Protection and Biodiversity Conservation Act 1999 in

The Parliament of Australia enacts:

1 Short title
5
This Act may be cited as the Environment Protection and
6
Biodiversity Conservation (Abolition of Alpine Grazing) Act 2011.

2 Commencement
8
This Act commences on the day after it receives the Royal Assent.

Each Act that is specified in a Schedule to this Act is amended or

repealed as set out in the applicable items in the Schedule

concerned, and any other item in a Schedule to this Act has effect

according to its terms.

1 After section 74D

Insert:

74E Alpine grazing in Victoria
8
For section 74C (Informing person proposing to take action that
9
action is clearly unacceptable), the Minister:
10
(a) is taken to have received, from the Government of Victoria, a
11
referral of its proposal to allow grazing by cattle in the
12
Alpine National Park for the purposes of a trial as to whether
13
such grazing can assist fire prevention and control; and
14
(b) is taken to have decided under section 74B, on the
15
commencement of this provision, that this Division should
16
apply to the referral for the following reasons:
17
(i) the proposed grazing for the purposes of the trial would
18
have a significant impact on the following listed
19
threatened species and listed threatened ecological
20
communities:
21
(A) Alpine Sphagnum Bogs and Associated Fens;
22
(B) Spotted Tree Frog Litoria spenceri;
23
(C)
Dwarf
Sedge
Carex paupera;
24
(D) Alpine Tree Frog Litoria verreauxii alpina;
25
(ii) the proposed grazing for the purposes of the trial could
26
have a significant impact on the following listed
27
threatened species and listed threatened ecological
28
communities that are known to exist near the grazing
29
sites:

Spot-tailed
Quoll
Dasyurus maculatus
31
maculatus;
32
(B)
Long-footed
Potoroo
Potorous longipes;
33
(C)
Smoky
Mouse
Pseudomys fumeus;

Clover
Glycine
Glycine latrobeana;

(iii) there is no ground for approving the proposed trial
2
because grazing on the scale that would be necessary to
3
achieve any fire control objectives would have an
4
impact on the species and ecological communities
5
mentioned, together with many others, that would
6
outweigh any possible benefits.
