The Parliament of Australia enacts:
4
1 Short title
5
This Act may be cited as the Environment Protection and
6
Biodiversity Conservation Amendment (Moratorium on Aquifer
7
Drilling Connected with Coal Seam Gas Extraction) Act 2013.

2 Commencement
9
This Act commences on the day after this Act receives the Royal
10
Assent.

Each Act that is specified in a Schedule to this Act is amended or

repealed as set out in the applicable items in the Schedule

concerned, and any other item in a Schedule to this Act has effect
4
according to its terms.

1 At the end of Part 3

Add:

Division 3--2 year moratorium on aquifer drilling
7
28B 2 year moratorium on aquifer drilling
8
(1) A person commits an offence if:
9
(a) the person takes an action; and
10
(b) the person takes the action for the purposes of, or in
11
connection with, coal seam gas extraction; and
12
(c) the action is, or results in, drilling through or into an aquifer;
13
and
14
(d) the drilling occurs within 2 years after the commencement of
15
this section.

Penalty:
17
(a) for an individual--$200,000; and
18
(b) for a body corporate--$2,000,000.
19
(2) Subsection (1) applies only if:
20
(a) the person is a corporation to which paragraph 51(xx) of the
21
Constitution applies; or
22
(b) the action is taken for the purposes of trade or commerce:
23
(i) between Australia and another country; or
24
(ii) between 2 States; or
25
(iii) between a State and a Territory; or
26
(iv) between 2 Territories; or
27
(c) the action is taken in a Territory.

(3) Subsection (1) does not apply if the action is taken to facilitate
29
safer coal mining.

(4) This section has effect despite any other provision of this Act or of
