A Bill for an Act to amend the Criminal Code Act

The Parliament of Australia enacts:

1 Short title
4
This Act may be cited as the Criminal Code Amendment (Firearms
5
Trafficking) Act 2015.

2 Commencement
7
(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

1 Subsections 360.2(1) and 360.3(1) of the Criminal Code

(penalty)

Repeal the penalty, substitute:

Penalty: Imprisonment for 20 years or a fine of 5,000 penalty
7
units, or both.

2 After section 360.3 of the Criminal Code

Insert:

360.3A Mandatory minimum penalties
11
(1) The court must impose a sentence of imprisonment of at least 5
12
years for a person convicted of an offence against this Division.
13
(2) Subsection (1) does not apply if it is established on the balance of
14
probabilities that the person was aged under 18 years when the
15
offence was committed.

3 Subsections 361.2(1) and (3) and 361.3(1), (3) and (4) of the

Criminal Code (penalty)

Repeal the penalty, substitute:
