The Parliament of Australia enacts:

1 Short title
5
This Act may be cited as the Electoral and Referendum
6
Amendment (Close of Rolls and Other Measures) Act 2010.

2 Commencement
8
(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10
column 2 of the table. Any other statement in column 2 has effect
11
according to its terms.

(1) This Part deals with pre-poll votes.

(2) There are 2 different kinds of pre-poll vote:

(a)
a
pre-poll ordinary vote, which is a vote made in accordance
5
with Division 3; and
6
(b)
a
pre-poll declaration vote, which is a vote made in
7
accordance with Division 4.

(3) General matters relevant to both kinds of pre-poll vote are set out
9
in Division 2.

200DD Where is pre-poll ordinary voting available?
1
(1) Subject to subsections (2) and (3), for voters enrolled for a
2
particular Division, pre-poll ordinary voting is available at the
3
following places:
4
(a) any pre-poll voting office that is located within the Division;
5
(b) any other pre-poll voting office that is specified, as
6
mentioned in subsection 200BA(1A), as a place at which
7
pre-poll ordinary voting is available to voters enrolled for the
8
Division;
9
(c) the office of the DRO for the Division.
10
(2) The Electoral Commissioner may, in writing, determine that
11
pre-poll ordinary voting is not available at one or more specified
12
places, either generally or as specified in the determination.
13
(3) A determination made under subsection (2) is not a legislative
14
instrument.
15
(4) For voters enrolled for a particular Division, pre-poll ordinary
16
voting is not available at a particular place referred to in
17
subsection (1) unless a copy of the certified list of voters for the
18
Division has been delivered to the place (see subsection 208(4)).

200DE Separate voting compartments
20
Each place at which pre-poll ordinary voting is available must have
21
separate voting compartments, constructed so as to screen the
22
voters from observation while they are marking their ballot papers.
23
There must be a pencil in each compartment for use by voters.
24
200DF Ballot-boxes
25
(1) Each place at which pre-poll ordinary voting is available must be
26
provided with the necessary ballot-boxes.
27
(2) Each of those ballot-boxes must be capable of being securely
28
fastened.

Subdivision B--Voting by pre-poll ordinary vote
1
200DG When is a person entitled to vote by pre-poll ordinary vote?
2
(1) Subject to subsection (2), a person (the voter) is entitled to vote by
3
pre-poll ordinary vote if:
4
(a) the voter has, in accordance with Division 2, applied for a
5
pre-poll vote; and
6
(b) the voter's name is on a copy of the certified list of voters for
7
a particular Division (the voter's Division) that has been
8
delivered to the place (the voting place) at which the
9
application is made; and
10
(c) the voting place is a place at which pre-poll ordinary voting
11
is available to voters enrolled for the voter's Division.
12
Note:
If the voter is not entitled to vote by pre-poll ordinary vote, the voter
13
may instead be able to vote by pre-poll declaration vote under
14
Division 4.
15
(2) The voter is not entitled to vote by pre-poll ordinary vote if:
16
(a) the voter does not comply with the requirements of
17
section 200DH relating to the pre-poll certificate for ordinary
18
voting; or
19
(b)
the
voter:
20
(i) refuses to answer fully any question he or she is asked
21
under section 200DI; or
22
(ii) answers a question specified in paragraph 200DI(1)(c)
23
in the affirmative; or
24
(c) the issuing officer has asked the voter one or more questions
25
under subsection 200DI(2) about matters shown, for a
26
particular person, on a copy of the certified list of voters for
27
the voter's Division to establish whether the voter is that
28
particular person, and one of the following applies:
29
(i) the voter's answers do not accord with the relevant
30
information shown for that particular person on the list;
31
(ii) the voter's answers accord with the relevant information
32
shown for that particular person on the list but the
33
issuing officer is not satisfied that the person is that
34
particular person; or

(d) the voter's name is on a copy of the certified list of voters for
1
the voter's Division but his or her address does not appear on
2
the list; or
3
(e) a mark on a copy of the certified list of voters for the voter's
4
Division indicates that the voter has already voted; or
5
(f) the voter is provisionally enrolled.

