A Bill for an Act concerning Commonwealth owned land at
Point Nepean, Victoria
The Parliament of Australia enacts:
This Act may be cited as the Commonwealth Land at Point Nepean,
Victoria Act 2003.
This Act commences on the day on which it receives the Royal
Assent.
1 After section 123G
Insert:
123H Defence land at Point Nepean,
Victoria
(1) The defence land owned by the Commonwealth at Point Nepean, Victoria
must not be sold by the Commonwealth but, subject to subsection (2), must be
transferred to the Government of Victoria for the conservation of environmental,
heritage, recreational and aesthetic values.
(2) It is a condition of the transfer of the land to the Government of
Victoria that the Government of Victoria undertakes that
(a) the land will be preserved in public ownership and made available for
preservation of environmental values, public appreciation and enjoyment, and
(b) plans of management will be prepared and public consultation
undertaken within two years of transfer to identify, conserve and manage
environmental, heritage, recreational and aesthetic values.
(3) The regulations may identify and describe the area of land referred to
in subsection (1).
