The Parliament of Australia enacts:

Part 1--Preliminary

1 Short title
8
This Act may be cited as the Emergency Water (Murray-Darling
9
Basin Rescue) Act 2008.
10
2 Commence ment
11
This Act commences on the day on which it receives the Royal
12
Assent.

3 Objects
1
The objects of this Act are to empower the Minister and the
2
Murray-Darling Basin Authority:
3
(a) to address the current crisis affecting the Murray-Darling
4
Basin, including making decisions about how best to allocate
5
water:
6
(i) for system maintenance; and
7
(ii) to the environment; and
8
(iii) to water users and holders of a water access entitlement
9
or a water access right;
10
throughout the Murray-Darling Basin; and
11
(b) to share, manage and allocate the Basin water resources and
12
manage all processes that may adversely affect them;
13
as an emergency measure until such time as the Minister approves
14
a Basin Plan that is consistent with the Water Act 2007.

4 Inte rpretation
16
A word or an expression that is used in this Act that is also used in
17
the Water Act 2007 has the same meaning in this Act as it has in
18
that Act.

5 Schedule(s)
20
Each Act that is specified in a Schedule to this Act is amended or
21
repealed as set out in the applicable items in the Schedule
22
concerned, and any other item in a Schedule to this Act has effect
23
according to its terms.

6 Decision that Interim Basin Plan required
5
The Minister may decide that, to address the current crisis affecting
6
the Murray-Darling Basin, an Interim Basin Plan is required, as an
7
emergency measure to apply until such time as he or she approves
8
a Basin Plan that is consistent with the Water Act 2007.
9
7 Authority to prepare Interim Basin Plan
10
(1) If the Minister decides under section 6 that an Interim Basin Plan is
11
required, the Minister must direct the Authority to prepare the
12
Interim Basin Plan and the Authority must prepare the Interim
13
Basin Plan.
14
(2) An Interim Basin Plan prepared by the Authority under
15
subsection (1) must include any determination made by the
16
Minister under section 9, 10 or 11.
17
(3) A direction by the Minister under subsection (1) must provide that
18
the Authority must prepare the Interim Basin Plan and provide it to
19
the Minister within 30 days of the date of the direction.
20
(4) An Interim Basin Plan may include any of the matters that must or
21
may be included in a Basin Plan under section 22 of the Water Act
22
2007, but does not need to include all the detail required in a Basin
23
Plan.
24
(5) A direction by the Minister under subsection (1) is a legislative
25
instrument.

8 Approval of Interim Basin Plan
27
(1) If the Minister gives a direction under subsection 7(1), within 30
28
days of receiving the Interim Basin Plan from the Authority the
29
Minister must either:

(a) approve the Authority's Interim Basin Plan; or
1
(b) approve the Authority's amended Interim Basin Plan
2
provided to the Minister under paragraph (3)(a); or
3
(c) amend the Authority's Interim Basin Plan and approve it; or
4
(d) prepare an alternative Interim Basin Plan and approve it;
5
as an emergency measure to apply until such time as he or she
6
approves a Basin Plan that is consistent with the Water Act 2007.
7
(2) The Minister must, before amending the Authority's Interim Basin
8
Plan under paragraph (1)(c) or preparing an alternative Interim
9
Basin Plan under paragraph (1)(d), consult the Authority.
10
(3) If the Minister consults the Authority under subsection (2):
11
(a) the Authority may amend its Interim Basin Plan and provide
12
the amended Interim Basin Plan to the Minister within a
13
timeframe decided by the Minister; or
14
(b) the Minister may amend the Authority's Interim Basin Plan
15
under paragraph (1)(c) or prepare an alternative Interim
16
Basin Plan under paragraph (1)(d).
17
(4) An Interim Basin Plan approved under subsection (1) is a
18
legislative instrument.
19
(5) When an Interim Basin Plan approved under paragraph (1)(b), (c)
20
or (d) is laid before a House of the Parliament under the Legislative
21
Instruments Act 2003, the Minister must also lay before that House
22
a document that sets out the Minister's reasons for not approving
23
the Authority's Interim Basin Plan under paragraph (1)(a).

