permit.

2. Such permits shall specify the authorised activity, including when,
1
where and by whom it is to be conducted and shall be issued only
2
in the following circumstances:
3
(a) to provide specimens for scientific study or scientific
4
information;
5
(b) to provide specimens for museums, herbaria and botanical
6
gardens, or other educational institutions or uses;
7
(c) to provide specimens for zoological gardens but, in respect of
8
native mammals or birds, only if such specimens cannot be
9
obtained from existing captive collections elsewhere, or if
10
there is a compelling conservation requirement; and
11
(d) to provide for unavoidable consequences of scientific
12
activities not otherwise authorised under sub-paragraphs (a),
13
(b) or (c) above, or of the construction and operation of
14
scientific support facilities.
15
3. The issue of such permits shall be limited so as to ensure that:
16
(a) no more native mammals, birds, plants or invertebrates are
17
taken than are strictly necessary to meet the purposes set
18
forth in paragraph 2 above;
19
(b) only small numbers of native mammals or birds are killed,
20
and in no case more are killed from local populations than
21
can, in combination with other permitted takings, normally
22
be replaced by natural reproduction in the following season;
23
and
24
(c) the diversity of species, as well as the habitats essential to
25
their existence, and the balance of the ecological systems
26
existing within the Antarctic Treaty area are maintained.
27
4. Any species of native mammals, birds, plants and invertebrates
28
listed in Appendix A to this Annex shall be designated "Specially
29
Protected Species", and shall be accorded special protection by the
30
Parties.
31
5. Designation of a species as a Specially Protected Species shall be
32
undertaken according to agreed procedures and criteria adopted by
33
the ATCM.
34
6. The Committee shall review and provide advice on the criteria for
35
proposing native mammals, birds, plants or invertebrates for
36
designation as a Specially Protected Species.

7. Any Party, the Committee, the Scientific Committee on Antarctic
1
Research or the Commission for the Conservation of Antarctic
2
Marine Living Resources may propose a species for designation as
3
a Specially Protected Species by submitting a proposal with
4
justification to the ATCM.
5
8. A permit shall not be issued to take a Specially Protected Species
6
unless the taking:
7
(a) is for a compelling scientific purpose; and
8
(b) will not jeopardise the survival or recovery of that species or
9
local population;
10
9. The use of lethal techniques on Specially Protected Species shall
11
only be permitted where there is no suitable alternative technique.
12
10. Proposals for the designation of a species as a Specially Protected
13
Species shall be forwarded to the Committee, the Scientific
14
Committee on Antarctic Research and, for native mammals and
15
birds, the Commission for the Conservation of Antarctic Marine
16
Living Resources, and as appropriate, the Meeting of the Parties to
17
the Agreement on the Conservation of Albatrosses and Petrels and
18
other organisations. In formulating its advice to the ATCM on
19
whether a species should be designated as a Specially Protected
20
Species, the Committee shall take into account any comments
21
provided by the Scientific Committee on Antarctic Research, and,
22
for native mammals and birds, the Commission for the
23
Conservation of Antarctic Marine Living Resources, and as
24
appropriate, the Meeting of the Parties to the Agreement on the
25
Conservation of Albatrosses and Petrels and other organisations.
26
11. All taking of native mammals and birds shall be done in the
27
manner that involves the least degree of pain and suffering
28
practicable.

ARTICLE 4

INTRODUCTION OF NON-NATIVE SPECIES AND DISEASES
32
1. No species of living organisms not native to the Antarctic Treaty
33
area shall be introduced onto land or ice shelves, or into water, in
34
the Antarctic Treaty area except in accordance with a permit.
35
2. Dogs shall not be introduced onto land, ice shelves or sea ice.

3. Permits under paragraph 1 above shall:
1
(a) be issued to allow the importation only of cultivated plants
2
and their reproductive propagules for controlled use, and
3
species of living organisms for controlled experimental use;
4
and
5
(b) specify the species, numbers and, if appropriate, age and sex
6
of the species to be introduced, along with a rationale,
7
justifying the introduction and precautions to be taken to
8
prevent escape or contact with fauna or flora.
9
4. Any species for which a permit has been issued in accordance with
10
paragraphs 1 and 3 above shall, prior to expiration of the permit, be
11
removed from the Antarctic Treaty area or be disposed of by
12
incineration or equally effective means that eliminates risk to
13
native fauna or flora. The permit shall specify this obligation.
14
5. Any species, including progeny, not native to the Antarctic Treaty
15
area that is introduced into that area without a permit that has been
16
issued in accordance with paragraph 1 and 3 above, shall be
17
removed or disposed of whenever feasible, unless the removal or
18
disposal would result in a greater adverse environmental impact.
19
Such removal or disposal may include by incineration or by
20
equally effective means, so as to be rendered sterile, unless it is
21
determined that they pose no risk to native flora or fauna. In
22
addition, all reasonable steps shall be taken to control the
23
consequences of that introduction to avoid harm to native fauna or
24
flora.
25
6. Nothing in this Article shall apply to the importation of food into

the Antarctic Treaty area provided that no live animals are
27
imported for this purpose and all plants and animal parts and
28
products are kept under carefully controlled conditions and
29
disposed of in accordance with Annex III to the Protocol.

