The  Parliament of Australia  enacts:

1  Short  title 

5 

 

  This Act may be cited as the Commonwealth Grants Commission 

6 

Amendment (GST Distribution) Act 2015.

2  Commencement 

8 

 

(1)  Each provision  of this Act specified in column  1 of the table 

9 

commences, or is taken to have commenced, in accordance with 

10 

column  2 of the table. Any other statement in column 2 has effect 

11 

according to its terms.

1  After  section 16AA

Insert:

16AB  Inquiries  relating  to the distribution  of Goods and  Services 

6 

Tax revenue 

7 

 

  If: 

8 

 

(a)  the Commission  conducts an inquiry  under section 16, 16A 

9 

or 16AA in  relation to the distribution  of the Goods and 

10 

Services Tax revenue among the States, the Northern 

11 

Territory and the Australian Capital Territory in relation to a 

12 

financial  year; and 

13 

 

(b)  in conducting  its inquiry,  the Commission  considers the 

14 

mining  revenue of a State or Territory; and 

15 

 

(c)  the Commission  reports to the Minister; 

16 

then, in conducting  the inquiry,  and making the report, the 

17 

Commission  must only  take account of the mining  revenue for the 

18 

most recent financial  year for which data is available at the time 

19 

the inquiry  is conducted.