9 Matters that may be determined by Minister
25
(1) The Minister may, to give effect to the objects of this Act,
26
determine:
27
(a) interim water sharing regimes; and
28
(b) interim allocation arrangements; and
29
(c) interim storage management; and
30
(d) interim water accounting rules; and
31
(e) rules for arrangements for sale and purchase and movement
32
of water among Basin States; and

(f) the allocation of water for essential system maintenance,

conveyance and environmental purposes; and
2
(g) any other matter necessary to give effect to the objects of this
3
Act.

(2) In making a determination under subsection (1), the Minister must
5
have regard to the matters set out in section 12.
6
(3) A determination under subsection (1) is a legislative instrument.

10 Sharing regime
8
In the interests of sustaining and protecting the environment and to
9
assist in making any determination under subsection 9(1),
10
including in relation to any water resource plan area, the Minister
11
must determine:
12
(a) the share of water needed to maintain Basin water resources
13
in a manner that enables water of reasonable quality to be
14
conveyed to water users, to maintain essential system
15
functions and to maintain water quality; and
16
(b) the share of the remaining non-flood water to which a Basin
17
State is entitled; and
18
(c) the share, if any, to be granted to the environment as a
19
separate and clearly identifiable holder of an inalienable
20
entitlement to water allocations in the water resource plan
21
area.

11 Activities inconsistent with relevant international agreements
23
The Minister may make a determination that certain activities are
24
inconsistent with relevant international agreements.

12 Matters to which Minister must have regard whe n making a

In making a determination under this Act, the Minister must have
7
regard to:
8
(a) the principles set out in the National Water Initiative which
9
have been agreed to by all governments of the
10
Commonwealth of Australia;
11
(b) critical human needs;
12
(c) environmental needs and obligations including international
13
obligations;
14
(d) community needs;
15
(e) the importance of efficient market processes in determining
16
the most appropriate way to use water and to facilitate
17
structural adjustment;
18
(f) the importance to the economy and communities of
19
maintaining permanent plantings;
20
(g) relevant international agreements;
21
(h) the possibility that all or some parts of the Murray-Darling
22
Basin may be experiencing adverse climate change, so that it
23
may not be possible to sustain all forms of water use in the
24
Murray-Darling Basin and that any adjustment burden must
25
shared equitably across the Murray-Darling Basin;
26
(i) the need for economically efficient water use and investment;
27
(j) any other benefits available to particular users of Basin water
28
resources;
29
(k) the need to prevent activities that contribute to the improper
30
use, storage and diversion of water;
31
(l) any other matter to which the Minister considers it necessary
32
to have regard.

13 Constitution of Authority

(1) For the purposes of implementing this Act or an Interim Basin Plan
7
approved under this Act, the Authority consists of:
8
(a) the Chair of the Authority; and
9
(b) the Chief Executive Officer of the Authority; and
10
(c) the 4 other members of the Authority.
11
(2) In order to ensure timely development and implementation of an
12
Interim Basin Plan under this Act, if the Chair or a member of the
13
Authority is appointed under the Water Act 2007 on a part-time
14
basis, then for the purposes of this Act, the Chair and those such
15
members are temporarily appointed on a full-time basis and are to
16
be paid such additional remuneration and allowances as are
17
prescribed in the regulations.

14 Powe rs of Authority in relation to implementation, compliance
19
and enforce ment of Interim Basin Plan
20
(1) The Authority is responsible for implementing an Interim Basin
21
Plan.
22
(2) For the purposes of investigating compliance with and enforcing an
23
Interim Basin Plan, the Authority has the same enforcement
24
powers as it has under the Water Act 2007, except to the extent of
25
any inconsistency with this Act.
26
(3) For the purposes of investigating compliance with and enforcing an
27
Interim Basin Plan, the Authority also has the same enforcement
28
powers as the ACCC and the Minister have under the Water Act
29
2007, except to the extent of any inconsistency with this Act.