200DH Voter to complete and sign pre-poll vote certificate for
7
ordinary voting
8
(1) If, under subsection 200DG(1) (but disregarding subsection
9
200DG(2)), the voter is entitled to vote by pre-poll ordinary vote, a
10
voting officer must give the voter a pre-poll vote certificate for
11
ordinary voting.
12
(2) The voter must complete and sign the certificate and give it to a
13
voting officer (the issuing officer).
14
(3) A pre-poll vote certificate for ordinary voting must be in the
15
approved form.

200DI Questions to be put to voter
17
(1) The issuing officer must ask the voter the following questions:
18
(a) What is your full name?
19
(b) Where do you live?
20
(c) Have you voted before in this election? or Have you voted
21
before in these elections? (as the case requires).
22
(2) If the answers the voter gives to the questions in paragraphs (1)(a)
23
and (b) do not satisfy the issuing officer that the applicant is a
24
particular person on a copy of the certified list of voters for a
25
particular Division, the officer may ask the voter one or more other
26
questions about matters shown on the list for the particular person,
27
to establish whether the voter is that particular person.

200DJ Right of voter to receive ballot paper
29
(1) If, under section 200DG, the voter is entitled to vote by pre-poll
30
ordinary vote, the issuing officer must give the voter a ballot paper,
31
duly initialled by the officer.

(2) The issuing officer, at the request of a scrutineer, must note any
1
objection by the scrutineer to the right of the voter to vote by
2
pre-poll ordinary vote, and must keep that record.
3
(3) The issuing officer must, immediately after giving the ballot paper
4
to the voter, place a mark against the voter's name on a copy of the
5
certified list of voters for the voter's Division.

200DK Voter to mark vote on ballot paper
7
Except as otherwise prescribed by the regulations, the voter, upon
8
receipt of a ballot paper under section 200DJ, must without delay:
9
(a) go to an unoccupied compartment of the voting place and
10
mark his or her ballot paper in private; and
11
(b) fold the ballot paper so as to conceal his or her vote and
12
deposit it in a ballot-box; and
13
(c) leave the voting place.

200DL Assistance to certain voters
15
(1) If the voter satisfies a voting officer that the voter cannot read or is
16
so disabled as to be unable to vote without assistance, a person
17
chosen by the voter may, according to the directions of the voter,
18
do any of the following acts:
19
(a) complete (but not sign) the pre-poll vote certificate for
20
ordinary voting;
21
(b) read the certificate to the voter;
22
(c) give the completed certificate to a voting officer;
23
(d) enter an unoccupied compartment of the voting place with
24
the voter and mark the voter's vote on the ballot paper;
25
(e) fold the ballot paper and deposit it in a ballot-box.
26
Note:
Subject to section 336, the pre-poll vote certificate for ordinary voting
27
must still be signed by the voter.
28
(2) Directions under subsection (1) may be given by reference to a
29
how-to-vote card.

(3) The other provisions of this Division have effect subject to this
31
section.

200DM Voter not entitled to vote again etc.

After the voter has, under sections 200DH and 200DJ, been given a
2
pre-poll vote certificate for ordinary voting and a ballot paper:
3
(a) the voter is not entitled to remove the certificate or the ballot
4
paper from the voting place; and
5
(b) the voter is not entitled to vote again in the same election.

Subdivision C--Requirements relating to ballot-boxes
7
200DN Subdivision sets out requirements to be complied with
8
This Subdivision sets out requirements to be complied with in
9
relation to each ballot-box (a pre-poll ordinary ballot-box) that is
10
used for pre-poll ordinary voting at a particular place.
11
200DO Requirements to be complied with before first use of
12
ballot-box
13
Before a ballot-box is first used for pre-poll ordinary voting at the
14
place, a voting officer, in the presence of any scrutineers, must
15
exhibit the ballot-box empty at the place, and then securely fasten
16
its cover.
17
200DP Requirements to be complied with at end of each day of use
18
of ballot-box
19
(1) At the end of each day when pre-poll ordinary voting is available at
20
the place, and in the presence of any scrutineers, each pre-poll
21
ordinary ballot-box used on that day must be closed, fastened and
22
sealed by a voting officer.
23
(2) After a pre-poll ordinary ballot-box has been sealed, it must on no
24
account be opened except as allowed by this Act.
25
200DQ Requirements to be complied with before ballot-box used
26
again on later day
27
If:
28
(a) a pre-poll ordinary ballot-box has been sealed after use at the
29
place on a day; and

