The Parliament of Australia enacts:

1 Short title

This Act is the
Defence Trade Controls Amendment Act 2023
.

2 Commencement
6
(1) Each provision of this Act specified in column 1 of the table
7
commences, or is taken to have commenced, in accordance with
8
column 2 of the table. Any other statement in column 2 has effect
9
according to its terms.

DSGL goods
means goods within the scope of the Defence and
11
Strategic Goods List.

DSGL services
means the giving of assistance (including training)
13
in relation to the design, development, engineering, manufacture,
14
production, assembly, testing, repair, maintenance, modification,
15
operation, demilitarisation, destruction, processing or use of DSGL
16
goods that are, or DSGL technology that is, within the scope of
17
Part 1 of the Defence and Strategic Goods List.

5B Constitutional supplies and constitutional DSGL services
1
Constitutional supplies
2
(1) A supply of DSGL goods or DSGL technology is a
constitutional
3
supply
if:
4
(a) the supply is made by, or on behalf of, or to:
5
(i) a constitutional corporation; or
6
(ii) a body corporate that is incorporated in a Territory; or
7
(iii) a body corporate that is taken to be registered in a
8
Territory under section 119A of the
Corporations Act
9
2001
; or
10
(b) the supply is made by, or on behalf of, or to:
11
(i) the government of a foreign country or of part of a
12
foreign country; or
13
(ii) an authority of the government of a foreign country; or
14
(iii) an authority of the government of part of a foreign
15
country; or
16
(c) the supply is made by or to an alien (within the meaning of
17
paragraph 51(xix) of the Constitution); or
18
(d) the supply occurs wholly or partly outside Australia; or
19
(e) the supply is made in the course of constitutional trade or
20
commerce; or
21
(f) the supply occurs wholly or partly within a Territory; or
22
(g) the supply is made by way of a postal, telegraphic, telephonic
23
or other like service (within the meaning of paragraph 51(v)
24
of the Constitution).

Constitutional DSGL services
26
(2) DSGL services are
constitutional DSGL services
if:
27
(a) the DSGL services are provided by, or on behalf of, or to:
28
(i) a constitutional corporation; or
29
(ii) a body corporate that is incorporated in a Territory; or
30
(iii) a body corporate that is taken to be registered in a
31
Territory under section 119A of the
Corporations Act
32
2001
; or
33
(b) the DSGL services are provided by, or on behalf of, or to:

(i) the government of a foreign country or of part of a

foreign country; or
2
(ii) an authority of the government of a foreign country; or

meaning of paragraph 51(xix) of the Constitution); or
7
(d) the DSGL services are provided wholly or partly outside
8
Australia; or
9
(e) the DSGL services are provided in the course of
10
constitutional trade or commerce; or
11
(f) the DSGL services are provided wholly or partly within a
12
Territory; or
13
(g) the DSGL services are provided by way of a postal,
14
telegraphic, telephonic or other like service (within the
15
meaning of paragraph 51(v) of the Constitution).

Definitions

(3) In this section:
18
constitutional corporation
means a corporation to which
19
paragraph 51(xx) of the Constitution applies.
20
constitutional trade or commerce
means trade or commerce:
21
(a) between Australia and places outside Australia; or
22
(b) among the States; or
23
(c) within a Territory, between a State and a Territory or
24
between 2 Territories.

5C Relevant supplies and relevant DSGL services
26
Relevant supplies
27
(1) A supply of DSGL goods or DSGL technology is a
relevant supply
28
unless:
29
(a) the supply is to any of the following:
30
(i) an Australian person;
31
(ii) a citizen or permanent resident of the United Kingdom
32
or United States of America;

(iii) a body corporate incorporated by or under a law of the
1
United Kingdom or United States of America, or of part
2
of either of those countries;
3
(iv) the Government of the United Kingdom or United
4
States of America, or the government of part of either of
5
those countries;
6
(v) an authority of the Government of the United Kingdom
7
or United States of America, or the government of part
8
of either of those countries; and
9
(b) either:
10
(i) the supply is to, or occurs wholly at, a place in
11
Australia, the United Kingdom or the United States of
12
America; or
13
(ii) if the supply is the provision of access to DSGL
14
technology
--
at the time of the provision of access, the
15
person to whom the access is provided is in Australia,
16
the United Kingdom or the United States of America;
17
and
18
(c) the DSGL goods or DSGL technology is not excluded by a
19
determination in force under subsection (3); and
20
(d) any other requirements prescribed by the regulations for the
21
purposes of this paragraph are satisfied.

Relevant DSGL services
23
(2) DSGL services are
relevant DSGL services
unless:
24
(a) the DSGL services are provided to any of the following:
25
(i) an Australian person;
26
(ii) a citizen or permanent resident of the United Kingdom
27
or United States of America;
28
(iii) a body corporate incorporated by or under a law of the
29
United Kingdom or United States of America, or of part
30
of either of those countries;
31
(iv) the Government of the United Kingdom or United
32
States of America, or the government of part of either of
33
those countries;
34
(v) an authority of the Government of the United Kingdom
35
or United States of America, or the government of part
36
of either of those countries; and

(b) the DSGL services are received at a place in Australia, the
1
United Kingdom or the United States of America; and
2
(c) the DSGL goods or DSGL technology to which the DSGL
3
services relate is not excluded by a determination in force
4
under subsection (3); and
5
(d) any other requirements prescribed by the regulations for the
6
purposes of this paragraph are satisfied.

