A Bill for an Act to amend the Criminal Code Act 1995 to create new offences in relation to transmitting child abuse and pornographic materials by postal or like services, and for related purposes

The Parliament of Australia enacts:

1  Short title

This Act may be cited as the Criminal Code Amendment (Anti-Child Abuse and Pornography Materials) Act 2007.

2  Commencement

This Act commences on the day on which it receives the Royal Assent.

3  Schedule(s)

Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

 

Schedule 1--Amendment of the Criminal Code Act 1995

1  Section 470.1 of the Criminal Code (after the definition of carry by post)

Insert:

child abuse material has the same meaning as in section 473.1.

child pornography material has the same meaning as in section 473.1.

2  After section 471.13

Insert:

471.13A  Using a postal or similar service to transmit child abuse material

Offence

(1) A person is guilty of an offence if the person causes an article of child abuse material to be transmitted by a postal or similar service.

Penalty: Imprisonment for 10 years or 2,500 penalty units, or both.

Definition

(2) To avoid doubt, the definition of carry by post in section 470.1 does not apply to this section.

Defence

(3) For the purposes of this section, a person is taken not to cause an article to be transmitted by a postal or similar service if the person is an employee or agent of Australia Post or similar service and the article is transmitted in the normal course of their duties.

3  After section 471.13

Insert:

471.13B  Using a postal or similar service to transmit child pornography material

Offence

(1) A person is guilty of an offence if the person causes an article of child pornography material to be transmitted by a postal or similar service.

Penalty: Imprisonment for 10 years or 2,500 penalty units, or both.

Definition

(2) To avoid doubt, the definition of carry by post in section 470.1 does not apply to this section.
