The Parliament of Australia enacts:

1 Short title
8
This Act may be cited as the Commonwealth Radioactive Waste
9
Management Act 2005.

2 Commencement
1
This Act commences on the day after it receives the Royal Assent.

3 Definitions
3
In this Act:
4
Commonwealth contractor means:
5
(a) a person who is a party to a contract with the Commonwealth
6
or a Commonwealth entity; or
7
(b) a person who is a subcontractor for a contract with the
8
Commonwealth or a Commonwealth entity.
9
Commonwealth entity means:
10
(a) a body corporate established for a public purpose by or under
11
an Act; or
12
(b) a company in which a controlling interest is held by any one
13
of the following persons, or any 2 or more of the following
14
persons together:
15
(i)
the
Commonwealth;
16
(ii) a body covered by paragraph (a).
17
controlled material has the meaning given by section 13 of the
18
Australian Radiation Protection and Nuclear Safety Act 1998.
19
facility means a facility for the management of controlled material
20
generated, possessed or controlled by the Commonwealth or a
21
Commonwealth entity.
22
site means a site described in Schedule 1.
23
subcontractor, for a contract, means a person who is a party to:
24
(a) a contract with a Commonwealth contractor (within the
25
meaning of paragraph (a) of the definition of Commonwealth
26
contractor); or
27
(b) a contract with another subcontractor (under a previous
28
application of this definition).

4 Authority to conduct activities
4
(1) This section applies to:
5
(a) the Commonwealth; and
6
(b) a Commonwealth entity; and
7
(c) a Commonwealth contractor; and
8
(d) an employee or agent of a person mentioned in paragraph (a),
9
(b) or (c).

(2) A person to whom this section applies may, in the Northern
11
Territory, do anything necessary for or incidental to the purposes
12
of selecting a site on which to construct and operate a facility.
13
(3) Without limiting subsection (2), the person may do any or all of the
14
following under that subsection (whether or not on a site):
15
(a) gain access to and enter land and drive vehicles or fly aircraft
16
to and from it;
17
(b) in order to drive vehicles to and from land--use existing
18
roads or construct roads on, or grade, land;
19
(c) construct or rehabilitate bores;
20
(d) operate drilling equipment;
21
(e)
extract
water;
22
(f) collect samples of flora and fauna;
23
(g) place monitoring equipment (including meteorological and
24
hydrological measuring equipment);
25
(h) build structures to protect bores, monitoring equipment or
26
other things;
27
(i) move or extract sand, gravel, soil, mineral and rock samples;
28
(j) conduct seismic or geological investigations;
29
(k) conduct archaeological or heritage investigations;

(l)
clear
vegetation.

(4) A person doing a thing under this Part on land that is not a site
32
must:

(a) take all reasonable steps to ensure that the doing of the thing

causes as little detriment and inconvenience, and does as
2
little damage, as is practicable to the land and to anything on,
3
or growing or living on, the land; and
4
(b) remain on the land only for such period as is reasonably
5
necessary; and
6
(c) leave the land, as nearly as practicable, in the condition in
7
which it was immediately before the thing was done.

5 Application of State and Territory laws
9
(1) A law, or a provision of a law, of a State or Territory (whether
10
written or unwritten), so far as it relates to:
11
(a) the use or proposed use of land or premises; or
12
(b) the environmental consequences of the use of land or
13
premises; or
14
(c) the archaeological or heritage values of land, premises or
15
objects (including the significance of land, premises or
16
objects in the traditions of Indigenous people); or
17
(d) controlled material, radioactive material or dangerous goods;
18
or
19
(e) licensing (however described) in relation to:
20
(i)
employment;
or
21
(ii) carrying on a particular kind of business or undertaking;
22
or
23
(iii) conducting a particular kind of operation or activity;
24
has no effect to the extent that it would, apart from this section,
25
regulate, hinder or prevent the doing of a thing authorised by
26
section 4.

(2) The regulations may prescribe a law, or a provision of a law, of a
28
State or Territory for the purposes of this subsection. The
29
prescribed law or provision has no effect to the extent that it
30
would, apart from this subsection, regulate, hinder or prevent the
31
doing of a thing authorised by section 4.

(3) Regulations made for the purposes of subsection (2) may prescribe
33
a law, or a provision of a law, whether or not it is a law or a
34
provision of a kind described in subsection (1).

(4) The regulations may prescribe a law, or a provision of a law, of a

State or Territory for the purposes of this subsection. The
2
prescribed law or provision has effect despite anything else in this
3
section.

