1 Short title
7
This Act may be cited as the Coordinator-General for Remote
8
Indigenous Services Act 2009.

This Act commences on the day on which it receives the Royal
2
Assent.

3 Object of Act
4
The object of this Act is to provide for a Coordinator-General for
5
Remote Indigenous Services, who will monitor, assess, advise in
6
relation to, and drive:
7
(a) the development and delivery of services and facilities by
8
governments, in each remote location specified by the
9
Minister, to a standard broadly comparable with that in
10
non-Indigenous communities of similar size, location and
11
needs elsewhere in Australia, including through:
12
(i) improvements to the coordination of the development
13
and delivery of such services and facilities; and
14
(ii) reforms to the development and delivery of such
15
services and facilities; and
16
(b) progress towards achieving the Closing the Gap targets in
17
those specified locations.

4 Definitions
19
In this Act:
20
Agency Head has the meaning given by the Public Service Act
21
1999.
22
Closing the Gap targets means the 6 targets agreed to in the
23
National Indigenous Reform Agreement, included in Schedule F to
24
the Intergovernmental Agreement on Federal Financial Relations
25
that took effect on 1 January 2009.
26
Coordinator-General means the Coordinator-General for Remote
27
Indigenous Services mentioned in section 7.
28
government services and facilities, in a community, means
29
services and facilities provided in the community by, for or on
30
behalf of the Commonwealth, a State, a Territory or a local
31
government, whether the services and facilities are provided:

(a) only to Indigenous persons; or
1
(b) to the community more generally.

head, of a service agency, means:
3
(a) in the case of an Agency (within the meaning of the Public
4
Service Act 1999)--the Agency Head of the Agency; or
5
(b) in the case of any other service agency established for a
6
public purpose--the person holding, or performing the duties
7
of, the principal office in respect of the service agency; or
8
(c) in the case of an individual--that individual; or
9
(d) in any other case--the chief executive officer (however
10
described) of the service agency.

Indigenous means:
12
(a) a member of the Aboriginal race of Australia; or
13
(b) a descendant of the Indigenous inhabitants of the Torres
14
Strait Islands.

Local Implementation Plans has the meaning given by the
16
National Partnership Agreement on Remote Service Delivery.
17
member of the Coordinator-General's staff means an APS
18
employee whose services are made available to the
19
Coordinator-General as mentioned in section 27.
20
National Partnership Agreement on Remote Service Delivery
21
means the National Partnership Agreement on Remote Service
22
Delivery that took effect on 27 January 2009.
23
non-Indigenous community means a community of which no
24
significant proportion is Indigenous.
25
remote location means a Remote Indigenous Location (within the
26
meaning given by the National Partnership Agreement on Remote
27
Service Delivery).

service agency means a department, agency or authority of:
29
(a) the Commonwealth; or
30
(b) a State; or
31
(c) a Territory.

specified remote community has the meaning given by section 5.

5 Specified re mote community
2
(1) A specified remote community is a community in a remote
3
location specified by the Minister under subsection (2).
4
(2) The Minister may, by notice published in the Gazette, specify a
5
remote location in a State or a Territory for the purposes of
6
subsection (1) if a significant proportion of the population of the
7
location is Indigenous.
8
(3) A notice made under subsection (2) is not a legislative instrument.
9
6 Act binds Crown
10
(1) This Act binds the Crown in each of its capacities.
11
(2) This Act does not make the Crown liable to be prosecuted for an
12
offence.

8 Functions of Coordinator-General

The functions of the Coordinator-General are to monitor, assess,
4
advise in relation to, and drive:
5
(a) the development and delivery of government services and
6
facilities in each of the specified remote communities to a
7
standard broadly comparable with that in non-Indigenous
8
communities of similar size, location and needs elsewhere in
9
Australia, including through:
10
(i) improvements to the coordination of the development
11
and delivery of such services and facilities; and
12
(ii) reforms to the development and delivery of such
13
services and facilities; and
14
(b) progress towards achieving the Closing the Gap targets in the
15
specified remote communities.

