The Parliament of Australia enacts:
4
1 Short title
5
This Act may be cited as the Environment Protection and
6
Biodiversity Conservation Amendment (Declared Fishing
7
Activities) Act 2012.

2 Commencement
9
This Act commences on the day this Act receives the Royal
10
Assent.

390SA Civil penalty--declared fishing activities

A person must not engage in a declared fishing activity in a
11
Commonwealth marine area.
12
Civil penalty:
13
(a) for an individual--5,000 penalty units;
14
(b) for a body corporate--50,000 penalty units.
15
Note:
If a body corporate is found to have contravened this section, an
16
executive officer of the body may be found to have contravened
17
section 494.

390SB Offence--declared fishing activities
19
(1) A person commits an offence if:
20
(a) the person takes an action; and
21
(b) the action is taken in a Commonwealth marine area; and
22
(c) the action is a declared fishing activity.
23
Penalty: Imprisonment for 7 years or 420 penalty units, or both.

Note 1:
If a body corporate is found to have committed an offence against this
25
section, an executive officer of the body may be found to have
26
committed an offence against section 495.
27
Note 2:
Subsection 4B(3) of the Crimes Act 1914 lets a court fine a body
28
corporate up to 5 times the maximum amount the court could fine a
29
person under this subsection.

Division 2--Declaring a fishing activity

Subdivision A--What is a declared fishing activity?

390SC What is a declared fishing activity?

(1)
A
declared fishing activity is a fishing activity that is specified in:
6
(a) an interim declaration that is in force under section 390SD;
7
or
8
(b) a final declaration that is in force under section 390SF.
9
(2)
A
fishing activity means an activity that constitutes fishing.

Subdivision B--Interim declaration

390SD Interim declaration
12
Making an interim declaration
13
(1) The Minister may, by legislative instrument, make a declaration
14
(an interim declaration) that a specified fishing activity is a
15
declared fishing activity.

Note 1:
For variation of an interim declaration, see subsection 33(3) of the
17
Acts Interpretation Act 1901.

Note 2:
For revocation of an interim declaration, see section 390SG.

(2) When making an interim declaration, the Minister may identify a
20
fishing activity by reference to all or any of the following:
21
(a) a method of fishing;
22
(b) a type of vessel used for fishing;
23
(c) a method of processing, carrying or transhipping of fish that
24
have been taken;
25
(d) an area of waters or of seabed.

Note:
Subsection (2) does not, by implication, limit subsection 33(3A) of the
27
Acts Interpretation Act 1901.

(3) The Minister must not make an interim declaration unless the
29
Minister and the Fisheries Minister agree that:

(a) there is uncertainty about the environmental, social or

economic impacts of the fishing activity; and
2
(b) it is appropriate that the fishing activity be prohibited in a
3
Commonwealth marine area while consultation occurs under
4
section 390SE about whether to make a final declaration in
5
relation to the fishing activity under section 390SF.

When an interim declaration is in force
7
(4) An interim declaration:
8
(a) comes into force at the end of the day on which it is
9
registered in the Federal Register of Legislative Instruments;
10
and
11
(b) remains in force until the earlier of the following times:
12
(i) the end of the period specified in the declaration as the
13
period for which the declaration is in force;
14
(ii) if the declaration is revoked--when the revocation
15
comes into force.

Specified period for which interim declaration is in force
17
(5) The Minister must specify in an interim declaration the period for
18
which it is to be in force. The period must not be longer than 60
19
days.

390SE Consultation
21
(1) As soon as is practicable after making an interim declaration under
22
section 390SD declaring that a specified fishing activity is a
23
declared fishing activity, the Minister must publish a notice on the
24
Department's website in accordance with subsection (2).
25
(2) The notice must:
26
(a) invite each declaration affected person (see subsection (3)) to
27
make a written submission about the impact on the person's
28
rights or interests in relation to fishing if a final declaration
29
under section 390SF were made in relation to the fishing
30
activity; and
31
(b) specify that written submissions must be lodged during the
32
period specified in the notice; and

(c) specify the manner in which written submissions are to be

lodged.

(3)
A
declaration affected person, in relation to a fishing activity,
3
means a person who:
4
(a) holds a fishing concession or is prescribed by the regulations;
5
and
6
(b) considers that the person would be detrimentally affected by
7
the making of a final declaration under section 390SF in
8
relation to the fishing activity.
9
(4) For the purposes of paragraph (1)(b), the period specified in the
10
notice must be at least 11 business days after the day the notice is
11
published.