15 Trade and comme rce power
4
(1) In trade and commerce, no natural person or agency of a State may
5
limit or impede the transfer or sale and purchase of water access
6
entitlements, water access rights and water allocations among
7
Basin States.
8
(2) In this section:
9
trade and commerce has the same meaning as in paragraph 51(i)
10
of the Constitution.
11
16 Inconsistent State or Territory actions
12
A State or Territory must not act in any manner which is
13
inconsistent with an Interim Basin Plan or a determination made
14
under this Act.
15
17 Activities by constitutional corporations
16
(1) A constitutional corporation, its employees or agents after the
17
commencement of this Act must not impede, without the consent
18
of the Minister or the Authority, the flow of water from the
19
Murray-Darling Basin by:
20
(a) building dams; or
21
(b) building pipelines; or
22
(c) building levies; or
23
(d) building irrigation channels; or
24
(e) sinking bores; or
25
(f) pumping water; or
26
(g) planting crops or trees; or
27
(h) taking part in any other activity, function, relationship or
28
business that results in the diversion of Basin water resources
29
from the Murray-Darling Basin.

(2) A constitutional corporation, its employees or agents after the

commencement of this Act must not take part, without the consent
2
of the Minister or the Authority, in any activity that diverts or
3
significantly intercepts Basin water resources from the
4
Murray-Darling Basin.
5
(3) A consent given by the Minister or the Authority under
6
subsection (1) or (2) must not have any adverse effect on the
7
amount of Basin water resources available for use within the
8
Murray-Darling Basin.

18 Acquisition of property
10
(1) The Minister may, in accordance with any provision of an Interim
11
Basin Plan approved under section 8, acquire from a person on just
12
terms a proportion or all of a water access entitlement or a water
13
access right in a water resource plan area, or any land associated
14
with an acquired water access entitlement or an acquired water
15
access right if appropriate, for one or both of the following
16
purposes:
17
(a) maintaining the reliability of water access entitlements and
18
water access rights; or
19
(b) returning water use to sustainable limits.
20
(2) If the Commonwealth and the person do not agree on the amount to
21
be paid, the person may institute proceedings in the Federal Court
22
of Australia for the recovery from the Commonwealth of such
23
reasonable amount as the court determines
24
(3) In this section:
25
acquisition of property has the same meaning as in
26
paragraph 51(xxxi) of the Constitution.
27
just terms has the same meaning as in paragraph 51(xxxi) of the
28
Constitution.

19 Declaration of taxation schemes detrime ntal to management of

Basin water resources

(1) The ACCC must inquire into the effects of arrangements in the
3
Income Tax Assessment Act 1997 on:
4
(a) the water market; and
5
(b) the nature of irrigation practice and investment;
6
and provide advice to the Minister based on the outcome of the
7
inquiry.
8
(2) Acting on the advice of the ACCC, the Minister may determine
9
that a taxation scheme is detrimental to management of the Basin
10
water resources.
11
(3) The Minister must give a copy of a determination made under
12
subsection (2) to the Treasurer.
13
(4) If the Minister gives a copy of a determination to the Treasurer
14
under subsection (3), the Treasurer must cause a report to be
15
prepared in response to the determination.
16
(5) The Treasurer must cause a copy of a report prepared under
17
subsection (4) to be laid before each House of the Parliament
18
within 15 sitting days of that House after the completion of the
19
preparation of the report.

20 Failure to comply with Interim Basin Plan made under this Act
21
(1) If a Basin State fails to comply with an Interim Basin Plan or any
22
determination made under this Act, the Minister must assess:
23
(a) the impact of that failure to comply on the other shares
24
determined under section 10 in the Basin water resources;
25
and
26
(b) the quantitative effect of that failure to comply on the Basin
27
water resources.
28
(2) If a Basin State fails to comply with any determination made under
29
this Act, the Minister must by determination reduce that Basin
30
State's share in the Basin water resources as determined under
31
section 10 by ten times the quantitative effect of that failure to
32
comply as assessed under paragraph (1)(b).

(3) If a Basin State, after the Minister under subsection (2) reduces that

Basin State's share in the Basin water resources, continues to fail
2
to comply with an Interim Basin Plan made under this Act, the
3
Minister must apply for an injunction against the Basin State under
4
section 140 of the Water Act 2007.

