The Parliament of Australia enacts:

1 Short title
6
This Act may be cited as the Family Assistance and Other
7
Legislation Amendment Act 2013.

2 Commencement
9
(1) Each provision of this Act specified in column 1 of the table
10
commences, or is taken to have commenced, in accordance with
11
column 2 of the table. Any other statement in column 2 has effect
12
according to its terms.

1 Section 66

Repeal the section, substitute:

66 Amount of baby bonus
6
General rule
7
(1) Subject to this section, the amount of baby bonus for an individual
8
in respect of a child is as follows:
9
(a) if the individual is eligible for baby bonus under
10
subsection 36(2) and the child is the first child born alive to
11
the woman who gave birth to the child--$5,000;
12
(b) if the individual is eligible for baby bonus under
13
subsection 36(3) and the child is the first child that becomes
14
entrusted to the care of the individual, or the individual's
15
partner, in the circumstances mentioned in
16
paragraph 36(3)(b)--$5,000;
17
(c) if the individual is eligible for baby bonus under
18
subsection 36(4), the child is the first stillborn child of the
19
woman who gave birth to the child and the woman has not
20
given birth to any other children--$5,000;
21
(d) if the individual is eligible for baby bonus under
22
subsection 36(5) and the child is the first child that becomes
23
entrusted to the care of the individual, or the individual's
24
partner, in the circumstances mentioned in paragraphs
25
36(5)(a) to (b)--$5,000;
26
(e) otherwise--$3,000.

Multiple children cases
28
(2) The amount of baby bonus for an individual in respect of each
29
child born during the same multiple birth (including any stillborn
30
child) is $5,000.
31
(3) If an individual is eligible for baby bonus under subsection 36(3) in
32
respect of 2 or more children who become entrusted to the care of

the individual, or the individual's partner, as part of the same

entrustment to care process, the amount of baby bonus in respect of
2
each child is $5,000.

(4) If an individual is eligible for baby bonus under subsection 36(5) in
4
respect of 2 or more children who become entrusted to the care of
5
the individual as part of the same adoption process, the amount of
6
baby bonus in respect of each child is $5,000.

Shared baby bonus
8
(5) If, under paragraph 37(3)(b), the Secretary has determined the
9
percentage that is to be an individual's percentage of baby bonus in
10
respect of a child, the amount of baby bonus for the individual in
11
respect of that child is that percentage of the amount worked out
12
under subsections (1) to (3) of this section.

(3) This subsection applies to an individual for the bonus test day if, at
2
any time before the end of the calendar year in which the bonus
3
test day occurs, the Secretary is notified, or otherwise becomes
4
aware, that:
5
(a) if the individual is eligible under subsection 35UE(1) for
6
schoolkids bonus on the bonus test day--the individual:
7
(i) undertook full-time study in respect of a secondary
8
course (within the meaning of subsection 543A(2AB) of
9
the Social Security Act 1991) on at least one day during
10
the previous education period for the bonus test day; or
11
(ii) undertook, or will undertake, full-time study in respect
12
of a secondary course (within the meaning of
13
subsection 543A(2AB) of the Social Security Act 1991)
14
on at least one day during the current education period
15
for the bonus test day; or
16
(b) if the individual is eligible under subsection 35UE(3) for
17
schoolkids bonus on the bonus test day--the individual:
18
(i) satisfied the secondary study test within the meaning of
19
section 35UI on at least one day during the previous
20
education period for the bonus test day; or
21
(ii) satisfied, or will satisfy, the secondary study test within
22
the meaning of section 35UI on at least one day during
23
the current education period for the bonus test day; or
24
(c) in any case--the individual:
25
(i) undertook an eligible activity on at least one day during
26
the previous education period for the bonus test day; or
27
(ii) undertook, or will undertake, an eligible activity on at
28
least one day during the current education period for the
29
bonus test day.
30
(3A) This subsection applies to an individual for the bonus test day if:
31
(a) the individual is eligible under subsection 35UE(2) for
32
schoolkids bonus on the bonus test day; and
33
(b) the individual:
34
(i) undertook full-time study in respect of a course of
35
education determined, under section 5D of the Student
36
Assistance Act 1973, to be a secondary course for the
37
purposes of that Act on at least one day during the
38
previous education period for the bonus test day; or
39

(ii) undertook, or will undertake, full-time study in respect

of a course of education determined, under section 5D

during the current education period for the bonus test
5
day; or
6
(iii) undertook an eligible activity on at least one day during
7
the previous education period for the bonus test day; or
8
(iv) undertook, or will undertake, an eligible activity on at
9
least one day during the current education period for the
10
bonus test day.

(b) there is a change in circumstances that may affect the

individual's eligibility for schoolkids bonus on a later bonus
21
test day or the amount of schoolkids bonus for the individual
22
for a later bonus test day;

the individual must, in the manner set out in a written notice given
24
to the individual under subsection (3) and as soon as practicable
25
after the change in circumstances, notify the Secretary of that
26
change.

(2) The Secretary must approve a manner of notification that an
28
individual is to use when notifying the Secretary of a thing under
29
subsection (1).

(3) The Secretary must, by written notice, notify the individual of the
31
approved manner of notification.
