and for related purposes

The Parliament of Australia enacts:
4
1 Short title
5
This Act may be cited as the Environment Protection and
6
Biodiversity Conservation Amendment (Alpine Grazing) Act 2014.

2 Commencement
8
This Act commences on the day after it receives the Royal Assent.

repealed as set out in the applicable items in the Schedule

concerned, and any other item in a Schedule to this Act has effect

according to its terms.

1 At the end of Division 1A of Part 7

Add:

74E Alpine grazing in Victoria
6
(1) The Minister:
7
(a) is taken to have received, from the Government of Victoria, a
8
referral of its proposal to allow grazing by cattle in the
9
Alpine National Park for the purposes of a trial as to whether
10
such grazing can assist fire prevention and control; and
11
(b) is taken to have decided under section 74B, on the
12
commencement of this section, that this Division should
13
apply to the referral.

(2) The Minister is taken to have made the decision for the following
15
reasons:
16
(a) the proposed grazing for the purposes of the trial would have
17
a significant impact on the following listed threatened species
18
and listed threatened ecological communities:
19
(i) Alpine Sphagnum Bogs and Associated Fens;
20
(ii) Spotted Tree Frog Litoria spenceri;
21
(iii) Dwarf Sedge Carex paupera;
22
(iv) Alpine Tree Frog Litoria verreauxii alpina;
23
(b) the proposed grazing for the purposes of the trial could have
24
a significant impact on the following listed threatened species
25
and listed threatened ecological communities that are known
26
to exist near the grazing sites:
27
(i) Spot-tailed Quoll Dasyurus maculatus maculatus;
28
(ii) Long-footed Potoroo Potorous longipes;
29
(iii) Smoky Mouse Pseudomys fumeus;
30
(iv) Clover Glycine Glycine latrobeana;
31
(c) grazing on the scale that would be necessary to achieve any
32
fire control objectives would have an impact on the species
33
and ecological communities mentioned in paragraphs (a) and
34

(b), together with many others, that would outweigh any

possible benefits.