(b) the ballot-box is to be used again on a later day for pre-poll

ordinary voting at the place;

before the ballot-box is so used again, a voting officer, in the
3
presence of any scrutineers, must examine the ballot-box, and
4
make it ready to receive ballot papers.

200DR Forwarding of ballot-boxes for purposes of scrutiny
6
(1) Subject to any directions under subsection (2), at the close of the
7
poll, a voting officer must, with the least possible delay, forward
8
each sealed pre-poll ordinary ballot-box for the purposes of
9
scrutiny.
10
(2) The DRO for the Division in which the place is located may direct
11
that one or more sealed pre-poll ordinary ballot-boxes at the place
12
are to be forwarded, for the purposes of scrutiny, before the close
13
of the poll.
14
(3) If a direction made under subsection (2) is in writing, the direction
15
is not a legislative instrument.
16
Division 4--Voting by pre-poll declaration vote
17
200DS Persons to whom this Division applies
18
This Division applies to a person who has, in accordance with
19
Division 2, applied for a pre-poll vote but who is not, under
20
Division 3, entitled to vote by pre-poll ordinary vote.

73CE Separate voting compartments
7
Each place at which pre-poll ordinary voting is available must have
8
separate voting compartments, constructed so as to screen the
9
voters from observation while they are marking their ballot-papers.
10
There must be a pencil in each compartment for use by voters.
11
73CF Ballot-boxes
12
(1) Each place at which pre-poll ordinary voting is available must be
13
provided with the necessary ballot-boxes.
14
(2) Each of those ballot-boxes must be capable of being securely
15
fastened.

Subdivision B--Voting by pre-poll ordinary vote
17
73CG When is a person entitled to vote by pre-poll ordinary vote?
18
(1) Subject to subsection (2), a person (the voter) is entitled to vote by
19
pre-poll ordinary vote if:
20
(a) the voter has, in accordance with Division 2, applied for a
21
pre-poll vote; and
22
(b) the voter's name is on a copy of the certified list of voters for
23
a particular Division (the voter's Division) that has been
24
delivered to the place (the voting place) at which the
25
application is made; and
26
(c) the voting place is a place at which pre-poll ordinary voting
27
is available to voters enrolled for the voter's Division.

If the voter is not entitled to vote by pre-poll ordinary vote, the voter
29
may instead be able to vote by pre-poll declaration vote under
30
Division 4.

(2) The voter is not entitled to vote by pre-poll ordinary vote if:

(ii) answers a question specified in paragraph 73CI(1)(c) or
7
subsection 73CI(4) in the affirmative; or

(c) the issuing officer has asked the voter one or more questions
9
under subsection 73CI(2) about matters shown, for a
10
particular person, on a copy of the certified list of voters for
11
the voter's Division to establish whether the voter is that
12
particular person, and one of the following applies:
13
(i) the voter's answers do not accord with the relevant
14
information shown for that particular person on the list;
15
(ii) the voter's answers accord with the relevant information
16
shown for that particular person on the list but the
17
issuing officer is not satisfied that the person is that
18
particular person; or
19
(d) the voter's name is on a copy of the certified list of voters for
20
the voter's Division but his or her address does not appear on
21
the list; or
22
(e) a mark on a copy of the certified list of voters for the voter's
23
Division indicates that the voter has already voted; or
24
(f) the voter is provisionally enrolled.