9 Powe rs of Coordinator-General
17
(1) The Coordinator-General has power to do all things necessary or
18
convenient to be done for or in connection with the performance of
19
his or her functions.
20
(2) The Coordinator-General's powers include, but are not limited to,
21
the following powers:
22
(a) the power under section 10 to request persons to produce
23
information and documents to the Coordinator-General;
24
(b) the power to request persons to attend meetings convened by
25
the Coordinator-General;
26
(c) the power to request assistance from service agencies;
27
(d) the power under section 16 to report failures to comply with
28
requests made by the Coordinator-General, including the
29
power to report such failures to the Minister;
30
(e) the power under section 14 to comment on Local
31
Implementation Plans;

(f) the power to do anything incidental to the

Coordinator-General's functions;

(g) any other powers conferred on the Coordinator-General by

this Act or by any other law.

10 Coordinator-General may request persons to provide
2
information and documents etc.

(1) For the purpose of performing his or her functions, the
4
Coordinator-General may request a person:
5
(a) to give the Coordinator-General specified information within
6
a specified time; or
7
(b) to produce to the Coordinator-General specified documents
8
within a specified time; or
9
(c) to attend before the Coordinator-General to answer questions
10
at a specified place at a specified time.
11
Note 1:
Section 11 provides that compliance with a request does not result in a
12
loss of legal professional privilege.
13
Note 2:
If a person fails to comply with a request, the Coordinator-General
14
may report the failure: see section 16.
15
(2) A person who, in good faith, complies with a request under
16
subsection (1) is not liable:
17
(a) to any proceedings for contravening any other law because of
18
that conduct; or
19
(b) to civil proceedings for loss, damage or injury of any kind
20
suffered by another person because of that conduct.
21
11 No loss of legal professional privilege
22
Information or a document does not cease to be the subject of legal
23
professional privilege merely because it is:
24
(a) given or produced in response, or included or referred to in a
25
response, to a request made under section 10; or
26
(b) referred to in answering a question asked pursuant to a
27
request made under section 10.

12 Coordinator-General may make and keep copies of docume nts

The Coordinator-General may make and keep copies of all or part
30
of any documents produced under section 10.

13 Limitation of powe rs under this Division
1
This Division does not have effect to the extent that it would
2
impair the capacity of a State to exercise its constitutional powers.

(1) The Coordinator-General may comment on draft Local

Implementation Plans.

(2) The Coordinator-General must monitor the implementation of each

Local Implementation Plan.

15 Regular reports on government services and facilities in specified
2
re mote communities

The Coordinator-General must prepare and give to the Minister
4
twice each year, or as otherwise required by the Minister, a report
5
on:
6
(a) the development and delivery, during the period since the
7
Coordinator-General last gave a report to the Minister under
8
this section, of government services and facilities in each of
9
the specified remote communities to a standard broadly
10
comparable with that in non-Indigenous communities of
11
similar size, location and needs elsewhere in Australia,
12
including through:
13
(i) improvements to the coordination of the development
14
and delivery of such services and facilities; and
15
(ii) reforms to the development and delivery of such
16
services and facilities; and
17
(b) the progress that has been made during that period towards
18
achieving the Closing the Gap targets in the specified remote
19
communities.
20
16 Reports on failures to comply with requests
21
Scope
22
(1) This section applies if:
23
(a) a person fails to comply with a request made by the
24
Coordinator-General under:
25
(i) paragraph 9(2)(b) (attendance at meetings); or
26
(ii) section 10 (provision of information and documents
27
etc.); or
28
(b) a service agency fails to comply with a request for assistance
29
made by the Coordinator-General under paragraph 9(2)(c); or
30
(c) an Agency Head or APS employee fails to cooperate with the
31
Coordinator-General.