7. Each Party shall require that precautions are taken to prevent the
31
accidental introduction of micro-organisms (e.g., viruses, bacteria,
32
yeasts, fungi) not present naturally in the Antarctic Treaty area.
33
8. No live poultry or other living birds shall be brought into the
34
Antarctic Treaty area. All appropriate efforts shall be made to
35
ensure that poultry or avian products imported into Antarctica are
36
free from contamination by diseases (such as Newcastle's Disease,
37
tuberculosis, and yeast infection) which might be harmful to native

flora and fauna. Any poultry or avian products not consumed shall

be removed from the Antarctic Treaty area or disposed of by
2
incineration or equivalent means that eliminates the risks of
3
introduction of micro-organisms (e.g. viruses, bacteria, yeasts,
4
fungi) to native flora and fauna.

9. The deliberate introduction of non-sterile soil into the Antarctic
6
Treaty area is prohibited. Parties should, to the maximum extent
7
practicable, ensure that non-sterile soil is not unintentionally
8
imported into the Antarctic Treaty area.

INFORMATION

Each Party shall make publicly available information on prohibited
13
activities and Specially Protected Species to all those persons
14
present in or intending to enter the Antarctic Treaty area with a
15
view to ensuring that such persons understand and observe the
16
provisions of this Annex.

EXCHANGE OF INFORMATION
20
1. The Parties shall make arrangements for:
21
(a) collecting and annually exchanging records (including
22
records of permits) and statistics concerning the numbers or
23
quantities of each species of native mammal, bird, plant or
24
invertebrate taken in the Antarctic Treaty area; and
25
(b) obtaining and exchanging information as to the status of
26
native mammals, birds, plants, and invertebrates in the
27
Antarctic Treaty area, and the extent to which any species or
28
population needs protection.
29
2. As early as possible, after the end of each austral summer season,
30
but in all cases before 1 October of each year, the Parties shall
31
inform the other Parties as well as the Committee of any step taken
32
pursuant to paragraph 1 above and of the number and nature of
33
permits issued under this Annex in the preceding period of 1 April
34
to 31 March.

REVIEW

The Parties shall keep under continuing review measures for the
10
conservation of Antarctic fauna and flora, taking into account any
11
recommendations from the Committee.

AMENDMENT OR MODIFICATION

1. This Annex may be amended or modified by a measure adopted in
16
accordance with Article IX (1) of the Antarctic Treaty. Unless the
17
measure specifies otherwise, the amendment or modification shall
18
be deemed to have been approved, and shall become effective, one
19
year after the close of the Antarctic Treaty Consultative Meeting at
20
which it was adopted, unless one or more of the Antarctic Treaty
21
Consultative Parties notifies the Depositary, within that time
22
period, that it wishes an extension of that period or that it is unable
23
to approve the measure.
24
2. Any amendment or modification of this Annex which becomes
25
effective in accordance with paragraph 1 above shall thereafter
26
become effective as to any other Party when notice of approval by
27
it has been received by the Depositary.

33 Application and transitional provisions

(1)
The amendments made by items 6 to 17 apply to permits issued on or
3
after the commencement of this Schedule.

(2)
The amendments made by items 20, 21, 23, 24, 25, 26, 27, 28 and 29
5
apply to acts done on or after the commencement of this Schedule.

(3)
The amendment made by item 22 applies to acts done wholly on or after
7
the commencement of this Schedule.

(4)
To avoid doubt:
9
(a) if an action is done in accordance with a permit or recognised
10
foreign authority issued before the commencement of this
11
Schedule, section 19 of the Antarctic Treaty (Environment
12
Protection) Act 1980 (whether as in force before or after the
13
commencement of this Schedule) does not apply to that
14
action; and
15
(b) if a permit issued before the commencement of this Schedule
16
refers to the taking of a native invertebrate or a native plant,
17
that term has a meaning unaffected by the amendment made
18
by item 3 of this Schedule.

(5)
The amendment made by item 30 applies to:
20
(a) to the extent that the amendment relates to the insertion of
21
section 19AC into the Antarctic Treaty (Environment
22
Protection) Act 1980--bringing an organism or article into
23
the Antarctic on or after the commencement of this Schedule;
24
and
25
(b) to the extent that the amendment relates to the insertion of
26
section 19AD into that Act--bringing an organism or bird
27
product into the Antarctic on or after the commencement of
28
this Schedule; and
29
(c) to the extent that the amendment relates to the insertion of
30
section 19AE into that Act--any organism that is brought
31
into, kept or continues to be kept in the Antarctic on or after
32
the commencement of this Schedule.

(6)
Despite the amendment made by item 31, regulations in force under
34
section 29 of the Antarctic Treaty (Environment Protection) Act 1980
35
immediately before the commencement of this Schedule continue in