73CH Voter to complete and sign pre-poll vote certificate for
26
ordinary voting
27
(1) If, under subsection 73CG(1) (but disregarding subsection
28
73CG(2)), the voter is entitled to vote by pre-poll ordinary vote, a
29
voting officer must give the voter a pre-poll vote certificate for
30
ordinary voting.
31
(2) The voter must complete and sign the certificate and give it to a
32
voting officer (the issuing officer).
33
(3) A pre-poll vote certificate for ordinary voting must be in the
34
approved form.

73CI Questions to be put to voter
1
(1) The issuing officer must ask the voter the following questions:

(a) What is your full name?
3
(b) Where do you live?
4
(c) Have you voted before in this referendum? or Have you
5
voted before in these referendums? (as the case requires).

(2) If the answers the voter gives to the questions in paragraphs (1)(a)
7
and (b) do not satisfy the issuing officer that the applicant is a
8
particular person on a copy of the certified list of voters for a
9
particular Division, the officer may ask the voter one or more other
10
questions about matters shown on the list for the particular person,
11
to establish whether the voter is that particular person.
12
If election is held on same day
13
(3) If the voting day for a referendum is the same as that fixed for the
14
polling at an election, the answers by the voter under section 200DI
15
of the Commonwealth Electoral Act 1918 for the purposes of the
16
election may, if they are satisfactory as regards the election, be
17
accepted as sufficient to enable the person to vote at the
18
referendum.
19
(4) If the issuing officer accepts, pursuant to subsection (3), the
20
answers by the voter to the questions referred to in that subsection
21
as sufficient to enable the person to vote at a referendum, the
22
officer may, if he or she thinks fit, put to the voter the following
23
question, namely, Have you already voted, either here or
24
elsewhere, at this referendum (or these referendums, as the case
25
requires)?

73CJ Right of voter to receive ballot-paper
27
(1) If, under section 73CG, the voter is entitled to vote by pre-poll
28
ordinary vote, the issuing officer must give the voter a ballot-paper,
29
duly initialled by the officer.
30
(2) The issuing officer, at the request of a scrutineer, must note any
31
objection by the scrutineer to the right of the voter to vote by
32
pre-poll ordinary vote, and must keep that record.

(3) The issuing officer must, immediately after giving the ballot-paper

73CK Voter to mark vote on ballot-paper
4
Except as otherwise prescribed by the regulations, the voter, upon
5
receipt of a ballot-paper under section 73CJ, must without delay:
6
(a) go to an unoccupied compartment of the voting place and
7
mark his or her ballot-paper in private; and
8
(b) fold the ballot-paper so as to conceal his or her vote and
9
deposit it in a ballot-box; and
10
(c) leave the voting place.

73CL Assistance to certain voters
12
(1) If the voter satisfies a voting officer that the voter cannot read or is
13
so disabled as to be unable to vote without assistance, a person
14
chosen by the voter may, according to the directions of the voter,
15
do any of the following acts:
16
(a) complete (but not sign) the pre-poll vote certificate for
17
ordinary voting;
18
(b) read the certificate to the voter;
19
(c) give the completed certificate to a voting officer;
20
(d) enter an unoccupied compartment of the voting place with
21
the voter and mark the voter's vote on the ballot-paper;
22
(e) fold the ballot-paper and deposit it in a ballot-box.

Note:
Subject to section 127, the pre-poll vote certificate for ordinary voting
24
must still be signed by the voter.
25
(2) Directions under subsection (1) may be given by reference to a
26
how-to-vote card.

(3) The other provisions of this Division have effect subject to this

he or she is enrolled;

the requirement that the claim or application be signed is (despite
23
section 336) taken to be satisfied if the person instead satisfies the
24
requirements prescribed by the regulations for the purpose of this
25
subsection.

(8) Subsection (7) does not apply to:
27
(a) an enrolment-related claim or notice that is required or
28
permitted to be sent to the Electoral Commissioner by a
29
provision of Part IX or X; or
30
(b) any of the following requirements for a signature:
31
(i) the requirement in subsection 98(3);
32
(ii) the requirement in subsection 99A(5);
33
(iii) the requirement in subsection 99B(3);
34
(iv) the requirement that a statutory declaration referred to in
35
subsection 104(3) be signed;