390SF Final declaration

Making a final declaration
15
(1) The Minister may, by legislative instrument, make a declaration (a
16
final declaration) that a specified fishing activity is a declared
17
fishing activity.

Note 1:

(2) The Minister must not make a final declaration unless:
22
(a) the fishing activity is the same as a fishing activity that is, or
23
was, specified in an interim declaration under section 390SD;
24
and
25
(b) consultation under section 390SE has occurred in relation to
26
the fishing activity; and
27
(c) the Minister has considered any written submission that:
28
(i) was made under section 390SE by a declaration affected
29
person; and
30
(ii) was lodged during the period referred to in paragraph
31
390SE(1)(b); and

(d) the Minister and the Fisheries Minister agree that there is

uncertainty about the environmental, social or economic
2
impacts of the fishing activity; and
3
(e) the Minister and the Fisheries Minister agree that it is
4
appropriate that:
5
(i) an expert panel be established under section 390SH to
6
conduct an assessment of the fishing activity and report
7
on the matter; and
8
(ii) the fishing activity be prohibited in a Commonwealth
9
marine area while the expert panel conducts the
10
assessment.

When a final declaration is in force
12
(3) A final declaration:
13
(a) comes into force at the end of the day on which it is
14
registered in the Federal Register of Legislative Instruments;
15
and
16
(b) remains in force until the earliest of the following times:
17
(i) the end of the day on which the report of the expert
18
panel is published on the Department's website under
19
paragraph 390SL(a);
20
(ii) the end of the period specified in the declaration as the
21
period for which the declaration is in force;
22
(iii) if the declaration is revoked--when the revocation
23
comes into force.

Specified period for which final declaration is in force
25
(4) The Minister must specify in a final declaration the period for
26
which it is to be in force. The period must not be longer than 24
27
months.

Subdivision D--Revoking declarations

390SG Revoking an interim or final declaration
30
(1) The Minister may, by legislative instrument, revoke:
31
(a) an interim declaration under section 390SD; or
32
(b) a final declaration under section 390SF.

(2) A revocation under subsection (1) comes into force at the end of
1
the day on which it is registered in the Federal Register of
2
Legislative Instruments.

Division 3--Expert panel assessment of declared fishing
4
activity

390SH Establishment of expert panel
6
(1) As soon as is practicable after making a final declaration under
7
section 390SF declaring that a specified fishing activity is a
8
declared fishing activity, the Minister must:
9
(a) appoint, in writing, one or more persons (the members) as an
10
expert panel to conduct an assessment and report to the
11
Minister about the fishing activity; and
12
(b) with the agreement of the Fisheries Minister, specify in
13
writing (the terms of reference):
14
(i) the matters relating to the fishing activity that are to be
15
the subject of the assessment and report; and
16
(ii) the date by which the panel must report to the Minister.

Note:
The Minister may revoke an appointment: see subsection 33(3) of the
18
Acts Interpretation Act 1901.
19
(2) The Minister may specify in the terms of reference the manner in
20
which the expert panel is to carry out the assessment.
21
(3) The Minister may, in writing, vary or revoke the terms of reference
22
with the agreement of the Fisheries Minister.
23
(4) The Minister must:
24
(a) publish a copy of the terms of reference on the Department's
25
website as soon as is practicable after the Minister specifies
26
or varies them; and
27
(b) cause a copy of the terms of reference to be laid before each
28
House of the Parliament within 15 sitting days of that House
29
after the day the Minister specifies or varies them.

390SI Terms and conditions

The Minister must determine, in writing, the terms and conditions
2
applicable to members of the expert panel, including terms and
3
conditions relating to:
4
(a) term of office; and
5
(b)
remuneration;
and
6
(c)
allowances;
and
7
(d) disclosure of interests.

390SJ Procedure for assessment
9
(1) The expert panel must comply with the terms of reference in
10
conducting the assessment.
11
(2) Subject to subsection (1), the expert panel may determine the
12
procedure to be followed in its assessment.
13
390SK Timing of the report
14
The expert panel must give the Minister the report on the
15
assessment on the date specified by the Minister in the terms of
16
reference.

390SL Publication of the report
18
The Minister must:
19
(a) publish a copy of the report on the Department's website
20
within 20 business days after the day the Minister receives
21
the report; and
22
(b) cause a copy of the report to be laid before each House of the
23
Parliament within 15 sitting days of that House after the day
24
the Minister receives the report; and
25
(c) comply with any other publication requirements prescribed
26
by the regulations.