Excluded DSGL goods or DSGL technology
8
(3) The Minister may, by legislative instrument, determine that
9
specified DSGL goods or DSGL technology is excluded for the
10
purposes of paragraph (1)(c) or (2)(c).

Definitions

(4) In this section:

place
includes:
14
(a) a vehicle, vessel or aircraft; and
15
(b) an area of water; and
16
(c) a fixed or floating structure or installation of any kind.

) commits an offence if:

(a) the supplier supplies DSGL technology to another person;

and

(b) the other person is a foreign person; and

(c) the supply is a constitutional supply; and
33
(d) the supply is a relevant supply; and

(e) any of the following applies:

(i) the place from which the supply is made and the place

to which the supply is made are both in Australia;
2
(ii) the supply occurs wholly at a place in Australia;

the supplier and the other person are in Australia; and
6
(f) either:
7
(i) the supplier does not hold a permit under section 11
8
authorising the supply; or
9
(ii) the supply contravenes a condition of a permit that the

supplier holds under section 11; and

(g) there is no notice in force under subsection 14(1) in relation
12
to the supplier and the supply.

(c) the supply occurs in the course of the officer or employee
's

(a) the DSGL technology is supplied by or to a person who is a

10B Offence
--
certain supplies of DSGL goods or DSGL technology
13
from outside Australia
14
(1) A person (the
supplier
) commits an offence if:
15
(a) the supplier supplies (the
current supply
) DSGL goods or
16
DSGL technology to another person; and
17
(b) the current supply is a constitutional supply; and
18
(c) the current supply is a relevant supply; and
19
(d) any of the following applies:
20
(i) the current supply occurs wholly at a place outside
21
Australia;
22
(ii) the current supply is from a place outside Australia and
23
is to a place outside Australia or to a foreign person;
24
(iii) if the current supply is the provision of access to DSGL
25
technology
--
at the time of the provision of access, the
26
supplier is outside Australia and the other person is
27
outside Australia or is a foreign person; and
28
(e) the supplier obtained the DSGL goods or DSGL technology
29
as a direct or indirect result of the export or supply (the
30
earlier export or supply
) of the DSGL goods or DSGL
31
technology:
32
(i) from a place in Australia to a place outside Australia; or
33

(ii) if the earlier export or supply was the provision of
1
access to DSGL technology
--
in circumstances where,
2
at the time of the provision of access, the person
3
providing access was in Australia and the person to
4
whom access was provided was outside Australia; and
5
(f) either of the following (whether or not obtained) was
6
required in relation to the earlier export or supply:
7
(i) permission (however described) under regulations made
8
under the
Customs Act 1901
;
9
(ii) a permit given under section 11 of this Act; and
10
(g) either:
11
(i) the supplier does not hold a permit under section 11
12
authorising the current supply; or
13
(ii) the current supply contravenes a condition of a permit
14
that the supplier holds under section 11; and
15
(h) there is no notice in force under subsection 14(1) in relation
16
to the supplier and the current supply.
17
Penalty: Imprisonment for 10 years or 2,500 penalty units, or
18
both.

Application to supplies to employees etc.

(2) For the purposes of subsection (1), if the supplier is not an
21
individual and supplies DSGL goods or DSGL technology to an
22
officer or employee of the supplier, the supply is taken to be a
23
supply by the supplier to another person (that other person being
24
the officer or employee).

Absolute and strict liability
26
(3) Absolute liability applies to paragraph (1)(b).
27
(4) Strict liability applies to paragraph (1)(f).

Exceptions
29
(5) Subsection (1) does not apply if:
30
(a) the current supply is of:
31
(i) goods that are an Article 3(1) US Defence Article; or
32
(ii) goods that are an Article 3(3) US Defence Article; or

(iii) DSGL technology in relation to original goods; and
1
(b) the current supply is by an Australian Community member or
2
by a member of the United States Community; and
3
(c) the current supply is to an Australian Community member or

a member of the United States Community; and

(d) the current supply is for an activity referred to in Article
6
3(1)(a), (b), (c) or (d) of the Defense Trade Cooperation
7
Treaty; and
8
(e) at the time of the current supply, the following are listed in
9
Part 1 of the Defense Trade Cooperation Munitions List:
10
(i) if the supply is of original goods or DSGL technology in
11
relation to original goods
--
the original goods;
12
(ii) if the supply is of incorporated goods
--
any of the
13
original goods incorporated in the incorporated goods;
14
and
15
(f) at the time of the current supply, the following are not listed
16
in Part 2 of the Defense Trade Cooperation Munitions List:
17
(i) if the supply is of original goods or DSGL technology in
18
relation to original goods
--
the original goods;
19
(ii) if the supply is of incorporated goods
--
any of the
20
original goods incorporated in the incorporated goods.

(6) Subsection (1) does not apply if, in relation to the current supply:

(ii) a citizen or permanent resident of a foreign country that

(1) A person (the

) commits an offence if:

(a) the provider provides DSGL services to another person; and

(b) the other person is a foreign person; and

(c) the DSGL services are constitutional DSGL services; and

(d) the DSGL services are relevant DSGL services; and
8
(e) either:
9
(i) the provider is an Australian person; or
10
(ii) the DSGL services are provided at or from a place in
11
Australia; and
12
(f) either:

(i) the provider does not hold a permit under section 11
14
authorising the provision of the DSGL services; or
15
(ii) the provision of the DSGL services contravenes a
16
condition of a permit that the provider holds under
17
section 11; and

(g) there is no notice in force under subsection 14(1) in relation

to the provider and the provision of the DSGL services.
