The Parliament of Australia enacts:

1 Short title
7
This Act may be cited as the Environment and Heritage
8
Legislation Amendment Act 2005.

2 Commencement
10
(1) Each provision of this Act specified in column 1 of the table
11
commences, or is taken to have commenced, in accordance with
12
2 Environment and Heritage Legislation Amendment Bill 2005 No. , 2005
column 2 of the table. Any other statement in column 2 has effect

according to its terms.

1 Subsection 13(1)

Repeal the subsection, substitute:

(1) A person must not manufacture an HCFC or methyl bromide unless
9
the person holds a controlled substances licence that allows the
10
person to do so.
11
(1AA) A person must not import or export an HCFC (other than a recycled
12
or used HCFC) or methyl bromide (other than recycled or used
13
methyl bromide) unless the person holds a controlled substances
14
licence that allows the person to do so.
15
(1AB) A person must not import or export a recycled or used HCFC or
16
recycled or used methyl bromide unless the person holds a used
17
substances licence that allows the person to do so.

2 After subsection 46(1B)

Insert:

(1BA) A person who manufactures an SGG in a quarter commencing more
21
than 3 months after the commencement of this subsection must,
22
within 15 days after the end of the quarter, give the Minister a
23
report in accordance with the regulations.