6 Application of Commonwealth laws
5
(1) The following laws have no effect to the extent that they would,
6
apart from this section, regulate, hinder or prevent the doing of a
7
thing authorised by section 4:
8
(a)
the
Aboriginal and Torres Strait Islander Heritage
9
Protection Act 1984;
10
(b)
the
Environment Protection and Biodiversity Conservation
11
Act 1999.

(2) The regulations may prescribe another law, or a provision of
13
another law, of the Commonwealth for the purposes of this
14
subsection. The prescribed law or provision has no effect to the
15
extent that it would, apart from this subsection, regulate, hinder or
16
prevent the doing of a thing authorised by section 4.

7 Minister's declarations
5
(1) The Minister may, in his or her absolute discretion, declare in
6
writing that one, or a specified part of one, of the sites is selected
7
as the site for a facility.
8
(2) The Minister may, in his or her absolute discretion, declare in
9
writing that all or specified rights or interests in land in the
10
Northern Territory specified in the declaration are required for
11
providing all-weather road access to the selected site (or selected
12
part of a site).
13
(3) A declaration has effect at the time specified in the declaration
14
(which must not be earlier than the time the declaration is made).
15
(4) A copy of a declaration must be published in the Gazette within 7
16
days of the declaration being made.
17
(5) Failure to comply with subsection (4) does not invalidate a
18
declaration.
19
(6) The Minister must not:
20
(a) make more than one declaration under subsection (1); or
21
(b) make more than one declaration under subsection (2).
22
(7) A declaration is not a legislative instrument.

8 Procedural fairness in relation to Minister's declarations
24
No person is entitled to procedural fairness in relation to the
25
Minister's making of a declaration.

9 Acquisition or extinguishment

(1) At the time the declaration under subsection 7(1) has effect, any
2
rights or interests in the selected site (or selected part of a site) that
3
have not already been acquired by the Commonwealth, or
4
extinguished, are by force of this section:
5
(a) acquired by the Commonwealth or extinguished; and
6
(b) freed and discharged from all other rights and interests and
7
from all trusts, restrictions, dedications, reservations,
8
obligations, mortgages, encumbrances, contracts, licences,
9
charges and rates.

(2) To avoid doubt, the rights and interests acquired under or
11
extinguished by subsection (1) include:
12
(a) rights to minerals (if any); and
13
(b) native title rights and interests (if any).
14
(3) At the time the declaration under subsection 7(2) has effect, the
15
rights or interests in the specified land that are specified in the
16
declaration are, by force of this section:
17
(a) acquired by the Commonwealth or extinguished; and
18
(b) freed and discharged from all other rights and interests and
19
from all trusts, restrictions, dedications, reservations,
20
obligations, mortgages, encumbrances, contracts, licences,
21
charges and rates.

(4) To avoid doubt, rights and interests specified in the declaration
23
under subsection 7(2) may include any of the following:
24
(a) rights to minerals;
25
(b) native title rights and interests;
26
(c) an interest that did not previously exist in relation to the land;
27
(d) an easement in gross.

(1) Section 9 has effect despite any other law of the Commonwealth or
30
the Northern Territory (whether written or unwritten).

(2) Without limiting subsection (1), section 9 has effect despite the
32
following laws of the Commonwealth:

(a)
the
Lands Acquisition Act 1989;

(b)
the
Native Title Act 1993.

11 Notice to Registrar-General
3
(1) The Secretary of the Department may lodge with the
4
Registrar-General for the Northern Territory (or other appropriate
5
officer) a copy of a Minister's declaration under section 7, certified
6
by writing signed by the Secretary.
7
(2) The officer with whom the copy is lodged may deal with and give
8
effect to it as if it were a grant, conveyance, memorandum or
9
instrument of transfer of relevant rights and interests done under
10
the laws of the Northern Territory.

12 Authority to conduct activities
5
(1) This section applies to:
6
(a) the Commonwealth; and
7
(b) a Commonwealth entity; and
8
(c) a Commonwealth contractor; and
9
(d) an employee or agent of a person mentioned in paragraph (a),
10
(b) or (c).

(2) A person to whom this section applies may, in relation to the
12
selected site (or selected part of a site), do anything necessary for
13
or incidental to any or all of the following:
14
(a) gathering or preparing information for a Commonwealth
15
regulatory scheme that relates to:
16
(i) the construction or operation of a facility; or
17
(ii) anything done in preparation for the construction or
18
operation of a facility;
19
(b) conducting activities that relate to gathering or preparing
20
information for such a regulatory scheme;
21
(c) preparing the selected site (or selected part of a site) for a
22
facility;
23
(d) preparing to construct and operate a facility;
24
(e)
constructing
a
facility;
25
(f) constructing roads on, or grading, land in the Northern
26
Territory;
27
(g) erecting fences and other access controls on land specified in
28
the declaration under subsection 7(2);
29
(h) operating a facility;
30
(i) maintaining a facility;
31
(j) keeping a facility safe;
32
(k) decommissioning a facility.

(3) Without limiting subsection (2), the person may, under that

subsection, do a thing mentioned in subsection 4(3) in relation to
2
the selected site (or selected part of a site).

(4) Subsection (2) extends to doing things outside the selected site (or
4
selected part of a site).

(5) A person to whom this section applies may, in relation to the
6
selected site (or selected part of a site):
7
(a) transport (including through a State or Territory) people and
8
materials (including controlled material) to or from a facility;
9
and
10
(b) use transport infrastructure for that transport.

13 Application of State and Territory laws
12
(1) A law, or a provision of a law, of a State or Territory (whether
13
written or unwritten), so far as it relates to:
14
(a) the use or proposed use of land or premises; or
15
(b) the environmental consequences of the use of land or
16
premises; or
17
(c) the archaeological or heritage values of land, premises or
18
objects (including the significance of land, premises or
19
objects in the traditions of Indigenous people); or
20
(d) controlled material, radioactive material or dangerous goods;
21
or
22
(e) licensing (however described) in relation to:
23
(i)
employment;
or
24
(ii) carrying on a particular kind of business or undertaking;
25
or
26
(iii) conducting a particular kind of operation or activity;

has no effect to the extent that it would, apart from this section,
28
regulate, hinder or prevent the doing of a thing authorised by
29
section 12.

(2) A law, or a provision of a law, of a State or Territory (whether
31
written or unwritten), so far as it relates to the transport of
32
controlled material, radioactive material or dangerous goods, has

no effect to the extent that it would, apart from this section,

regulate, hinder or prevent transport authorised by section 12.

(3) The regulations may prescribe a law, or a provision of a law, of a
3
State or Territory for the purposes of this subsection. The
4
prescribed law or provision has no effect to the extent that it
5
would, apart from this subsection, regulate, hinder or prevent the
6
doing of a thing authorised by section 12.

(4) Regulations made for the purposes of subsection (3) may prescribe
8
a law, or a provision of a law, whether or not it is a law or a
9
provision of a kind described in subsection (1) or (2).

(5) The regulations may prescribe a law, or a provision of a law, of a
11
State or Territory for the purposes of this subsection. The
12
prescribed law or provision has effect despite anything else in this
13
section.

14 Application of Commonwealth laws
15
(1) The regulations may prescribe a law, or a provision of a law, of the
16
Commonwealth for the purposes of this subsection. The prescribed
17
law or provision has no effect to the extent that it would, apart
18
from this subsection, regulate, hinder or prevent the doing of a
19
thing authorised by section 12.
20
(2) The regulations must not prescribe any of the following laws, or
21
any provision of the following laws:
22
(a)
the
Australian Radiation Protection and Nuclear Safety Act
23
1998;
24
(b)
the
Environment Protection and Biodiversity Conservation
25
Act 1999;
26
(c)
the
Nuclear Non-Proliferation (Safeguards) Act 1987.

15 Compensation
4
(1) If rights or interests are acquired, extinguished or otherwise
5
affected under section 9, the Commonwealth is liable to pay a
6
reasonable amount of compensation to a person whose right or
7
interest has been acquired, extinguished or otherwise affected.
8
(2) If the Commonwealth and the person do not agree on the amount
9
of the compensation, the person may institute proceedings in the
10
Federal Court of Australia for the recovery from the
11
Commonwealth of such reasonable amount of compensation as the
12
court determines.
13
16 Compensation for acquisition of property
14
(1) If the operation of this Act would result in an acquisition of
15
property from a person otherwise than on just terms, the
16
Commonwealth is liable to pay a reasonable amount of
17
compensation to the person.
18
(2) If the Commonwealth and the person do not agree on the amount
19
of the compensation, the person may institute proceedings in the
20
Federal Court of Australia for the recovery from the
21
Commonwealth of such reasonable amount of compensation as the
22
court determines.
23
(3) In this section:
24
acquisition of property has the same meaning as in paragraph
25
51(xxxi) of the Constitution.
26
just terms has the same meaning as in paragraph 51(xxxi) of the
27
Constitution.

17 Regulations
29
The Governor-General may make regulations prescribing matters:
30

(a) required or permitted by this Act to be prescribed; or
1
(b) necessary or convenient to be prescribed for carrying out or
2
giving effect to this Act.