21 Inconsistent Commonwealth laws
4
(1) If a provision of this Act is inconsistent with a provision of any
5
other law of the Commonwealth, the relevant provision of this Act
6
has effect despite the provision of that other law and that provision
7
of the other law is, to the extent of any inconsistency, invalid.
8
(2) A provision of this Act and a provision of any other law of the
9
Commonwealth must not be taken for the purposes of this section
10
to be inconsistent to the extent that they are capable of operating
11
concurrently.

22 Application of Legislative Instruments Act 2003
13
A determination made, or an Interim Basin Plan approved by, the
14
Minister under a provision of this Act is a legislative instrument for
15
the purposes of the Legislative Instruments Act 2003.
16
23 Annual report by Minister
17
(1) As soon as practicable after each 30 June, the Minister must cause
18
to be prepared a report on the operation of this Act for the 12
19
months ending on that 30 June.
20
(2) The Minister must cause a copy of a report prepared under
21
subsection (1) to be laid before each House of the Parliament
22
within 15 sitting days of that House after the day on which the
23
Minister receives the report.
24
24 Regulations
25
The Governor-General may make regulations prescribing matters:
26
(a) required or permitted by this Act to be prescribed; or
27
(b) necessary or convenient to be prescribed for carrying out or
28
giving effect to this Act.

180A Chief Executive Officer
8
(1) There is to be a Chief Executive Officer of the Authority.
9
(2) The Chief Executive Officer is to be appointed on a full-time basis.
10
(3) The Chief Executive Officer is to be appointed by the
11
Governor-General by written instrument.
12
(4) The Chief Executive Officer is appointed for the period specified
13
in his or her instrument of appointment. The period must not
14
exceed 4 years.

Note:
For re-appointment, see subsection 33(4A) of the Acts Interpretation
16
Act 1901.

180B Duties
18
(1) The Chief Executive Officer is responsible for the day-to-day
19
administration and management of the Authority and the control of
20
its operations.
21
(2) The Chief Executive Officer is to act in accordance with any
22
policies determined, and any directions given, by the Authority in
23
writing.
24
(3) The Chief Executive Officer has such other duties (if any) not
25
covered by this Act that are determined by the Governor-General.

180C Delegation
1
The Chief Executive Officer may, in writing, delegate to a member
2
of the staff of the Authority all or any of the duties or powers of the
3
Chief Executive Officer, unless the regulations otherwise provide.

180D Standing obligation to disclose interests
5
(1) The Chief Executive Officer must disclose any interest the Chief
6
Executive Officer has if that interest could conflict with the proper
7
performance of the duties of the Chief Executive Officer.
8
Disclosure is required whether or not there is any particular matter
9
under consideration that gives rise to an actual conflict of interest.
10
Note:
The Chief Executive Officer must also disclose the interest under
11
section 180E if the interest is in a matter being considered or about to
12
be considered by the Authority.
13
(2) The disclosure must be by written notice given to the Minister as
14
soon as practicable after the Chief Executive Officer becomes
15
aware of the potential for conflict of interest.
16
(3) Subsection (1) applies to interests:
17
(a) whether direct or indirect, and whether or not pecuniary; and
18
(b) whether acquired before or after the Chief Executive
19
Officer's appointment.

180E Obligation to disclose interests before conside ring a particular
21
matter
22
(1) If:
23
(a) the Chief Executive Officer has an interest in a matter being
24
considered or about to be considered by the Authority; and
25
(b) the interest is an interest that could conflict with the proper
26
performance of the duties of the Chief Executive Officer, as
27
those duties give the Chief Executive Officer a role in
28
deciding a matter;
29
the Chief Executive Officer must disclose the nature of the interest
30
to a meeting of the Authority.

(2) The disclosure must be made as soon as possible after the relevant
1
facts have come to the Chief Executive Officer's knowledge.
2
(3) The disclosure must be recorded in the minutes of the meeting of
3
the Authority.

