The Parliament of Australia enacts:

1 Short title
6
This Act may be cited as the Financial Assistance Legislation
7
Amendment Act 2009.

2 Commence ment
9
This Act commences on the day on which it receives the Royal
10
Assent.

Each Act that is specified in a Schedule to this Act is amended or

repealed as set out in the applicable items in the Schedule

concerned, and any other item in a Schedule to this Act has effect

according to its terms.

Insert:

(6A) Despite subsection (6), if the Minister considers that it is
10
appropriate, the Minister may decide that an amount payable to a
11
State under subsection (4) is to be paid at such times, and in such
12
instalments, as the Minister decides. The Minister cannot decide
13
that an amount is to be paid later than it would be paid under
14
subsection (6).

Example: The Minister may decide that an amount payable to a State in resp ect
16
of a year be paid in one payment during that year.

(6B) If the Minister makes a decision under subsection (6A) in relation
18
to a State, the Minister must, as soon as practicable, notify the
19
Treasurer of the State in writing of the decision.