Initial discussion of Coordinator-General's concerns

(2) The Coordinator-General may discuss the matter with such persons
2
as the Coordinator-General considers appropriate.
3
Coordinator-General may escalate concerns
4
(3) If the Coordinator-General is not satisfied with the result of the
5
discussions under subsection (2), the Coordinator-General may
6
report the matter to the head of the relevant service agency.
7
(4) If the Coordinator-General is not satisfied with the response of the
8
head of the service agency, the Coordinator-General may report the
9
matter to:
10
(a) the Minister; and
11
(b) if the Coordinator-General considers it necessary to do so--
12
the Prime Minister.

17 Other reports
14
For the purpose of performing his or her functions, the
15
Coordinator-General may prepare and give to the Minister reports
16
other than those mentioned in sections 15 and 16.

18 Criticism of service agencies
18
If the Coordinator-General proposes to include in a report under
19
this Division material that is expressly or impliedly critical of a
20
service agency, or a part of a service agency, the
21
Coordinator-General must consult with the head of that service
22
agency.

Note:
Compliance with this section for the purposes of including material in
24
one report under this Division also counts as compliance for the
25
purposes of including substantially the same material in another report
26
under this Division.

19 Appointment
4
Appointment by Governor-General on full-time basis
5
(1) The Coordinator-General is to be appointed by the
6
Governor-General by written instrument. The appointment is to be
7
on a full-time basis.

Note:
The Coordinator-General is eligible for reappointment: see subsection
9
33(4A) of the Acts Interpretation Act 1901.

Obligation to fill vacancy as soon as practicable
11
(2) Whenever a vacancy occurs in the office of Coordinator-General,
12
an appointment must be made to the office as soon as practicable.
13
Period of appointment
14
(3) The Coordinator-General holds office for the period specified in
15
the instrument of appointment. The period must not exceed 5 years.
16
Terms and conditions not covered by this Act
17
(4) The Coordinator-General holds office on the terms and conditions
18
(if any) in relation to matters not covered by this Act that are
19
determined by the Governor-General.
20
20 Acting appointments
21
(1) The Minister may, by written instrument, appoint a person to act as
22
the Coordinator-General:
23
(a) during a vacancy in the office of Coordinator-General
24
(whether or not an appointment has previously been made to
25
the office); or
26
(b) during any period, or during all periods, when the
27
Coordinator-General:
28
(i) is absent from duty or from Australia; or

(ii) is, for any reason, unable to perform the duties of the

office.

(2) An appointment under subsection (1) ceases to have effect after 12
3
months if it does not cease earlier.
4
(3) Anything done by or in relation to a person purporting to act under
5
an appointment is not invalid merely because:
6
(a) the occasion for the appointment had not arisen; or
7
(b) there was a defect or irregularity in connection with the
8
appointment; or
9
(c) the appointment had ceased to have effect; or
10
(d) the occasion to act had not arisen or had ceased.

See sections 20 and 33A of the Acts Interpretation Act 1901.

21 Remuneration
13
(1) The Coordinator-General is to be paid the remuneration that is
14
determined by the Remuneration Tribunal. If no determination of
15
that remuneration by the Tribunal is in operation, the
16
Coordinator-General is to be paid the remuneration that is
17
prescribed by the regulations.
18
(2) The Coordinator-General is to be paid the allowances that are
19
prescribed by the regulations.
20
(3) This section has effect subject to the Remuneration Tribunal Act
21
1973.

22 Leave of absence
23
(1) The Coordinator-General has the recreation leave entitlements that
24
are determined by the Remuneration Tribunal.
25
(2) The Minister may grant the Coordinator-General leave of absence,
26
other than recreation leave, on the terms and conditions as to
27
remuneration or otherwise that the Minister determines.

23 Engaging in other paid work
1
The Coordinator-General must not engage in paid employment
2
outside the duties of his or her office without the Minister's
3
approval.