(4) Unless the Authority otherwise determines, the Chief Executive
5
Officer:
6
(a) must not be present during any deliberation by the Authority
7
on the matter; and
8
(b) must not take part in any decision of the Authority with
9
respect to the matter.
10
(5) For the purposes of making a determination under subsection (4),
11
the Chief Executive Officer:
12
(a) must not be present during any deliberation of the Authority
13
for the purpose of making the determination; and
14
(b) must not take part in making the determination.
15
(6) A determination under subsection (4) must be recorded in the
16
minutes of the meeting of the Authority.
17
(7) Subsection (1) applies to interests:
18
(a) whether direct or indirect, and whether or not pecuniary; and
19
(b) whether acquired before or after the Chief Executive
20
Officer's appointment.

180F Outside employment
22
The Chief Executive Officer must not engage in paid employment
23
outside the duties of the Chief Executive Officer's office without
24
the Minister's approval.
25
180G Remuneration and allowances
26
(1) The Chief Executive Officer is to be paid the remuneration that is
27
determined by the Remuneration Tribunal. If no determination of
28
that remuneration by the Tribunal is in operation, the Chief
29
Executive Officer is to be paid the remuneration that is prescribed
30
in the regulations.

(2) The Chief Executive Officer is to be paid the allowances that are

prescribed in the regulations.

(3) This section has effect subject to the Remuneration Tribunal Act
3
1973.

180G Leave of absence
5
(1) The Chief Executive Officer has the recreation leave entitlements
6
that are determined by the Remuneration Tribunal.
7
(2) The Minister may grant the Chief Executive Officer leave of
8
absence, other than recreation leave, on the terms and conditions as
9
to remuneration or otherwise that the Minister determines.

180H Resignation
11
(1) The Chief Executive Officer may resign his or her appointment by
12
giving the Governor-General a written resignation.
13
(2) The resignation takes effect on the day it is received by the
14
Governor-General or, if a later day is specified in the resignation,
15
on that later day.

180I Termination of appointme nt
17
(1) The Governor-General may terminate the appointment of the Chief
18
Executive Officer for misbehaviour or physical or mental
19
incapacity.
20
(2) The Governor-General may terminate the appointment of the Chief
21
Executive Officer if:
22
(a) the Chief Executive Officer:
23
(i) becomes bankrupt; or
24
(ii) applies to take the benefit of any law for the relief of
25
bankrupt or insolvent debtors; or
26
(iii) compounds with his or her creditors; or
27
(iv) makes an assignment of his or her remuneration for the
28
benefit of his or her creditors; or

(b) the Minister is satisfied that the performance of the Chief
1
Executive Officer has been unsatisfactory; or
2
(c) the Chief Executive Officer is absent, except on leave of
3
absence, for 14 consecutive days or for 28 days in any 12
4
consecutive months; or
5
(d) the Chief Executive Officer engages, except with the
6
Minister's approval, in paid employment outside the duties of
7
his or her office; or
8
(f) the Chief Executive Officer fails, without reasonable excuse,
9
to comply with section 180D or 180E.

180J Other terms and conditions
11
The Chief Executive Officer holds office on the terms and
12
conditions (if any) in relation to matters not covered by this Act
13
that are determined by the Governor-General.

(1) The Minister may appoint a person to act as the Chief Executive

Officer:
18
(a) during a vacancy in the office of Chief Executive Officer,
19
whether or not an appointment has previously been made to
20
the office; or
21
(b) during any period, or during all periods, when the Chief
22
Executive Officer:
23
(i) is absent from duty or Australia; or
24
(ii) is, for any reason, unable to perform the duties of the
25
office.

Validation

(2) Anything done by or in relation to a person purporting to act under
28
an appointment is not invalid merely because:
29
(a) the occasion for the appointment had not arisen; or
30
(b) there was a defect or irregularity in connection with the
31
appointment; or

(c) the appointment had ceased to have effect; or

(d) the occasion to act had not arisen or had ceased.

Repeal the subsection, substitute:

(2) For the purposes of the Public Service Act 1999:

(a) the Chief Executive Officer and the Authority staff together
7
constitute a Statutory Agency; and
8
(b) the Chief Executive Officer is the Head of that Statutory
9
Agency.
