The Parliament of Australia enacts:

1 Short title

This Act is the Competition and Consumer Amendment
5
(Safeguarding the Reputation of Australian Beef) Act 2017.

2 Commencement
7
(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

137A Cattle exporters to ensure no misrepresentations about

Australian beef

(1) This section applies if:
16
(a) a person is engaged in the business of exporting cattle; and
17
(b) the cattle are slaughtered, or processed after slaughter, in a
18
foreign country.

(2) The person must take all reasonable steps to ensure that no product
20
that results from that slaughter or processing is marketed as
21
Australian beef.

Note:
A pecuniary penalty may be imposed for a contravention of this
23
subsection.

(3) In this section:

beef means the fresh or preserved flesh of cattle or calves, and

includes beef products, beef by-products and edible offal.

cattle means bovine animals other than buffaloes.

market: a product is marketed as Australian beef if a
4
representation is made in the course of trade or commerce
5
(including any marking on a package, or statement in advertising)
6
that the product is beef that has any connection with Australia.
7
processed means the dressing of cattle carcases or the treatment,
8
packing, carriage, handling or storage of beef.

The amendments made by this Schedule apply in relation to cattle

exported on or after the commencement of the Schedule.
