1 Short title

This Act is the
Commonwealth Environment Protection Authority
5
Act 2021
.

2 Commencement
7
(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

this Act
The day after the end of the period of 6
months beginning on the later of:
(a) the day this Act receives the Royal
Assent; and
(b) the day the Consolidated Revenue Fund
is appropriated under an Act to the
Department in which this Act is

Commonwealth Environment Protection
Authority.
However, the provisions do not commence
at all if the event mentioned in paragraph (b)
does not occur.
Note:
This table relates only to the provisions of this Act as originally

@501A Commonwealth Environment Protection Authority

(1) The Commonwealth Environment Protection Authority is
12
established by this section.
13
(2) The EPA consists of the following:
14
(a) the CEO;
15
(b) the Deputy CEOs;
16
(c) the staff of the EPA;
17
(d) consultants engaged under section @501ZC.
18
(2) The function of the EPA is to assist the CEO in the performance of
19
his or her functions.
20
(3) The CEO has the control of the operations of the EPA.
21
(4) For the purposes of the finance law (within the meaning of the
22
Public Governance, Performance and Accountability Act 2013
):
23
(a) the EPA is a listed entity; and
24
(b) the CEO is the accountable authority of the EPA; and
25
(c) the following persons are officials of the EPA:
26
(i) the CEO;

(ii) the Deputy CEOs;

(iii) the staff of the EPA;

(iv) consultants engaged under section @501ZC;

(d) the purposes of the EPA include:

(i) the function of the EPA referred to in subsection (2) of
5
this section; and
6
(ii) the functions of the CEO referred to in section @501C;
7
and
8
(iii) the functions of the OMCEA referred to in section
9
@501Y.

Subdivision B--Chief Executive Officer
11
@501B Chief Executive Officer
12
There is to be a Chief Executive Officer of the Commonwealth
13
Environment Protection Authority.
14
@501C Functions and powers
15
(1) The CEO has the following functions:
16
(a) the functions conferred on the CEO by this Act or other
17
Commonwealth legislation;
18
Note:
Other provisions of this Act give the CEO functions involving
19
exercising the routine administrative environmental regulatory
20
functions of the Commonwealth, monitoring compliance with
21
this Act and enforcing this Act.
22
(b) the following functions relating to communities:
23
(i) educating communities about the administration of
24
Commonwealth environmental laws;
25
(ii) to the extent Commonwealth environmental laws allow
26
for community involvement in the administration of
27
those laws--promoting the take-up of those
28
opportunities;
29
(iii) increasing public confidence in the administration of
30
Commonwealth environmental laws;
31
(c) to make recommendations to the Minister as to regulations
32
that should be made in order to advance the purposes of this
33
Act;

(d) any functions conferred on the CEO by regulations made for
1
the purposes of this paragraph;
2
(e) any functions incidental to any of the above.

(2) The CEO has power to do all things necessary or convenient to be
4
done for or in connection with the performance of his or her
5
functions.
6
(3) In performing his or her functions, the CEO must act effectively,
7
efficiently, equitably and transparently.
8
CEO solely responsible for performing his or her functions
9
(4) The Minister must not give directions to the CEO about the
10
performance of the CEO's functions.
11
(5) If the Minister gives a direction (whether express or implied) to the
12
CEO contrary to subsection (5), the CEO must disregard the
13
direction.

@501D Appointment
15
(1) The CEO is to be appointed by the Governor-General by written
16
instrument.

Note:
The CEO may be reappointed: see section 33AA of the
Acts
18
Interpretation Act 1901
.

(2) The CEO holds office for the period specified in the instrument of
20
appointment. The period must be 5 years.
21
(3) The Governor-General must not appoint a person as the CEO
22
unless:
23
(a) the Minister is satisfied that the person qualifies for the
24
appointment because of the person's knowledge of, or
25
experience in, any of the following:
26
(i) conservation of biodiversity;
27
(ii) ecologically sustainable development;
28
(iii) heritage;
29
(iv) Indigenous affairs;
30
(v) law;
31
(vi) law enforcement;

(vii) natural resource management; and
1
(b) the Minister has referred the proposed appointment to the
2
joint committee for approval; and
3
(c) the joint committee has approved the proposed appointment.

(4) The first person appointed as CEO must have knowledge of, or
5
experience in, law enforcement.
6
(5) The CEO, or at least one of the Deputy CEOs, must be an
7
Indigenous person. This subsection has effect despite Part II of the
8
Racial Discrimination Act 1975
.
9
(6) A person is not eligible to be appointed as CEO if, at any time
10
during the 5 years before the start of the appointment, the person
11
was any of the following:
12
(a) a member of the Federal Parliament, a State Parliament or the
13
Legislative Assembly of a Territory;
14
(b) a registered political campaigner (within the meaning of the
15
Commonwealth Electoral Act 1918
);
16
(c) registered as a lobbyist (however described) under a law of a
17
State or Territory or a foreign country;
18
(d) a senior executive in:
19
(i) an industry association (whether in Australia or a
20
foreign country); or
21
(ii) an environmental organisation on the register of
22
environmental organisations kept under
23
Subdivision 30-E of the
Income Tax Assessment Act
24
1997
, or on a similar register in a foreign country.
25
Note:
Under section 29 of the
Public Governance, Performance and
26
Accountability Act 2013
, and the rules made under that Act, the CEO
27
must, in writing, disclose material personal interests that relate to the
28
affairs of the EPA to the Minister.

@501E Acting CEO
30
(1) The senior Deputy CEO acts as the CEO:
31
(a) during a vacancy in the office of CEO (whether or not an
32
appointment has previously been made to the office); or
33
(b) during any period, or during all periods, when the CEO:
34
(i) is absent from duty or from Australia; or

(ii) is, for any reason, unable to perform the duties of the
1
office.

(2) The
senior Deputy CEO
is the Deputy CEO who, out of the
3
Deputy CEOs who are:
4
(a) not absent from duty or from Australia; and
5
(b) able to perform the duties of their offices;
6
was appointed first.
7
@501F Other paid work
8
The CEO must not engage in paid work outside the duties of the
9
CEO's office without the Minister's approval.
10
@501G Remuneration
11
(1) The CEO is to be paid the remuneration that is determined by the
12
Remuneration Tribunal. If no determination of that remuneration
13
by the Tribunal is in operation, the member is to be paid the
14
remuneration that is prescribed by the regulations.
15
(2) The CEO is to be paid the allowances that are prescribed by the
16
regulations.

(3) Subsections 7(9) and (13) of the
Remuneration Tribunal Act 1973
18
do not apply in relation to the office of CEO.
19
Note:
The effect of this subsection is that remuneration or allowances of the
20
CEO will be paid out of money appropriated by an Act other than the
21
Remuneration Tribunal Act 1973
.

(4) This section has effect subject to the
Remuneration Tribunal Act
23
1973
(except as provided by subsection (3)).

@501H Leave of absence
25
(1) The CEO has the recreation leave entitlements that are determined
26
by the Remuneration Tribunal.
27
(2) The Minister may grant the CEO leave of absence, other than
28
recreation leave, on the terms and conditions as to remuneration or
29
otherwise that the Minister determines.

@501J Resignation
1
(1) The CEO may resign the CEO's appointment by giving the
2
Minister a written resignation.
3
(2) The resignation takes effect on the day it is received by the
4
Minister or, if a later day is specified in the resignation, on that
5
later day.

@501K Termination of appointment
7
(1) The Governor-General may terminate the appointment of the CEO:
8
(a) for misbehaviour; or
9
(b) if the CEO is unable to perform the duties of the CEO's
10
office because of physical or mental incapacity.
11
(2) The Governor-General may terminate the appointment of the CEO
12
if:
13
(a) the CEO:
14
(i) becomes bankrupt; or
15
(ii) applies to take the benefit of any law for the relief of
16
bankrupt or insolvent debtors; or
17
(iii) compounds with the CEO's creditors; or
18
(iv) makes an assignment of the CEO's remuneration for the
19
benefit of the CEO's creditors; or
20
(b) the CEO is absent, except on leave of absence, for 14
21
consecutive days or for 28 days in any 12 months; or
22
(c) the CEO engages, except with the Minister's approval, in
23
paid work outside the duties of the CEO's office (see section
24
@501F).

Note:
The appointment of the CEO may also be terminated under section 30
26
of the
Public Governance, Performance and Accountability Act 2013
27
(which deals with terminating the appointment of an accountable
28
authority, or a member of an accountable authority, for contravening
29
general duties of officials).

@501L Terms and conditions of appointment
31
The CEO holds office on the terms and conditions (if any) in
32
relation to matters not covered by this Act that are determined by
33
the Minister.

@501M Delegation by CEO
1
(1) The CEO may, in writing, delegate all or any of the CEO's
2
functions or powers under any law to:
3
(a) a Deputy CEO; or
4
(b) an SES employee, or acting SES employee, in the EPA.
5
Note:
Sections 34AA to 34A of the
Acts Interpretation Act 1901
contain
6
provisions relating to delegations.
7
(2) In performing a delegated function or exercising a delegated
8
power, the delegate must comply with any written directions of the
9
CEO.
10
(3) This section does not apply to a function or power of the CEO if a
11
law other than this section provides for the delegation of that
12
function or power.

Subdivision C--Deputy Chief Executive Officers
14
@501N Deputy Chief Executive Officers
15
(1) There are to be 4 Deputy Chief Executive Officers of the
16
Commonwealth Environment Protection Authority.
17
(2) A Deputy CEO is to be appointed by the Governor-General by
18
written instrument.

Note:
A Deputy CEO may be reappointed: see section 33AA of the
Acts
20
Interpretation Act 1901
.

(3) A Deputy CEO holds office for the period specified in the
22
instrument of appointment. The period must be 5 years.
23
(4) The Governor-General must not appoint a person as a Deputy CEO
24
unless:
25
(a) the Minister is satisfied that the person qualifies for the
26
appointment because of the person's knowledge of, or
27
experience in, any of the following:
28
(i) conservation of biodiversity;
29
(ii) ecologically sustainable development;
30
(iii) heritage;

(5) At least one of the first 4 Deputy CEOs must have knowledge of,
7
or experience in, law enforcement.

Note:
Under subsection @501D(5), the CEO, or at least one of the Deputy
9
CEOs, must be an Indigenous person.

(6) A person is not eligible to be appointed as a Deputy CEO if, at any
11
time during the 5 years before the start of the appointment, the
12
person was any of the following:
13
(a) a member of the Federal Parliament, a State Parliament or the
14
Legislative Assembly of a Territory;
15
(b) a registered political campaigner (within the meaning of the
16
Commonwealth Electoral Act 1918
);
17

(b) during any period, or during all periods, when a Deputy
33
CEO:

(i) is absent from duty or from Australia; or

A Deputy CEO
must not engage in paid work outside the duties of
6
the Deputy CEO's office without the Minister's approval.

@501R Remuneration
8
(1) A Deputy CEO is to be paid the remuneration that is determined by
9
the Remuneration Tribunal. If no determination of that
10
remuneration by the Tribunal is in operation, the member is to be
11
paid the remuneration that is prescribed by the regulations.
12
(2) A Deputy CEO is to be paid the allowances that are prescribed by
13
the regulations.

(3) Subsections 7(9) and (13) of the
Remuneration Tribunal Act 1973
15
do not apply in relation to the office of Deputy CEO.
16
Note:
The effect of this subsection is that remuneration or allowances of a
17
Deputy CEO will be paid out of money appropriated by an Act other

(4) This section has effect subject to the

with section @501V.

@501V Disclosure of interests to the Minister
28
A Deputy CEO must give written notice to the Minister of all
29
interests, pecuniary or otherwise, that the Deputy CEO has or
30
acquires and that conflict or could conflict with the proper
31
performance of the Deputy CEO's functions.

@501W Terms and conditions of appointment
1
A Deputy CEO holds office on the terms and conditions (if any) in
2
relation to matters not covered by this Act that are determined by
3
the Minister.

@501X Delegation by Deputy CEO
5
(1) A Deputy CEO may, in writing, delegate all or any of the CEO's
6
functions or powers (including a function or power delegated to the
7
Deputy CEO under section @501M) to an SES employee, or acting
8
SES employee, in the EPA.
9
Note:
Sections 34AA to 34A of the
Acts Interpretation Act 1901
contain
10
provisions relating to delegations.
11
(2) In performing a delegated function or exercising a delegated
12
power, the delegate must comply with any written directions of the
13
Deputy CEO.
14
(3) This section does not apply to a function or power of a Deputy
15
CEO if:
16
(a) a law other than this section provides for the delegation of
17
that function or power; or
18
(b) the power was delegated to the Deputy CEO under a
19
provision other than section @501M.

Subdivision D--Monitoring, compliance, enforcement and
21
assurance
22
@501Y Office of Monitoring, Compliance, Enforcement and
23
Assurance
24
(1) There is to be within the EPA an Office of Monitoring,
25
Compliance, Enforcement and Assurance of the Commonwealth
26
Environment Protection Authority.
27
(2) The OMCEA must include a Deputy CEO.
28
(3) The OMCEA has the function of assisting the CEO in performing
29
his or her functions, to the extent those functions relate to
30
monitoring compliance with, and enforcing, Commonwealth
31
environmental laws.

@501Z CEO must consult Auditor General
1
(1) The CEO must consult the Auditor-General in establishing the
2
EPA's monitoring, compliance, enforcement and assurance
3
systems.
4
(2) The Auditor-General must conduct performance audits of the
5
EPA's monitoring, compliance, enforcement and assurance
6
systems:
7
(a) 3 years after the commencement of this section; and
8
(b) at such times occurring:
9
(i) after the first audit; and
10
(ii) before 1 January 2036;
11
as the Auditor-General considers appropriate, such that no
12
more than 5 years occurs between audits.
13
@501ZA Monitoring plans
14
Before the CEO, under a Commonwealth environmental law:
15
(a) grants an approval, permit, licence or other permission
16
(however described) subject to conditions; or
17
(b) imposes new conditions on such an approval etc.;
18
the CEO must develop a plan to monitor compliance with the
19
conditions.

Subdivision E--Staff and consultants
21
@501ZB Staff
22
(1) The staff of the EPA must be persons engaged under the
Public
23
Service Act 1999
.
24
(2) For the purposes of the
Public Service Act 1999
:
25
(a) the CEO and the APS employees assisting the CEO together
26
constitute a Statutory Agency; and
27
(b) the CEO is the Head of that Statutory Agency.

@501ZC Consultants
1
The CEO may, on behalf of the Commonwealth, engage
2
consultants to assist in the performance of the CEO's functions.

Subdivision F--Miscellaneous
4
@501ZD Fees
5
(1) The CEO may charge a fee for the performance of any of the
6
CEO's or EPA's functions.
7
(2) Subsection (1) does not apply to performing a function:
8
(a) on the CEO's own initiative; or
9
(b) if a Commonwealth law other than this Division deals with
10
the charging of fees for the performance of that function.

@501ZE Annual report
12
The annual report prepared by the CEO and given to the Minister
13
under section 46 of the
Public Governance, Performance and
14
Accountability Act 2013
for a period must include details about the
15
action the CEO took during the year to establish and maintain the
16
EPA's monitoring, compliance, enforcement and assurance
17
systems, including the following:
18
(a) any advice the Auditor-General gave to the CEO under
19
subsection @501Z(1) during the year;
20
(b) any action the CEO has taken during the year in response to
21
advice given by the Auditor-General under subsection
22
@501Z(1);
23
(c) if the Auditor-General conducted an audit under subsection
24
@501Z(2) during the year--a copy of the Auditor-General's
25
report of the audit.
26
@501ZF Vacancies to be filled as soon as practicable
27
If a vacancy occurs in the office of CEO or in an office of Deputy
28
CEO, the Minister and the joint committee must take all reasonable
29
steps to ensure that the vacancy is filled as soon as practicable.

Division 1B--Parliamentary Joint committee on

Environment and Energy

@501ZG Parliamentary Joint committee on Environment and

Energy

(1) As soon as practicable after the commencement of the first session
5
of each Parliament, a joint committee of members of the
6
Parliament to be known as the Parliamentary Joint committee on
7
Environment and Energy is to be appointed according to the
8
practice of the Parliament with reference to the appointment of
9
members to serve on joint select committees of both Houses of the
10
Parliament.
11
(2) The joint committee is to consist of 12 members:
12
(a) 6 of whom must be members of the Senate appointed by the
13
Senate, and 6 of whom must be members of the House of
14
Representatives appointed by that House; and
15
(b) 5 of whom must be members of the Government; and
16
(c) 5 of whom must be members of the Opposition; and
17
(d) 2 of whom must be members of the Parliament other than
18
members of the Government or Opposition.
19
(3) The co-Chairs of the joint committee are to be:
20
(a) the joint committee member nominated as co-Chair by the
21
Prime Minister; and
22
(b) the joint committee member nominated as co-Chair by the
23
leader of the Opposition.
24
(4) A member of the Parliament is not eligible for appointment as a
25
joint committee member if the member is:
26
(a) a Minister; or
27
(b) the President of the Senate; or
28
(c) the Speaker of the House of Representatives; or
29
(d) the Deputy President and Chair of Committees of the Senate
30
or the Deputy Speaker of the House of Representatives.
31
(5) A joint committee member ceases to hold office:
32
(a) when the House of Representatives expires by the passing of
33
time or is dissolved; or

provided by subsection (6) or (7).

(6) A joint committee member appointed by the Senate may resign his
8
or her office by writing signed by him or her and delivered to the

President of the Senate.

(7) A joint committee member appointed by the House of

Representatives may resign his or her office by writing signed by
12
him or her and delivered to the Speaker of that House.

(8) Either House of the Parliament may appoint one of its members to
14
fill a vacancy amongst the members of the joint committee
15
appointed by that House.

@501ZH Powers and proceedings of the joint committee
17
All matters relating to the powers and proceedings of the joint
18
committee are to be determined by resolution of both Houses of the
19
Parliament.

@501ZJ Duties of the joint committee
21
(1) The joint committee has the following duties:
22
(a) to monitor the CEO's performance of his or her functions;
23
(b) to report to both Houses of the Parliament, with such
24
comments as it thinks fit, on any matter connected with the
25
performance of the CEO's function that the joint committee
26
considers should be directed to the attention of Parliament;
27
(c) to examine each annual report prepared by the CEO under
28
the
Public Governance, Performance and Accountability Act
29
2013
and report to both Houses of the Parliament on any
30
matter appearing in, or arising out of, any such annual report
31
or special report;

(d) to inquire into any question in connection with the joint

committee's duties that is referred to it by either House of the

(f) to make recommendations to both Houses of the Parliament,

the Minister and the CEO on:

(ii) what proportion of the EPA's budget should be spent on

monitoring, compliance, enforcement and assurance.

(2) Subsection (1) does not authorise the joint committee to reconsider
11
the CEO's decisions or recommendations in relation to a particular
12
decision under a Commonwealth environmental law.

@501ZK Estimates

(1) Without limiting section @501ZH, the joint committee may
15
request the CEO to submit to the joint committee draft estimates
16
for the EPA for a financial year before the Federal budget for that
17
financial year.
18
(2) The CEO must comply with the request in time to allow the joint
19
committee to consider the draft estimates and make
20
recommendations on them before the budget.

501ZL Review of Commonwealth environmental laws
22
The joint committee must:
23
(a) regularly review Commonwealth environmental laws; and
24
(b) if the joint committee reasonably believes that the purposes
25
of those laws would be better achieved if any functions under
26
those laws were transferred to the CEO--recommend to both
27
Houses of the Parliament and the Minister that the functions
28
be transferred to the CEO.

(3) Despite anything else in this Part, the CEO may, by written

instrument, suspend or revoke the approval if the CEO is satisfied
4
on reasonable grounds that:

(a) the applicant, in connection with the approval, intentionally
6
mispresented the impact of the action on the environment
7
(whether in the application, an environmental impact
8
statement or in any other document or evidence);
9
(b) the action constitutes a significant threat to the environment;
10
and
11
(c) the suspension or termination is likely to mitigate that threat;
12
and
13
(d) attaching conditions under subsection (2) would not be a
14
sufficient response to the threat; and
15
(e) it is not practicable, in the circumstances, to suspend or
16
revoke the approval under the other provisions of this
17
Division.

(4) As soon as possible after making an instrument under
19
subsection (2) or (3), the Minister must:
20
(a) give a copy of it to the holder of the approval; and
21
(b) publish the instrument in accordance with the regulations.

comply with the requirement; and

(1) An inspector may require a person, by notice, to produce a record

(2) The notice must:

(a) be in writing; and

(b) be served on the person; and

(c) require the person to produce the record or document at a

specified place within a specified period of at least 14 days.

The notice may be served by sending the notice to the person's fax
9
number.

(3) A person who is served with a notice to produce must not fail to

comply with the notice.

(1) An inspector may inspect, take extracts from, and make copies of,
5
any document that is, or that the inspector suspects on reasonable
6
grounds is, evidential material in relation to an offence against an
7
environmental law, in relation to a contravention of a civil penalty
8
provision or in relation to both.
9
(2) Subsection (3) applies if:
10
(a) as a result of the exercise of a power under subsection (1),
11
property is damaged; and
12
(b) the damage or corruption occurs because insufficient care
13
was exercised in exercising the power; or
14
(3) The Commonwealth must pay the owner of the equipment, or the
15
user of the data or programs, such reasonable compensation for the
16
damage or corruption as the Commonwealth and the owner or user
17
agree on.
18
(4) However, if the owner or user and the Commonwealth fail to
19
agree, the owner or user may institute proceedings in a relevant
20
court for such reasonable amount of compensation as the court
21
determines.
22
(5) In determining the amount of compensation payable, regard is to
23
be had to whether the occupier of the premises, or the occupier's
24
employees or agents, if they were available at the time, provided
25
any appropriate warning or guidance on the operation of the
26
equipment.
27
(6) Compensation is payable out of money appropriated by the
28
Parliament.

An inspector, in carrying out monitoring and investigation

functions under this Act, may enter or cross any land or waters:

(1) The Minister may, by legislative instrument, make rules

prescribing matters of a transitional nature (including prescribing

any saving or application provisions) relating to the amendments or

repeals made by this Act.

(2) To avoid doubt, the rules may not do the following:

(a) create an offence or civil penalty;
8
(b) provide powers of:

(i) arrest or detention; or
10
(ii) entry, search or seizure;

(c) impose a tax;

(d) set an amount to be appropriated from the Consolidated