24 Disclosure of interests to the Minister
5
The Coordinator-General must give written notice to the Minister
6
of all interests, pecuniary or otherwise, that the
7
Coordinator-General has or acquires and that could conflict with
8
the proper performance of the Coordinator-General's functions.
9
25 Resignation
10
(1) The Coordinator-General may resign his or her appointment by
11
giving the Governor-General a written resignation.
12
(2) The resignation takes effect:
13
(a) on the day it is received by the Governor-General; or
14
(b) if a later day is specified in the resignation--on that later day.

Termination of appointment
16
Obligation to terminate on certain grounds
17
(1) The Governor-General must terminate the appointment of the
18
Coordinator-General if:
19
(a) the Coordinator-General:
20
(i) becomes bankrupt; or
21
(ii) applies to take the benefit of any law for the relief of
22
bankrupt or insolvent debtors; or
23
(iii) compounds with his or her creditors; or
24
(iv) makes an assignment of his or her remuneration for the
25
benefit of his or her creditors; or
26
(b) the Coordinator-General is absent, except on leave of
27
absence, for 10 consecutive days or for 28 days in any 12
28
months; or

(c) the Coordinator-General engages, except with the Minister's

approval, in paid employment outside the duties of his or her
2
office (see section 23); or
3
(d) the Coordinator-General fails, without reasonable excuse, to
4
comply with section 24.

Discretion to terminate for misbehaviour or physical or mental
6
incapacity
7
(2) Subject to subsections (3), (4) and (5), the Governor-General may
8
terminate the appointment of the Coordinator-General:
9
(a) on the ground of misbehaviour or physical or mental
10
incapacity; or
11
(b) if the Minister is satisfied that the performance of the
12
Coordinator-General has been unsatisfactory.
13
(3) If the Coordinator-General:
14
(a) is an eligible employee for the purposes of the
15
Superannuation Act 1976; and
16
(b) has not reached his or her maximum retiring age (within the
17
meaning of that Act);
18
his or her appointment cannot be terminated on the ground of
19
physical or mental incapacity unless the Board (within the meaning
20
of that Act) has given a certificate under section 54C of that Act.
21
(4) If the Coordinator-General:
22
(a) is a member of the superannuation scheme established by
23
deed under the Superannuation Act 1990; and
24
(b) is under 60 years of age;
25
his or her appointment cannot be terminated on the ground of
26
physical or mental incapacity unless the Board (within the meaning
27
of that Act) has given a certificate under section 13 of that Act.
28
(5) If the Coordinator-General:
29
(a) is an ordinary employer-sponsored member of PSSAP,
30
within the meaning of the Superannuation Act 2005; and
31
(b) is under 60 years of age;
32
his or her appointment cannot be terminated on the ground of
33
physical or mental incapacity unless the Board (within the meaning
34

of that Act) has given an approval and certificate under section 43
1
of that Act.

27 Coordinator-General's staff

The Coordinator-General may arrange with the Secretary of the
4
Department for the services of APS employees in the Department
5
to be made available to the Coordinator-General.

28 Annual reports

Annual report to be given to Minister
4
(1) The Coordinator-General must, as soon as practicable after 30 June
5
in each year, prepare and give to the Minister a report (an annual
6
report) on the operations of the Coordinator-General, and the
7
Coordinator-General's staff, during the year that ended on that
8
30 June.

Annual report to be tabled in Parliament
10
(2) The Minister must cause a copy of each annual report to be tabled
11
in each House of the Parliament within 15 sitting days of that
12
House after the day on which the Minister receives the report.
13
29 Delegation of ce rtain powe rs by Coordinator-General
14
The Coordinator-General may delegate all or any of his or her
15
powers under this Act (other than section 27) to a member of the
16
Coordinator-General's staff.
17
30 Regulations
18
The Governor-General may make regulations prescribing matters:
19
(a) required or permitted by this Act to be prescribed; or
20
(b) necessary or convenient to be prescribed for carrying out or
21
giving effect to this Act.
